What if your LLC is registered in WY but I live in CA? I do not conduct any business in CA. I just operate my WY LLC from my home office in CA. Do I still have to register the LLC as A Foreign entity in CA and pay the $800 minimum tax?

Yes. The fact that you operate your business from California, means that you have a physical Nexus there and must register and pay the franchise tax

Thank you for your video. I own a Digital marketing Delaware corporation. I am living in California with clients in Arizona and Idaho, I do not have clients in California. Do I have a significant presence?

Yes, it looks like you are the main decision-maker in the company therefore your corporation has a physical presence in California. Unless you choose to hire a manager to manage the corporation for you and be a passive investor as long as you don’t participate in the day-to-day operations of the company. The $800 are due when you file taxes? Every year?

Your first $800 franchise tax is due on the 15th day of the 4th month after registration of your entity. For example, if you formed your LLC on March 10 2023 - your first $800 payment will be due on July 15th In subsequent years it is due on April 15th. You must pay it separately on the Franchise tax board’s website or have your tax preparer make a payment for you

Hello, i live in nevada my llc is registered in nevada but 95% of the work is in california so when i do taxes i pay california taxes, what could you suggest? Should close my llc in nevada and open a new one in CA? Or open a foreign llc in CA and pay taxes in both states but i am not working that much in NV only like $5,000 a year in NV, i would appreciate your help of what i should do thank you!

Since you are a Nevada resident, your LLC has a nexus in Nevada too. We recommend obtaining a foreign qualification in California. Unfortunately that will make you pay franchise tax in both states. If you need help with tax filing, please email us at info@goglobal.world We will be glad to help
