I think they take into account whether the artist had access to the copywrited material when the song was written, and there would be obvious proof the song wasn't heard prior? But I'm not a lawyer, so I don't know!

The "official" grounds for infringement are that 1) the derivative work must be "substantially similar" to the original, and 2) the alleged infringer must have had access to the original work. I put "official" in quotes because, as seen in the first case against Thicke, et. al., a jury or judge may decide, subjectively, what is "close enough". I am of the opinion that a jury selected to hear/ decide cases of copyright infringement should be made up of professional or trained musicians only. Any lay person may THINK something sounds the same although they could be different enough to not cross the threshold of infringement.

Let me share a short story here... 2 years ago, I was picked for a dance at my studio, and they didn't tell us the song until they taught us the choreo. (dance) I hadn't heard the song before, but I had heard Ice Ice Baby. So, I was listening to that beginning part, and right before it said "Under Pressure!" I said "Ice Ice Baby...." (lol)

This video seems like something you could help me out with. 6 years ago (January 2015) my friend released a track called "Dreams" , in 2017 Ed Sheeran brought out a track called "Castle on the Hill", In many people's opinions it's pretty obvious that it''s just a better produced acoustic version of the track, many lawyers take eye to the case but said it would cost too much to take him to court, even though it was a good case. They have sued multiple people for copying his songs even though the thing they "copied" are really just standard blues progressions. To the people who don't know who Marvin Gaye is and that he's dead, they will think "oh that Marvin Gaye guy is suing another artist I like, fuck him." because they don't know it's not him and its his estate. Before I knew who Marvin Gaye was I was upset that he was suing people for no reason, but then later on when I became a fan of him I learned that he died a long time ago, and obviously wasn't suing anyone and it was just his lawyers trying to get an easy buck. Most young people don't know this and all they know him for are the headlines "Marvin Gaye lawyers sue yet another famous artist." That's why his estate is ruining his name because his name is attached to something that people hate.

I think the sneaky thing about the second Ed Sheeran lawsuit is that they are trying to sue him for something that, at the time he released Thinking Out Loud, was not protected by the Copyright. If the court accepts that lawsuit, that would open a precedent that could be easily exploited. I think that the second Copyright should only be valid for songs released AFTER it was filled, and not Thinking Out Loud.

With the Ice Ice Baby and Under Pressure thong once I heard my mom playing Ice Ice Baby on her phone and I thought it sounded familiar. I had never heard the song in my life at least to my knowledge. She kept saying that she thought she saw something where the minions were singing it. I asked her if she was thinking of when the penguins and elephant seals sang Under Pressure in Happy Feet 2. I think what vanilla ice was trying to say is that his bass lines second phrase was started on a pickup note. And ended on the up beat. Unlike queens "under pressure" which started on a down beat and ended on a down beat. Plus "Ice ice baby" has one extra note due to the pickup note. But it does sound really similar even.
