Mam if a judge gives more jail terms than what was mentioned in law at force (for ex: for an offence having a maximum jail term of 3yrs, the judge gives 4yrs) then can the judge be punished for giving excess punishment? Latter part of Art 20(1) cleary says 'no greater penalty'. 20. Protection in respect of conviction for offences: (1) No person shall be convicted of any offence except for violation of the law in force at the time of the commission of the act charged as an offence, nor be subjected to a penalty greater than that which might have been inflicted under the law in force at the time of the commission of the offence. (2) No person shall be prosecuted and punished for the same offence more than once. (3) No person accused of any offence shall be compelled to be a witness against himself.

just sharing my thought... abortion is illegal, but lets make it legal so practitionersthe operation and put their own lives at risk. its like saying lets make robbery legal since robbers take lot of risk and can get killed while robbing the bank. we have already de-humanised unborn human being by calling them by a latin word ,fetus(not a baby?) and have de-sensitised the act of killing a human. thats a classic ploy of killers - dehumanise their victims before killing them. would we be ok to kill infants/kids who develop abnormalities after birth,,how is it right then to kill unborn human beings with abnormalities while in the womb? if thats one of the argument. Another argument:Woman should have control over their body. When it comes to the right to control one’s body, I agree. No one can mandate that we donate our organs to other people, but abortion is not forcing someone to give another person their kidney. It’s more like giving somebody a kidney and then using violence to take it back. Also, if people need my kidneys, usually I’m not responsible for that. But 99% of the time people engage in an activity known for creating helpless beings. Also, if I don’t donate an organ, that’s letting somebody die of a pre-existing illness., whereas abortion is killing a healthy individual. An individual, I would say, does have a right to a person’s body in the same way that a newborn has a right to his mother’s breast milk if that is the only thing that can sustain him. While her kidneys may not have been made for his body, her nourishment through mammary glands have been. I would say the same applies to the uterus for the unborn. They do have that natural right. we can continue to argue about the timeline so to when can the unborn survive outside the mothers womb and draw corresponding legal framework supporting the mothers and babies'cause? its just amazing how someone can morally justify killing a human being based on their developmental stage of life, because deep down morals are same irrespective or race,status,place,religion etc.

I appreciate that u took time to explain ur side. But my concern is, if women r forced to have babies without their interest (sometimes that happens even after pregnancy) imagine how would they bring up the new borns. They end up in garbage or orphanage. Some r even killed. Think about, the struggles of the baby as he/she grows up. I don't want children suffering. Instead i would say the fetus be killed without having to see the world.

@@preethilaw Everybody should be aware of the fact that unprotected intercourse might lead to pregnancy. If they had taken necessary precautions beforehand, pregnancy might've prevented. There are still chances to get pregnant even after all the precautions but only in rare cases and birth control works successfully most of the times. Nobody forced them to get pregnant in the first place. And around 98 percent of abortions are due to lifestyle choices. They voluntarily had intercourse which is the mean to create a new human being (not talking about r*** situation here). Abortion should be available in cases where the woman's health is at stake. Reproductive organs are evolved for carrying offspring. And I hope that you're aware of the scientific fact that life forms at conception. ZYGOTE ,EMBRYO, FETUS are just stages in human life just how there are stages like NEW BORN, PRE TEEN, TEEN, MIDLE AGED and so on. But at the end of the day, it's a human no matter how small. Nobody has the right to decide for others. We don't know whether the baby will have a good life growing up or not. What if it had a good life even if the mom didn't want it at first? What if it grew up to be a successful rich person even if it grew in an orphanage or under foster care? What if it got adopted by loving adopters? Also, not all kids who came as a result of a planned pregnancy is living a good life under loving parents. I know the problem around adoption, foster care etc. Maybe we should work for the betterment of adoption and the foster care system. Maybe we should make this world a better place to live in. Instead of killing babies maybe we should work towards that. Instead of living with the problem and using violence we can make a problemless world. It's possible if we work towards it. In a world where killing babies is seen a right, I think it is still possible. Abortion is an extreme act which involves killing. Government should make better plans for these cases. We should work towards making a world where there'll be no chance that a baby would end up getting killed or left uncared for even if it's an orphan. Everybody would be okay saying I DON'T WANT THE CHILDREN SUFFERING INSTEAD I WOULD WANT THE FETUS KILLED unless they are the fetus. I hope that you would not be okay killing a new born if it's in a poor condition. Same goes for all the stages whether it is a fetus or a toddler. As someone who grew up in an extremely abusive, poor and violent household I'm glad that I'm alive to make my own choices and make my standard of living better. It sounded like I or kids having a childhood like mine would've been better off killed as a fetus never given a chance to experience life and decide for ourselves. I didn't ever wish that it would've been better if my mom had killed me. As an ex fetus and a current teenager who is also a female I do not consider abortion as my right. I do stand for my and my fellow women's rights to choose everything as they wish starting from dressing to carrier to choosing the partner of their wish which doesn't involve killing of another human being. Also I think that we need some positivity now a days instead of people saying that kids born in poor condition don't deserve to live.
