Hi Simon, can a deed of trust be used when one spouse owns shares (or a unit trust) and has made a taxable gain over the annual allowance?

A deed of trust may be used on any type of assets. Please note that a deed of trust needs to have tea been done before any disposals are complete

If the property was owned 50%/50% then you will also need to complete a form 17: www.gov.uk/government/publications/income-tax-declaration-of-beneficial-interests-in-joint-property-and-income-17

Yes you can. You will need to do a form 17 if the property is currently 50-50 owned
