Referenda are not legally binding, no more than an opinion poll and we’re governed by Acts of Parliament, not by opinion polls. 52% : 48% does not constitute a democratic mandate, it should be at least 2/3 for such a seismic change and it was ludicrous to reduce such a complex issue to a crude binary Yes /No decision. Brexit is undeliverable, it is wasting time and energy and compromising the dignity and credibility of Parliament. Revoke Article 50. Back to the drawing board.

Scots law and English law are very different. Law in Ireland and Northern Ireland is closer to English law than either of them is to Scots law, which is mixed system, rooted in Roman law. Therefore it is possible for the courts in different jurisdictions to come to different conclusions.

Although this is within a scottish court, the law applicable here is UK constitutional law, not traditional civil law within scotland that may differ from UK law (in most case it doesn't because the judiciary are lazy and just take English authority as Scottish authority (to which there are many complaints about this)). The reason why the decisions are so different, is because the Court of Session here is making leaps of faith into politics through their legal window. This judgement is not legally minded, nor does it logically follow and they can quote no authority to support their conclusion. Just wait for the full judgement and you can read how many acrobatic tricks they wil have to try and pull of for this one. I can accept a decision that BoJo gave advise ultra vires/unreasonably/unlawfully etc. However, I cannot accept that this therefore makes the prorogation unlawful as this prorogation is an absolute power of the crown with no act of parliament involved or raised as as authority that can proffer any restriction to that power in this usage. So the reasoning behind the prorogation is irrelevant.

Even if we concede he acted unlawful, lets go as far as to say that he willfully deceived the Queen with his advise. Even then, the prorogation is not unlawful, only the advise is unlawful. It may seem pendatic, but this distinction is important as UK law suprecedes Scottish authority. Although Scotland operates half house between a civil and a common law system. However, there are many occassions where judges have accidentally used English authority in Scottish cases when such authority is not valid. Moreover, constitutionally the law of the UK is that of the law of England in essence, because UK constitutional law derives from Parliament and the crown and this is the law no matter where you are in the UK. Parliament and the crown is derivative of English tradition prior to the union, and thus the law itself is mirrored. I've digressed substantially at this point. The fact of the matter is that in that the Crown has a number of powers under its prerogative one of which is prerogation. The Crown's powers can only be restricted by statute, and the actions of ministers are only able to be challenged under certain heads such as "ultra vires", "unreasonableness" etc. All of these are where the minister has acted outside of his station or wrongly within his station such that his decision was ultra vires. Because Prerogation requires Royal assent. It is not an act of the minister, but an act of the Queen. The Queen cannot be reviewed, which is why they are challenging the act of the minister. However, even if the minister were to act in wrongly in every way imagineable, the act of the Queen the source of authority of the prerogation will always prevail. The only thing that can directly challenge the Queen is legislation passed through parliament. No such legislation exists to limit prerogation in a way which would render the current circumstances as unlawful. Therefore, the prerogation is not justiceable. The Miller case was justiceable as the prerogative to make treaties, in revoking Article 50 would affect national law, and the crown does not have the power to unilaterally alter our law withotu permission of parliament. The previous decision was on a technical point that does not apply here.

How can anyone know for sure that all Leavers who voted were absolutely voting for a Brexit without a deal? The UK is being inflexible (ostensibily) about the backstop they initially proported for. The EU is inflexible in removing it due to supporting the GFA and Ireland as one if its members. They have, however, told the UK they are open to resolutions that the UK is able to come up with (since it would be the UK putting up a border in Ireland). I saw ostensibly becuase really its that the members of the ERG (who voted 3 times against the withdrawal agreement you're referring to) want out before the EU tax avoidance directorate gets implemented in January.

The backstop is to mask this, albeit at the cost of putting the GFA at risk. Agree though. May was not a member of the ERG but did try to keep her party together and keep everyone happy. Johnson repays this by removing the whip from 21 MPs from his party rather than attempt any kind of compromise and reconciliation.

But the MP's now have a fixed term of office and have refused snap elections. Thus the former justices views are outdated based on the prior act of parliament, of fixed terms. Before whenever a PM lost a key vote, there would be snap elections and a new majority PM chosen. Therefore the right to suspend parliament is now a right of the PM during his full term of office. Secondly, the results of the referendum must be preserved and not circumvented by the opposition MPs.

They say that becase the advise is unlawful therefore the prerogation is unlawful. They do not justify this at all, and make the assumption that the power of prerogation stems from lawful advise to prerogue. The power of prerogation is absolute, notwithstanding any acts of parliament to the contrary. The power of prerogation does not stem from the advise, and therefore even in the case of wilful deceit the prerogation must stand. The only thing that hinder this power is an act of parliament such as was the case in the Miller case when it came to treaty making privleges of the crown.

Whether it be English courts or Scottish courts, they are all saying that Boris Johnson is guilty. What the English courts are saying is although he is guilty, due to a case about 150 years ago, they should not interfere in Parliament. There is no such case law in Scotland and therefore unlike their English colleagues, who also agree he is guilty, the Scottish courts can say he is guilty.

Claudette Earle. I'm American and our system is very different from yours. I can't say I understand exactly how yours works but I have empathy for the chaos you are currently experiencing. We too are in uncharted territory with this ridiculous President we have currently. But I want to say that Trump's behavior is NOT going unchallenged here. Congress has subpoenaed multiple people in Trump's Admin. Several people have been tried and convicted and sent to prison. The closer they are to Trump though the more his admin is refusing to honor the subpoenas forcing the issue in court that Trump and his Republican Senate has packed with his own judges. They are also ignoring the court orders when a judge issues one. This is unprecedented and no one seems to know what to do about it. The House of Representatives, controlled by the Democratic Party, keeps investigating and holding more hearings. They are essentially doing impeachment investigations without filing the Articles of Impeachment Our Constitution has a process for removing a President and it's not easy. I wouldn't call us complacent at all---people are riled up and protesting but you might not get a good sense of that. We are a big country with 50 states, all of whom have states' rights that they like to invoke. Think of it like the EU, a collection of individual countries each with their own culture, laws, political structures, settlement history, ethnicity issues, etc. We aren't a united people. Trump won with only a little over 1/3 of the vote. Most of us can't tolerate him.

The Judges reckoned that there is malice of stifling the responsibility of the Parliamentarians to carry their jobs, but fail to consider that the current Parliament is stifling the will of the people by blocking the governments' task of delivering the mandate of the 2016 referendum for more than 3 years now. Yes, the prorogation has the essence of blocking the power of Parliament, but this is paramount to deliver the will of the people in the shortest possible time, and avoid the game of power grab by the parliament. Some of the ministers have the illusion that the executive power of the Prime Minister can be assumed by creating laws according to their wimp, hence diluting the system long held by the British people as their pride and as a model in the world. Now, the trending phrase that is going on in the media is “Parliament vs the People” - this battle-cry is ridiculous as it is a contradiction by itself, Parliament is the ‘People’, it is not a body separate from its source. Acknowledging this misnomer only tells the twisted form of the current British Parliament, because you cannot fault the people in this discourse. People are the sovereign, not the Parliament. During the general election, Parliament can be dissolved and regain its power after the exercise, simply, by people’s choice. The BLIND-SIDE OF EUROPEAN LEADERS The European side of Brexit is a subtle disintegration on the European project. By allowing to drag Brexit for more than 3 years, the European leaders unwittingly planted uncertainty in the European market that gradually eats their economy, and proof of this is the current German economy that is faltering. European leaders believe that they can thwart Brexit and instill discipline to maintain the status quo, hence avoiding disaster. But the reality is that Brexit will not go away any way you see it, and without its fulfillment, the more it will drag down Europe into the gutter. Were the SNP to kick off another referendum on Scottish independence it’ll boil down to a choice between the UK and the EU. With the crushing defeat in 2014, the voter turnout disparity and the ironic fact that the vote on independence would be between which union to stay in! Unlawful does not mean criminal. Ministers reguarly have been found to do things that are unlawful merely due to a misunderstanding of the application of certain legislative instruments. Besides, this judgement reaks of bias, as they are making huge politically enthused leaps in logic. If we accept that the advise was lawful, this does not then mean that the prerogation is unlawful, because the prerogation is an absolute right, with no acts restricting it as of current. Therefore it is not possible for prerogation to be unlawful no matter the motive. Only an act of parliament can say whether something is lawful or not, when it comes to limiting the powers of the crown.

Please, then tell me in detail all of those constitutional traditions. Please do not forget some, because then anybody will be able to claim whatever they want to be a constitutional tradition. There is a reason why the constitution is a written document in 99% of all countries in the world (except in the UK, Saudi Arabia, ...). By writing it down as 1 document, it could be read by anybody. Then, you could not easily lie to or trick people who know how to read a document with a clearly written procedures for the governments/parliament/head of state and citizens, procedures about referendums, successions, international treaties, environment, voting in parliament, voting and jobs of government, elections for the parliament or the head of state, ....

They have always said, Scottish courts are separate from English and Welsh. And we don't take any laws from Scotland, because they have all their own laws. All they have done is, they found a very sympathetic judge allegedly. Who has made an interpretation favouring the more remain stance allegedly, but the week before, we had a court case and the court said that the Parliament or prime minister had the right to do it, because they would have been off on 5 weeks with their conferences anyway. It's like this week the TUC conference and then next week is the greens or the Liberal Democrats and then Labour and then the Conservatives and whoever next between UKIP or brexit parties. So I don't take much stock from that Scottish court case, but just from the English and Welsh case as we should.

Secession is always illegal. Because it is a kind of secession, I'm sure that Brexit is also problematic legally to some extent. But legality takes a back seat to political and military considerations when fundamental questions of sovereignty and empire are involved, and of course everyone knows this. In fact, I'd say that the best reason not to enter in to relationships like the EU in the first place is because the only way to leave is being carried out in a pine box.

Its as compulsory as article 50, and the referendum result, and the 2017 election manifestos declaring all parties would honour the referendum. We can probably ignore the ruling for three years and then demand another go. The fundamental problem with Brexit is that it is not true as Matt says that "the will of the people was expressed in the referendum." The Tories completely botched the referendum by making the people chose in a binary vote when the people are actually divided four ways. (1) Leave no matter what. (2) Remain no matter what. (3) Leave with a deal that has the best protections but remain if no deal, and (4) don't care one way or the other. Because the referendum only gave a choice between Leave or Remain, the #3 category never was polled and allowed to express its will. Now we see the realignment because there just slim majority for leave when the choice was binary but now there is no majority to leave when the question of "no deal vs a deal" divides the Leave camp and many would vote remain if there is no deal.
