The other car had already been using the car as a weapon from the moment of the brake check. This is entirely on the black car and their ego.

A new incident was created when they decided to leave their vehicle in the middle of a busy roadway and announce they had a firearm while blocking the van from the front. Then entered the van with the intention of great bodily harm.

Gotta stay up to date for each state if u carry.

@@immachine1565 yeah I’d say in this case self defense is thrown out of the window because they provoked each other, but under the castle doctrine/ stand your ground in Texas and Pennsylvania you don’t have to retreat in your vehicle. Even if you have an escape, but the cops/court will question it. As the first guy said though the shooter was only arrested for the innocent third person. Law is tricky because everything is about how it’s interpreted instead of right vs wrong. Plus you have to include case specific variables. A good defense would probably have a field day beating this case.

This was in Ft. Wayne, Indiana on 11-19-23 at the intersection of Lake Avenue and Maplecrest Road. The assailant was shot twice (arm and shoulder) while the driver of the uninvolved white vehicle that was used as a backstop was also wounded. Everybody survived with non-lifethreatening injuries. The driver of the red van, 42-year-old Jason Henkle, was charged with criminal recklessness with a deadly weapon while the assailant currently has pending battery charges. UPDATE: 12-20-23: 42-year-old Jason Henkle has been cleared of criminal recklessness with a deadly weapon after shooting 19-year-old Alexander Mozee in a road rage confrontation. Henkle’s charges were dropped following the emergence of video evidence confirming his claim of self-defense. Mozee is still waiting for his court date for charges related to the incident.

Many years ago I worked in a warehouse in Nevada with an Italian guy from New York. He was one crazy dude. He was 6', 4", 300+ pounds and a Vietnam Vet. He came into work one day and shared a story of a road rage incident that happened to him. He was driving on the freeway, and this dude cut him off, so he pulled up along side him and gave him a dose of New York hospitality, complete with swearing and middle finger pointing. He said they both engaged in this behavior for a minute until the other guy faked/feigned swerving into him. This really pissed off my coworker, so he grabbed a bottle of aspirin lying on the front seat, opened his side window (drivers) and hucked the bottle up over his car at the other car. It struck the other guy's windshield and shattered the windshield. The other guy pulled out a 45 and emptied it into his car. He wasn't struck, but he said he was a changed man. He said he would never, ever, ever pick a fight with another driver again. That was 1980.

There is so much truth to this. I watched something similar happen a few years ago on the way to work but no shots were fired. Some kid in a mustang was driving like a psychopath on the highway passing people going at least 110 because I was going 80 and he passed me like I was holding still. He passed me and about a quarter mile in front of me a guy was simply changing lanes to pass the cars in front of him, signaled just fine, waited for a second and merged and the kid almost plowed into the back of him. Kid passes this dude on the shoulder then slows down to a normal speed. So I'm thinking I know exactly what he's gonna do. He's gonna be a dick to this guy. So the mustang kid commences to brake check this dude about 5 times and then the kid stops his car across both lanes and gets out starts coming at the dude gesturing for him to get out and do something I guess. So I pull up behind and wait because I can't get around them. Dude gets out the car and pulls out a whole ass 6 inch magnum and that kid looked like he dropped a load in his pants. Got back in his car still talking shit and drove off. I gave the dude a thumbs up and we went about our day.

1:12 What the van does as a result of being 'brake check' is called Vehicular Assault. Now I would've backed away from this van and called the police. What the car did is not what the van did in retaliation. What that car did is normal in the city, and all over the place. The van didn't need to brake but simply let off the gas cause it was clear they were going to merge regardless. They also put everyone else's life in danger when they opened fire. This van is completely over the line in EVER REGARD. The car should have not pursued the matter once that happened, and involved the police. Leave that van alone. Take the wrong turn, exit and take a minute to regroup into a new group of cars. Don't do what they did.

Scenarios like this are why I stopped reacting to road rage myself. Part of growing up is realizing that just because someone is having a bad day and decides to take it out on you with their driving, isn’t worth your life. Believe me, I still get very upset at times but keeping scenarios like this in the back of my head are a great reminder of why it’s not worth it.

I flipped off a guy for tailgating me once and he and his passenger followed me for 10 minutes. They cut me off forcing me to stop and tried to approach my car three times. I finally found a well lit parking lot (This happened at around 2am) and just drove around in circles until they gave up and left. I don't react to road ragers anymore. You never know how far a random asshole might be willing to escalate something.

Literally part of the ccw course training. You gotta be a verbal punching bag and be absolutely in control of everything you do or it becomes your fault. If he had let it go and dude kept brake checking him or blocking him, and then punched the window it would be different. His little "revenge" move could and more than likely would be considered creating a problem in which deadly force was then used to get him out of. Edit: watched it a few more times and it's hard to tell how, but the passenger window of the white suv shattered...either a shot went in or the dudes elbow broke it or maybe both. Gotta know the backdrop cause he coulda just smoked the innocent guy next to him just because he wanted to shoot the guy 2nd edit: found the story (google: red van road rage shooting) and he did infact hit the white suv with one of the shots. Shooter held on allegations of criminal wrecklessness with a deadly weapon and the car driver could be charged with battery.

I couldn't agree more. You're just asking to get arrested, by cutting the other driver off. If he started attacking you, the first time he cut you off, then you would be justified. Yeah, my favorite story of that was my friend who lived in AZ but worked in Las Vegas and drove home only on weekends. On his way home a guy was harassing him and telling him to pull over. He did and the guy got out with a metal pipe and walked toward his truck at night with no one around. My friend opened his door and stood sideways, and the guy with the pipe laughed at how small he was, about 140 lbs. My friend slowly turned and put his hand on his pistol at his waist and stood his ground. The guy turned around fast without a word and went back to his car, probably realizing he came one step away from death and didn't know it.

Sad story: A few years ago, some guy my boss knew got involved in road rage on the way back from vacation. The other guy shot at his car, the wife died, and they never found the suspect. So guys, keep your cool it's not worth it. I remember a handful of times where my own dad would drive like an assh0Ie while my mom was begging him to stop, so with that perspective, it's definitely a grim thing to think about.

Exactly why you should just let things go. In my city some guy and his girl cut off this lady with her baby in the back seat on the freeway. She pulled up beside them and flipped them off. The guy proceeded to shoot at her but ended up hitting her baby in the back seat killing him. They eventually did catch the shooter but imagine how the mother feels? She will forever remember that her baby was shot and killed because she couldn’t just let it go and got her baby killed because she flipped off the wrong crazy guy. It’s never worth it.

I have a good friend that something similar happened to. As long as I knew her would talk how her husband was always a very aggressive driver. Never would let anyone cut in front of him. Always had to be ahead of others. She said she just wanted to hide her face the whole time he was driving. One night someone tried to merge in ahead of them and her husband would not let them. The other drive had the same temper and tried to cut them off in the next block. They when back and forth like this about three times. Then as her husband floored his Porsche to zoom around that guy again. Suddenly the rear window and her side window exploded. The other driver was unloading his pistol on them. She was hit in side of her abdomen. But the door had slowed the bullet down enough that it did not go in her far and noting vital was hit. She also got glass imbedded in her shoulder and neck. That would still occasionally poke through her skin 3 years later. She said her husband since that night has been a much calmer driver.

Notice how each of them took the opportunity to escalate the situation rather than the opposite. 1) Dark car cuts off the red car. 2) Red car cuts off and bumps into the dark car. 3) People from the dark car decide to exit the car and attack. 4) Driver of the red car decides to use lethal force (with innocents in the line of fire - white car). What a sick encounter.

The fact that the darker vehicle cut off the red vehicle, the driver of the red vehicle should have let the driver of the darker vehicle go to prevent from this scenario to happen. But because of egos and arrogance which got the best of both parties to act foolishly led the driver or passenger to get shot with no warning, and yes the driver of the red vehicle wouldn't have traded paint with the darker vehicle hadn't he had the gun in his or hers possession hadn't he or she used it, therefore the person knew what he or she was doing. No excuses. all of that mess could have prevented. It's a dangerous world out there and never know what the other person or persons thoughts are when evil intents and agendas lurk in their hearts and minds to commit such acts as this. Life is too short for life to be taken so lightly. God bless you all in Jesus Christ name. Amen and amen.

Fun fact, you can de-escalate road rage by frantically pointing towards the back of the aggressors car as if something is wrong. They might stop over to the side of the road, and find out that there’s nothing wrong. Meanwhile, you’re long gone and they just wasted time checking their vehicle 😂

I was a victim of road rage about 6 years ago. It was raining pretty bad, was giving plenty of room between me and cars in front. Traffic was congested, as it was time for everyone to get off work. I slowed to let someone over into my lane and a car full of teenage girls behind me, were apparently not paying attention and got angry because they had to break hard. After that, they proceeded to pull up beside me and throw their Starbucks coffee at my windshield, called me every name in the book. I'm not sure how any of that was my fault but they sure thought it was. I bet their friends were really impressed with the story they told them. 😏

Sad part is eventually that attitude will catch up with them and can be deadly. Here in Az a woman shot another woman to death for spitting on her hood during a road rage incident. People are being more brazen in their driving, but it’s not worth you forever changing your life by ending in prison, disabled, a vegetable or dead. Even if you live, more than likely the other person’s family and friends will seek revenge on you. It’s just not worth it. ✌️
