Sorry that happened guys clearly there is a game warden here he was trying to solicit a trespass or just find a reason to write a ticket the game ward did not do a proper investigation to talk to the person who called and made the complaint Unfortunately they were not informed that the lady living at the residence was giving permission to her nephew and nephew's party to hunt within 300 yards of her home or less as a matter of fact the South Carolina State game law states that you can hunt within 300 yards of a resident as long as you have permission from the owner of the resident. Please make sure you give us a follow-up on this situation and don't give in contest your part of this investigation in the court of law the game awards were definitely out of context on the law that they were trying to enforce. The investigation was poorly dealt with and that's for sure you had some good evidence so make sure you continue to let that video roll and also submit it to the courts as evidence because those guys weren't wearing body cams for future reference make sure you get employee name or Warden names and badge ID numbers I know it would be on the paperwork but sometimes it's hard to read their sketchy handwriting good luck guys

Fight the ticket! Gather your evidence and fight the ticket. This is why law enforcement get such a bad rap because they don't have the ability to understand reason. Once he found out yall had permission and it was a misunderstanding he should have torn the tickets up.

Seems legit on the Warden’s side. The second officer shows them the property lines of the place they had permission to hunt and surrounding parcels where the shooters were standing. (There are phone apps for this now.). As he said, the men and dogs would have to be contained on and limited to the specific property they had permission to hunt and not running the dogs through that parcel while trespassing on other landowners at the shooting positions. Also, it sounds like there’s a law regarding minimum safe distance from a residence which would supersede permission. Lastly, unless the lady owns the field across the road, anything they shoot crossing that ends up there would require permission to retrieve.

If the law supercedes the landowner that also means the landowner cant hunt on his or her own ptoperty within 300 yards from said dwelling. Now the picture should be a bit clearer. The law only applies to other hunters without permission. The issue here is that the lady that owns the house called the warden because she thought people were hunting her property or was too close that she didn't give permission. Once that was cleared up the warden should have left. As for the open field you are correct and that's not a position I would want to be in.

Pretty much every city bans the discharge of firearms within city limits except in limited cases like self defense meaning you can’t do target practice in your backyard. In the counties there are laws which could affect a property owner provided there was a credible witness, most likely a law officer. Many states prohibit hunting within a certain range of maintained roads and prohibit firing across them. Typically you can get away with this as county officers are few in number and have a large jurisdiction. Clarification of permission only gets them off of trespassing and poaching on aunties’ parcel but one has to wonder why no one called auntie first thus preventing her call to the game officer. It doesn’t excuse them from being caught within range of a dwelling. Also, several were along a public road marking the property line boundary to a parcel they could not hunt increasing the likelihood of another deer being killed off property like their previous citation which they could have avoided by moving into the property a dozen or so yards which may have negatively affected their ability to see and get clear shots. If their 2 parcels are adjoining, the man that said he was owner of the one could clear a shooting lane down the boundary and push off auntie onto his. 45 acres is a pretty small piece to be running multiple guns and dogs on though.

I would also add the other landowners most likely complained and that’s why they were there. I believe they would have to get permission to retrieve game from the property they don’t have permission to hunt.

I saw other citations they would have gotten in my state but in this video it wasn't a concern in SC. Everything else you stated were hypotheticals and didn't take place. We don't know if they would have shot a deer in that field or just caught the dogs. Warden was out of linesfter learning the facts...assuming they were factual statements from nephew. All warden had to was back up the street and speak with auntie. I'm a still hunter myself. I ran dogs in my younger years with my grandfather before this form of hunting died out with the older generation. There is one group of guys that have starting running dogs in my area after all these years of no dogs.. I cant get mad because i understand their plight and i had a lot of fun doing it myself. It brought a sense of community before everyone starting naming deer and counting inches.. I assume they are back because utube has made it popular again.

I lived in SC when the laws using dogs was changed. 1/25/2018 Bill #3272 Hunters now must have written permission from land owners for the dogs and the land has to be not less than a thousand acres unless the property is completely enclosed with fence capable of holding the dogs from crossing onto another private property. The reason for the change was hunters were running their dogs across private property without permission causing angry land owners to petition the state for law changes. Just saying. I have seen hunters standing on roads shooting double-Alt buckshot at deer crossing in front of vehicles passing by.

If the law states no shooting within 300 yards of a residence, then that supersedes “permission”. He also used a phone app to show property lines and noted they would only be legal if all the humans and dogs stayed on the property they had permission to hunt, but that would have put them all within 300 yards of homes. He then mentioned that the last call they responded to was after an off duty warden in a tree stand across the field saw them kill a doe in the field, which was a different property they did not have permission to be on.

Those tickets should have been voided. It easy to do. Nolle Prose is easy and stops any further problems. When you know someone did not break the law and you still seize them under the 4th amendment. It is a clear case of civil rights violation in the federal 1983 statute. This is a slam dunk case for an attorney to sue. You should contact a civil rights attorney now. This is pure laziness on the officers part. Or they just wanted to show activity on their monthly activities logs. The cases made were illegal, since the officers knew that no laws had been broken and still cited the hunters.

I’m from Minnesota and the same laws apply to us about shooting to close to buildings. How would you like to have buckshot on your house. We are not allowed to use buckshot or dogs to hunt deer but our average whitetail weighs 150 to 300 lbs

I hunt my own property as well. I enjoy still hunting and dog hunting. When dog hunting is faded out like you would like. Then they will work on fading out still hunting. It's already happening in some areas. And then you don't have to worry about getting all of "your " deer ran off. Maybe you should buy more land. My property is big enough that when the hounds are on my property, they do not run off all of the deer.

With a little common sense and actually talking to the person that called and getting the issue taking care of there, he chose to push it through the court system and costing the tax payers money. I respect they have a job to do but common sense but use common sense. Instead of going and getting the situation taken care of by talking to the person he wanted to write tickets instead. That's how they get to pay raises and bonuses, and advancements in their career. This is part of why people dislike law enforcement of any branch that don't use. They put on a badge and think they're better than everybody and are never wrong. We had a game warden here in Alabama that was a gung-ho ticket writer. He wrote 27 tickets at are hunting club at the clubhouse for bs reasons. After the judge had listened to about 5 people in court that morning, he asked how many more was there for the same tickets. The judge dismissed all tickets and had a very Stern conversation with the game Warden for tying up the court system for writing tickets it should have never been written.

Sorry folks, been hunting white tails for over 50 years. I will always support hunters. Really can’t see fair chase while hunting deer with dogs. Get rid of the dogs and deer drives. It’s safer and you will have more enjoyment while hunting. Hunt back off from the road where you aren’t seen by the public. Much more rewarding hunting deer one on one in the woods. Typically, there is not enough big tracts of land, left to hunt with dogs these days, there are a few left, but not many, I hunt myself in SC, but not with dogs, it's very aggravating to have dogs and people on your private property.

Buddy of mine who just recently passed away from cancer, had a nice place only about 1.5 miles from me, 155 acres, plus frontage on a 75 acre pond. When he first bought the place, had trouble with coon hunters, who acted like they owned the place, we have always hunted here, almost came to blows, after a few missing, coon hounds, they got the message.
