The legitimacy count's and the recent Court of Appeal is a clear directive to legitimate LEGISLATION including the State High Courts jurisdiction is emphatic including every other previous actions and Courts pronounments and verdicts are of no effect If any side likes go to the Court that has competent jurisdiction and lodge their own side of the legality and legitimacy Their vacation is party and not their seats. So if you want their seats vacation SIMPLY CONDUCT ANOTHER CREDIBLE ELECTION and without that and that means there's no Assembly in Rivers State as at now and the Governor Can't Determine the affairs of the Legislative Arm since it's not under military control but Democratic voters government

There's no crisis in Rivers state, it's just an issue of perception. It's rather an opportunity to have stronger institutions rather than strong people. State house of assembly shouldn't be under the control of the executive. Those 25 members are heroes of democracy!

Charles is speaking from both sides of his mouth and guilt-tripping his guest for being an interested party (unnecessarily). He agreed that the act is not self-executory, meaning nobody/institution has declared the seats vacant. The only injuction that restrains Amahewule has now been trashed. Hence the 27 are still members and (the head) can parade as speaker. Straight forward (no ambiguity)! To worsen the matter, a suspended member is the one beign a factional speaker.... I'm really sorry for Fubara. It is really messy for him now; So many mines of impeachable offences. I agree with Monday Ubani. Only a political solution can help Fubara.

Rt Hon Oko Jumbo did not start parading himself as the speaker based on the court decision, he was the speaker before he approached the court to get a restraining order on Martin and his group to stop parading themselves as members, the court now says go back to status before you approach the court. 2. Rt Hon Oko Jumbo Speaker go to federal high court to make your request not the state high court. That is Rt Hon Jumbo continue to be the speaker. Martins can also call himself speaker does not mean he is the speaker since legally he is no longer a member of the house but to force him to stop parading himself you need a court order if he will not stop by his own sense.

The same way eddison was removed as majority leader and suspended as a member of the house, then the next day he goes to government house and declared himself speaker we have now seen how that ended 😂😂😂 you hear the sen reference the federal high court ruling stating that eddison was never speaker of the rivers state house of assembly and all actions taken by him is nil and void. So again who declared the seat of the 27lawmakers vacant? The same Edison whom the court already ruled was never speaker?😂😂 see how your logic falls apart? Now to address the actual defection. The said lawmakers has said they never actually defected and the pdp joined the case and testified that they were still members of the pdp ( now in my own personal opinion I believe they are lying, we all saw them defect with our own two eyes, but the law does not care about our opinions, evidence and facts is what matters in court and no one has been able to provide an actual admissible evidence showing they defected ) that being said, even if they defected, the law actually gives them the right to defect if there was division in their party at the time of their defection, and they claim the rancor over who the national secretary of the pdp was at the time, and ayus lawsuit over his sacking ,meets the bar for the division the law stipulates. ( again I disagree with them on these and I believe it does not meet that bar, but again the law does not care about my opinions) so since they claimed that tussle meets the bar for defection, the problem is, it’s not my job or yours or fubara, and his cronies to determine wether that meets the standard for defection . That’s the job of the federal high court and courts above it to make that determination. And until that is done they remain members of the house and Martin’s remains speaker of the house until a court determines otherwise .

Charles was only explaining what he read in the Constitution. Written in plain English. Once any Assembly member including the speaker defects, whoever the new speaker is should declare the seats vacant. 😂 Mr Ehie was the speaker in December and he was the person who declared the seats vacant. Amaehule and co should now go to court to challenge the speakers ' declaration and should wait for the court's judgment. 😢

You are aware that the criminality of putting an entire state in one person's pocket was introduced by the certificate forger, Tinube. Someone wanted to do it on Anambra but Senator Ngige who was the governor then resisted it. Today, the entire Lagos state is being controlledled by th cert forger, Tinube. Some unbiased and competent lawyers have stated that the remaining Rivers State law makers do not need the pronouncement of any law court to declare the seats of the defected law makers vacant. The pro Fubara law makers made a mistake by initially going to court (State High Court). Their seats automatically became vacant the moment they defected. The vacation of the order by the appeal court does not change anything. The pro Wike law makers will have to fight for a long time because what they are dealing with now is the issue of jurisdiction, the main matter is yet to be dealt with.

It’s arrant nonsense to suggest that the declaration of a defection by the speaker does not meet the requirement of their seats being vacant. In the first place, why was the defection declared openly and in an affidavit? When power is used to serve narrow interests than that of all Rivers State citizens these defects are bound to happen in the polity. Abuse of power is a defect of not living up to the standards of the law of constitution. Matters are made worse where judicial legislative activism fails to serve with clarity to the issues before the Court. It is high time to consider AI to do a better job than corrupt judges and justices in Courts of the land.

@chidi-lm1tx justice Omotosho of the Federal High Court ruled in January that the lawmakers remain members of Rivers State House of Assembly and that Fubara should not do anything to disrupt their activities. That judgement was not appealed but they rather ran to the Rivers State High Court to shop for an interim order. This same order was set aside by the Appeal Court. It is a pity that the political solution proffered by the President was thrown off the table. Fubara has got himself in a precarious position. I feel for Rivers State.
