Presidents are above federal law and (most) state governors are above their state laws. They can pardon, grant clemency and commute. They can overrule any court at a whim (within their purview). The real issue is that Hur is not a psychologist to make assessment about the cognitive capacity of people he is investigating. The task for Robert Hur was to determine if any conduct raises to the level of bringing charges, which his report says it did not.

The problem isn't that shady things exist. The problem is what the hell are you going to do about it going forward. Because to me all the is a show. There is never any solutions that come from having these hearings. Hur keeps saying a jury would likely go soft in one sentence, then he will say a jury could have found him guilty. Why didn't Hur just charge him and let the jury decide?
