Because it's not. If you look closely, you can see it's a Black Series head that was spray painted white. There's no flash from the mold, we never see him modify it to fit the neck peg as there isn't a part to the mold to account for it. He should be called dishonest restore.

Without knowing exactly which 12 inch Darth Vader that is, replacing his head would be very difficult as some of these figures have removable helmets. Moreover, my recollection is that - as with the smaller action figure - one hand is out flat with the fingers fully extended and the other is curled so as to grip the lightsaber.
