Rivers: Appeal Court Budget Judgement Will Only Affect Acts that Are Yet to Be Implemented - Adegoke

The decision of the Court of Appeal, which has nullified the 2024 budget, will affect acts carried out in pursuance of the implementation of the budget. It is unlikely that Acts that have been expended and payments made for such expenditure will be reversed

One thing that disgusts me a lot about many Nigerians is that we unnecessarily allow emotions to prevail over reality and facts many time than none, especially when it's about the political matters. We accept facts when it fulfils our sentiment and fight it when it's other way round. I don't know whatever version of the narrative that caused all this in the first place you believe, but the question is where in the world where democracy is practiced is a 3 member house will prevail over 15+ members? This is just a simple common sense. Democracy as it's called is simply a game of numbers, even Harris in one interview in this coming US election was asked how she will fund an economical policy she promised if she wins without house majority, she said she will romance the opposition too see in her direction, that's politics and democracy for you, not sonsenaical emotional sentiment. Fubara is the leader of the state, he should find every ways to run his state even when he doesn't have the majority, that's his problem/headache. But thinking it will be done disobeying the law that legitimises his own position himself or by soliciting for social sympathy is the best way to go, then that even further verifies he wasn't capable enough to be in the position he's holding. 🇳🇬 God Bless Nigeria 🇳🇬

The judgment by the Court of Appeal in Abuja did not reinstate the Martins Amaewhule-led faction of the State House of Assembly. The court only addressed matters related to the passage of the state’s 2024 Appropriation Law and the National Assembly’s temporary assumption of legislative duties in Rivers State. Amaewhule and 26 other members lost their seats following their defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) on December 11, 2023. Their defection triggered Section 109(1)(g) of the 1999 Constitution, which automatically vacates the seat of any lawmaker who changes political parties without a crisis in the party under which they were elected.

Gov. Fubara should be forgiven and be allowed to conduct an election to fill the vacant seats and then come and present the budget properly because in actual sense the 27 law makers have been defected. They cannot deny. It is there on record.

The Judiciary really has not been helpful at all in recent times. Is the Appeal Court insinuating that Rivers state has no House of Assembly? The last time I checked, Governor Fubara cannot compel INEC to conduct an election to fill the seats vacated by Wike's boys. If the main issue is that of quorum then I don't see who the Appeal Court expects Governor Fubara to present the budget to.
