CASE TITILE - Govt. Of Kerala vs Joseph on 9 August 2023, CIVIL APPEAL 3142 OF 2010
The Supreme Court in a case relating to the land dispute has observed merely a long period of possession, does not translate into the right of adverse possession The Court was dealing with an appeal against the judgment passed by the Kerala High Court by which the findings returned in the First Appeal by the District Judge were overturned and the land, the subject matter of dispute, was stated to be rightfully belonging to the respondents by virtue of the principle of adverse possession.
In Govt. of Kerala v. Joseph, 2023, the Supreme Court has emphasized that the Courts have to consider the question of adverse possession “more seriously” when claimed on land that belongs to the Government.
In this case, the judgment of the first appellate court which observed that ‘the title of the Government on land cannot be lost by placing reliance on “casual advertence” or on the basis of “scanty material” ’ was restored by the Apex Court. The Apex Court held -
“When the land subject of proceedings wherein adverse possession has been claimed, belongs to the Government, the Court is duty-bound to act with greater seriousness, effectiveness, care, and circumspection as it may lead to the destruction of a right/title of the State to immovable property.”

Hello Sir, I hope you are well. I have watched the LLA EMPLOYEE RIGHTS master class and I really liked it. I'm currently unemployed but I believe all the knowledge shared in the Master Class will help me to ask the right questions. If you don't mind, I had a favour to ask. I stay in Guwahati and the Durga Puja celebrations are at the doorstep. I worry about reckless use of loud speakers in my society. Last year due to the excessive noise of loudspeakers my mother had to suffer a lot because she has migraine and she cannot withstand loud noise as well as bright light. As per the noise pollution act 2000 , noise level in the residential area cannot be more than 55 DB. Is there any way by which this loud speaker problem can be mitigated legally without going to court. Any small tip would be useful for me.I just don't want loud speakers outside my home even if it's for occasional purposes. Thank you

Sir,We have in possession of a Land which was given up via settlement deed at the year of 1965 by someone who was owner of that land but at the year 1971 a vesting Proceeding was happened against that person and land had become vest to the Government. Sir,since 1965 we have in possession of that land and now want to become legal owner via Adverse Possession. How is it possible sir?plz tell me to know.

सर मेरे मामा ने मेरी जमीन और घर में जबरदस्ती कब्ज़ा किया है। मेरे पिता ने उसे हमारी ज़मीन की देखभाल करने के लिए दिया था, लेकिन अब उसने चोरी करना शुरू कर दिया है और हाल ही में अजीब व्यवहार करना शुरू कर दिया है, इसलिए हम उसे बेदखल करना चाहते हैं। ज़मीन और घर मेरे नाम पर है लेकिन वो कब्ज़ा नहीं छोड़ रहे हैं। क्या करना चाहिए
