If the court is given power to raise presumption, then why the prosecutor need to prove the abetment by husband or relative. Once ,marriage , cruelty, suicide by women within 7 year is proved, the prosecutor is relieved from proving any thing. Now it's the court which will raise presumption as to whether there is abetment or not. In short the prosecutor need not to prove abetment but married women , cruelty,and suicide within 7 year.

5:24 you’re saying that for attracting sec 113A the suicide must have been abetted by husband or his relatives(2nd point) but sec 113A says *when the question* is whether the suicide by a woman is abetted by her husband or his relatives! That’s the question not an essential to attract sec 113A. So correct yourself

Ma'am make a correction if I m wrong that prosecution doesn't need to prove abetment to suicide because it is presumption being raised by court when suicide by a married woman within 7 yrs of marriage and cruelty is proved by prosecution. But you said that prosecution has to prove abetment also which I feel is wrong

No I think what ma'am tried to say is that the court will use its discretion to decide whether to make the presumption or not. The general rule is that it will make the presumption but if in some exceptional case it decides that the facts are such that presumption cannot be made, then the prosecution will need to prove.
