I'm glad someone in the chat mentioned to him that the game was a criticism of Japan's law. Japan has an extremely high conviction rate and not all the people who are convicted were guilty of the crime they were accused for. Phoenix does these odd ways of getting evidence, cause the system is very rigged against the accused.
@luke.mp43 жыл бұрын
Interestingly, jury trials fell out of fashion in Japan because they produced an unusually-high acquittal rate: up to 15% nationwide, compared to the modern US acquittal rate of .25%. The inquisitorial system this created has led to the opposite problem in Japan, which is now thankfully the subject of legal reform in the country.

@@Artsias It's not a mix between anything. It's based on court dramas. There is no basis in actual court law other than the setting and the tone of a court. I think this was in a game theory at some point, but its worth pointing out, in the context of Japanese Law, that Phoenix Wright is an _outstanding_ lawyer. Because of Japan's incredibly high conviction rate, the most successful defence attorneys of all time often have single-digit case wins, so Phoenix winning four _in a row_ over the span of a few months is equivalent to how many cases a brilliant lawyer may win in their entire career in Japan.

There's a lot on the surface pointing toward Powers, not just Oldbag's words. Indeed the game does have an annoying tendency of switching from having to prove your client innocent (or that there is credible doubt as to their guilt) to proving absolutely that they are innocent AND find the actual guilty party at the same time at the cost of potentially having the client indicted immediately but that can be justified by this being a game and so needing to have a climax to the cases. @@tinywitchfrogs_ yep, it's a dystopic AU that brought the situation of 2001 Japan's justice to its extreme but also somewhat logical conclusion: a system where you are de facto guilty until proven innocent (reasoning being that if you are arrested there is pretty solid evidence to justify the arrest), the prosecution and the police pretty much rule the courthouse, and yet is extremely slow with a backlog lasting decades. The dystopic yet logical result would be a system where the conviction rate is pretty much total and unscrupulous prosecutors dictate the law through fear, corruption and exploitation of every blind point of the law. The worst thing is, by the time 2016 arrived and Spirit of Justice was published, if you exclude the three-day trial system, *the actual situation in Japan was even worse that predicted*. There had been major scandals during the last few years that showed rampant corruption on every level, police, prosecution, judges, with rich people pretty much paying to never being arrested for horrible crimes and the defence, while itself being corrupted, also having pretty much no power and suffering undeserved social punishment... it was so bad that it actually needed reforming everywhere. And that's just the law and order.

Interesting to Note: The game is probably so heavy on cross-examination of witness testimony because, according to Article 38 of the Japanese Constitution, "no person shall be convicted or punished in cases where the only proof against a suspect is his/her own confession". Rather, confessions must be substantiated with evidence to prove that the confession by the witness is the only possibility in the case. This is done to safeguard witnesses from bullshit confessions to get themselves out of the trial, as Japanese trials are notorious for vigorous questioning of witnesses, with detention periods lasting up to 23 days. This provision is also probably why it took a lot more examination, including a motive, to definitively pin Vasquez for the death of Hammer, because all the evidence up until that point had been contextual for Power’s case, and had insofar been insufficient in proving that Vasquez could be the only suspect. Additionally, although the Japanese Judicial System at once had a jury, established in 1923 by Tamasaburo Katō, the jury system was suspended in 1943 by Obuchi Keizo. Today, Japanese Courts run under an inquisitorial system, where judges actively participate in the trial. Japanese law also has a jury-like system, introduced in 2009, where citizens- selected as “lay judges”- help preside over the case. They, along with the judge, decide the outcome of the case. However, at the time of this game’s release, the judge was the final authority on a case’s outcome, as far as I can tell.
@paradoxxis86123 жыл бұрын
This is irrelevant, as the game isnt based on Japanese law at all. Takumi didnt know anything about it, and was basing it on TV court dramas. The similarities come from the fact that everyone has at least a foggy understanding of how court works in their country.

@@HekateAredhel idk if it was really explained in the stream, maybe it was mentioned. One thimg Dam noticide its tge lack of a jury, which (if im not mistaken) is something japanese trials don't have to this day. In Japan you're also guilty until proven otherwise.

I like to imagine the reason Edgeworth ends up working with Phoenix is because he's so fed up with Vasquez.

Daniel there are earthquakes in America too. generally people who grow up in areas that experience earthquakes don't worry about them unless they are very intense. since edgeworth was the only person who did anything about the earthquake, it's reasonable to assume that the earthquake was mild. Therefore Edgeworth's reaction showed unusual fear

2:53:53 um, no Dan I don’t think you can be both at the same time 😭 you can switch careers but I’m pretty sure it’s a conflict of interest if you’re both a state prosecutor and a criminal defense lawyer at the exact same time
@TheBasedTyrant3 жыл бұрын
It's true, Japan has no concept of a right to self defense, most places in the world don't in fact, including ridiculously some states of America where you have a "duty to retreat" in places like this you would be forced to hide the truth in order to defend yourself from the unjust prosecution that would be put upon you. I could never live in a place like that, where self defense could see you tried as a murderer.

I'm very impressed that RT used Edgeworth's animations to figure out the whole left hand/right hand situation but technically, everybody in AA is ambidextrous since they flip the sprites according to which side of the screen the character is on so that they always use the hand that's furthest away from the camera in order to not obscure their face. If Edgeworth was defending and when he is the main character in AAI, he would be on the left side of the screen and then it would seem like he is left-handed. Either way, though, even if he is canonically right-handed (since that's the hand he used to pick up the gun up, after all, so it's at least the one he favours if not his dominant hand), the player would still need to present evidence that contradicts the photo hencewhy the court record had to contain the gun and specifically the note that stated fingerprints from his right hand were found on it. Edit: I forgot to mention the von Karmas are the exception. Franny because she uses whatever side makes her gesture more dramatic and Manfred because of plot reasons
