Sir, in Section 24, notice should be mandatorily given to the opposite when the application is filed by any of the parties but giving of notice is not mandatory if the court transfer the case on its own notice. Have I interpreted the section correctly? "Or of its own motion without such notice" , does it mean that giving of notice is not mandatory? Thank you sir.

If it is a murder My question is how can the party use the provisions of cpc while dealing with a criminal case? Also how can a civil court try a criminal case?

It can be at any stage, but it should be before the end of trial, usually judges may become bias at any stage, so to get justice u can move an application at any stage

At the end court always take into consideration all the facts, not only wife's convenience but others wittneses convienence is also considered, all though no hard and fast rule is there but for the end of justice court could take direction

sir, while transferring from one high court to another and flling application in section 25 of cpc, will supreme court look for jurisdiction, whether the other court has the jurisdiction or not ? will that be look into ? lets say transferring from UP high court to delhi high court, will SC look for jurisdiction in that case, competence to give order in that ? please reply , thanks
