Sir...please answer my question . ‘A’ sues ‘B’ for certain land in his personal capacity. The suit is heard and dismissed. Against ‘A’ sues ‘B’ for the same land in the same court as Mutawali. Is the subsequent suit barred by Res Judicata? Give reasons in support of your answer and also refer to the case law on the point, if any.

I have one doubt One person filed case in munsif about possession and boundary the court appointed commission based on commission report injunction issued it is favourable to defended. Again plantif appeal to district court the orderd no one both plentif and defended no to damage the boundery line and to tresspass possession of both parties. After three years plantif and others give to same issue raised indirectly they ask putting of boundary and inthat case another commision appointed it is pending Is res judicate applicable
