Agreed on the rant. Perhaps tuning shops could insist customers sign a detailed disclaimer, promising that they will not use it on the road/will not do 150 on the bypass/will slow down outside schools and old peoples' homes and so on before releasing a vehicle. I know it would feel a bit daft, but if it saves getting prosecuted, might be worth considering. Re. Rick's analogy with the barman, in the US, bar staff can be prosecuted if they serve drink to someone who is intoxicated. The world's going mad. What happened to personal responsibility?

This is the rule for the UK... Can a pub serve a drunk person? It is an offence to sell alcohol to a person that is already drunk. You can also refuse entry to the premises to a drunk person, with door staff able to assist should they be employed.

I 100% agree with you Rick, too many helmets out there who say they are vehicle repair specialists or tuning specialists. With no training whatsoever. How is this regulated! It’s not! I have to spend the best part of £15,000 each a year on training my techs and even more to Develop them to Master Tech’s. There is continuous Development In Place every year to learn about the latest repair methods. I get questioned daily about why i charge for diagnostic work. Apparently all i do is plug in a diagnostic laptop and it tells me what the problem is. If it’s that easy why don’t you fix it yourself is normally my response. But Freddy who got a Halfords Socket set and eBay scanner for his 18th Birthday is allowed to work on these vehicles without as much as a KZbin Video on how to fix a problem. Anyone looking to prosecute someone with a Penis & Balls Map i’d be asking them what their level of vehicle knowledge is. Has the judge got an Advanced Automotive Engineering Qualification probably not. If i purchase something from you or any other Vehicle Tuning Company and use it in an illegal state that is my fault and my fault only. I’ve been the knob who committed an offence. Not the person selling it to me. Does that mean if i buy a car that is capable of more than 70mph and get caught speeding, is that the fault of the manufacturer? NO! Best of luck pal and ensure you have a disclaimer signed on every invoice paid for. Rant Over, I’m now wound up for the entire day 🤣👍.

Perfectly valid point Ricky. 👍 The only way forward is to get a disclaimer signed by the customer to accept the responsibility of operating the vehicle after illegally after any modifications have been made. The authorities going after the businesses that tuned these vehicles need to look at better regulations and training of the whole industry - there are some terrible sub standard and dangerous practices that need addressing first.

In this country you have to tell the insurer about mods, it's their engineer that decides if they will insure it or not without any determination on the legality. Anywhere else that actually monitors this type of thing uses and MOT type system to approve e.g. TUV in Germany and many similar set-ups elsewhere in europe or " Engineering Approval" in Oz and NZ.

I drive 1100bhp Nissan Gtr r35. Ive always loved cars. Bought my first car at the age of 14. I agree with you for the most part, however, performance car owners need to be more responsible and considerate. If you drive a car with a loud exhaust think twice before accelerating hard in a 30 limit, especially if there are houses and kids nearby. If it’s after 19:00 in evening don’t be accelerating hard near people’s houses and running pops and bangs maps. 9 out of 10 people do not want this going on outside their houses. It’s only going to result in complaints to the authorities and we are going to end up getting taxed off the road or changes to emissions, noise limits etc will mean use of our performance cars on the road will soon be a thing of the past.

Ricky, I understand your rant, totally. In the USA as you are aware the EPA are targeting these tuners and the fines are massive. The environmental improvements trying to clean up air pollution include improving emissions from ICE vehicles. The UK has one of the most permissive countries in the world to allow individuals and businesses to work on cars and engines. Germany you have change tyres every year, you can't fit non TUV parts. As legislation tightens its emission levels are going to tighten... Engine builders and tuners will be restricted on what they will be able to do. I love cars and engines but they will be legislated against and the screw will tighten and selling non homologated parts will result in court cases. Change is a coming and it's not going to be pops and bangs all round...

Ermm You don't have to change tyres every year , you have to use suitable tyres for the weather , you can either have 2 sets one summer one winter or use "snowflake" marked all season tyres all year round , either way those tyres can be used for multiple years condition/wear based.

Don’t disagree with anything you said about tuning mate, but the part I think is missing is that nobody can self regulate any more, it’s the same as the stupid race fit exhausts and ‘growlers’ on bikes, people are obsessed with pushing things as far as they possibly can then moaning that they get fingered. I live near Thamesdown drive and honest it’s just traffic light Grand Prix and pops and bangs and totally straight piped cars… this doesn’t change your very valid point that it’s not YOUR fault, but I just think it is a dimension of the argument, that people just want to take everything to the extreme. Same as the pub thing, 5-6 pints with your mates, act like an adult, have a laugh and don’t end up tying up 4-5 nurses and admin at the hospital and they could treat people who are dying of stuff they didn’t choose. people will always want to make their cars faster, I agree with your rant completely, If anyone is taken to court over a car it should always be the driver, if I drove a mates car and got pulled to find it has a bald tyre, the police would give me the points not the car owner, stating that it is up to the driver to make sure everything is legal before you drive. Be very careful with disclaimers, they are handy for getting rid of the numpties but you cannot rely on disclaimers if you are going to court. It’s the minority of customers that make the job hard, if there is a trick in life it’s avoiding that 1%, Ricky seems to do a good job of avoiding them 😊

The thing is, car manufacturers have to make cars that fulfill emission standards and make provisions to prevent tampering with these is to ensure the vehicle will keep within emission standards for a specific time frame and distance traveled. You have seen what happened in Dieselgate when the manufacturers didn't do this properly. It has been many years since this legislation is in place. When a company manages to break the anti-tampering that manufacturers have to put in and knowingly modify the software (and/or hardware) they should obviously be aware that the vehicle will no longer fulfill the homologation requirements. Putting the requirement on the tuning companies to ensure that cars aren't used on the public road after the software has been modified is maybe a bit steep, but just for legal liability, I think it is fair to have the customer sign a waiver where they state that they are aware that the modification performed makes the car illegal to drive on the public road and that this modification will make the car be legal to be used on private grounds (track) only. They will have to also state that the company doing the modification will not be liable if the owner decides to break the law and if a magistrate decides they are, the customer will be fully liable for all costs and damages that the company performing the modification endures as a result of the customer breaking the law. It's not really what you want, but if you want to make money on putting pops and bangs on some barryboys shitbox, you will need to cover your behind....

If you want to do major car mods in Oz the first thing you need to do is find an approval engineer to certify the finished vehicle and that cost serious money. All workshops are licensed and must have a minimum level of equipment and all technicians are licensed after an approved apprenticeship. Smashed write off's are put into a data base so they can be tracked but even with all the above the shonks still get away with selling cars that should be crushed.

The percentage of owners that get their cars is very low, there are so many people changing exhausts, tuning etc etc without even talking to an engineer so many of these cars would be illegal on the road but the industry isn’t as scrutinised in Australia as it is in other countries

Also, why is it that certain sounds that some people don't like mean the people that like them can't have them? It's like if some people didn't like silver cars then silver cars get banned... I live in Germany. Any modification to a vehicle needs to be documented on the vehicle paperwork and needs to pass the MOT. TUV..... Then it's legal. As you just said it's fair in Germany

The offroad bike salesman will not be held responsible because because most of his customers use the bike on offroad private tracks most of the time. "Tuning companies" make most of their money on cars that get used on the public road. If 95% of what they do gets used illegally, even though their own work is not, a case for "aiding and abetting in a crime" will make it in court, especially if they don't do "enough" to prevent this from happening. I doubt most of these companies could even exist if it wasn't for cars that get used on the public road, so it is obvious that law enforcement is coming after them.

In Australia you have to be a qualified mechanic before you work on cars, to be qualified you have to do an apprenticeship (I think its 4 years). Its the same for Electrician / Plumber etc. It's stupid. There is no way to change career later in life without doing the whole apprenticeship. I'm sure people will reply to this with all sorts of reasons justifying this but the real reason is the unions controlling the industries and keeping wages high. It doesn't stop the 'muppets' there are still plenty of qualified 'muppets'. At the same time the Aus version of an MOT is a complete joke that checks very little. BTW Aus bar staff are responsible to ensure they don't server drunk people !!!

The law is pretty clear, Onyx deCatted a car and charged them for it. This is classed as aiding and abetting a crime as I the customer am paying Onyx to make my car not comply with something that other road users have to pay for at an MOT to pass in order to drive on public roads, hence the £5000+fees fine. Onyx, Ricky or any business can do any modification, but most businesses have you sign a waiver stating I am responsible now.

Mate, I'm no legal eagle, but what lawyer represented the two business and what defense did they put up ? Your knowledge of the main motor brands releasing stock cars from the forecourt with P&B as standard, should have been used in defense. This reference with proof should have put into question fairly the situation. The main motor brands should contribute to the fine given the two business did not dob them in. I suspect the main performance car brands have very small print in the purchase contract, that a Philadelphia lawyer could not get to them ! Time to up-date your customer T&C's to cover your ass.

Ricky on the R8 bearings, Acidic oil contamination I’ve seen this years ago on laid up cars where when they have not done much milage but the car has been stood the oil as it ages turns acidic and eats the shells.

I am late on this but the car with the bearing issues, did it run E85? That pitting can be common with an E fuel car that has oil contamination then sits for a bit. Start it, move, shut down before oil is at full temp and you burn the E off, absorbs water and you see the pitting (basically corrosion) in the bearing surface.

Had that kind of wear on a few BMW M and S 1000rr's cavitation caused by air pockets in the oil bursting under pressure and taking away material from the shells, like you say that's usually caused from oil degregation and or to high RPM/ overspeed. We were told by BMW to increase the bearing clearance so a thinner walled bearing to increase the oil film between crank and bearing

Yes I agree, ive dealt with Chch Sockburn testing station and can thoroughly recommend the process. all my welds were inspected and mods were checked by an ENGINEER of similar experience to me and then it was signed off im more than happy with the process ..( remember NZ was famous for its n0 8 wire )

As a landlord we are responsible for a customer who leaves. The test case was a young man upset left a pub, went to 3 other bars and was refused entry. He then took his own life by jumping in a river. All the bars were fined and had their licenses reviewed for not showing him a duty of care. Even though he never came in the premises.

You're dead right Ricky. Business owner must get a disclaimer signed, and the vehicle trailered away from the premises. I would go further and get a bloody big stamp made that would go across an A4 invoice corner to corner and use red ink to stamp "This vehicle MUST NOT BE USED ON THE PUBLIC ROAD" and see how the courts view that. The snowflakes are coming for everybody, so much so that we will soon be six foot under in a fucking snowdrift!

Ref the pub hypothesis....ironically..... S.141 of Licensing Act makes it an offence to “knowingly” sell or attempt to sell alcohol to a person who is drunk. The bar person serving the customer is liable for a fixed fine of £80.00. Which is routinely ignored in this country. Pops and bangs are annoying though. They serve no purpose other than 'look at me'. You aren't driving a WRC car with antilag.

Agreed, however I would say that the likes of Mat Armstrong being a knob on his channel making jokes along the lines of "oh, I just turned my back for 2 minutes and someone robbed the cat off my car", plus associated stupidly loud exhaust systems, aren't helping one little bit.

Sorry, got to disagree here. Look at any number of tuners websites and you'd be hard pressed to find more than a couple that state "not for road use" or state its not legal to use on the road afterwards. Not to mention those that are blatantly selling services like dpf/egr removal etc. Ultimately the tuners blatantly *know* it's illegal and are turning a blind eye. You compare it to a barman selling a drink to someone who's going to go home and beat up their partner but its more like the barman turning a blind eye to an 18 year old buying a round of alcoholic drinks for a table of 14 year olds. It's right in front of them. The issue as ever has been those that have taken the piss, there are a couple of knob jockeys round here who have what can only be described as the "Battle of Seelow Heights" map, it's an artillery barrage not a pop or little bang, utterly obnoxious. Those are the kind of examples that people see and complain about.

As an ex mechanic/tester Iv been saying this shit for years and this is the reason mechanics pay is so low in comparison to lets say an electrician or plumber. There’s nothing stopping g Dave the shelf stacker stripping his brakes down on Sunday and killing 10 people on the M1 on Monday! Zero regulation in the trade.

idk, if you did a bad job, like you were supposed to do the brakes then a car crashed you'd probably deserve a fine or w/e. so if you do a good job of making the car no longer road legal and watch it drive away, then you probably get a fine too, whether right or wrong. i think you'd probably find a lot of other industries are actually liable for similar things. i don't think it has anything to do with snowflakes or 'these days' or w/e either, just timeless bureaucracy, same as it ever was, same as it always will be.

If a barman serves an under 18 that breaks the law and the landlord would be liable. Otherwise the act of serving alchohol is legit and the person is responsible for their own actions if they go and give someone a beating later. If a tuner removes a CAT from a 'road car', they do that knowing it's breaking the law for that car to be driven on the public road. Tuners need to force the disclaimer forms as a start point.

Ya got to realise judges and lawyers don’t live in the real world , they’re not liable for their actions and time is nothing to them as they get paid by the hour whatever the result. They don’t give a fcuk, as long as they get paid . Laws a joke mate and they’ve had hundreds of years to perfect their scam . I'm all for free expression but some p's n b's are too loud and none stop. The down shift pop and burble I great. Parked up in a st/rs/r32 etc nearly blowing the exhaust off is bringing unwanted attention for the old bill and residents miles away.
