Sir if the defendant never disclose that the same matter is already pending in another court and the second court passed the judgment in the favour of defending . First court passed the judgement in the favour of plaintiff. Then which court judgement is valid????

sir ek question hai, res judicata agar apply ho jata hai to fir kya log upper court mai fir se case nahi dal sakte? jaise agar district court kisi matter per fasla suna chuki hai to HC mai apply nahi kar sakte us judgement ko challange karne ke liye?

Same level ke court me nhi kar sakte lekin appealable hai to upar jasakte hai if we not satisfied.i think I'm right
