We have this exact problem here in TN. Landowners privatizing our public resources, blocking off areas. I’ve even been threatened to get shot. It helps if you carry around an extra bag for trash, pick up any you can carry. Also we can all help keep landowners happy by respecting the waterways and keeping them clean. A lot of these folks are just tired of all the trash on their banks

In NY there are some parts of the lake Erie tributaries that are private. But the land is private not the water, so you can be in a kayak or raft that is not touching the land and still be able to fish. As long as nothing is touching the land then you are legal

I know nucanoe sells lift kits for the seats. But there's a cheaper way, that will give you more room underneath for storage. Just get one inch pvc couplers and the three and half inch toilet bowl floor mounting bolts. I stacked washers above and below the coupler and the seat is raised three inches now. I keep a ton of tackle beneath the seat now. The best mod for it though, is to order 1 inch aluminum pipe and a T-connector with some bicycle handles. Just slide the pipe in through the hole in the back and you have a comfortable double handle. Makes the kayak feel half as light.

As a 32 year land surveyor, the guide is correct, non-navigable waters. They can block it off. Doesn't mean I agree with it. But, as far as changing the laws, lots of moving parts and considerations. One, lets say the river is 100' wide from top of bank to top of bank, so roughly 50' from top of bank to centerline of the river, which would represent the property line. For a tract that has 1 mile of frontage, that 50' strip would equate to 264,000 square feet, or 6 acres of area that was purchased when the land was bought. For the state to change the law, and open that up to public use, you can bet the land owners would be seeking indemnification for that area. Granted, the State could "take it" through the process of eminent domain, if they so desired, but the land owners would still be compensated. Just not at the dollar figure they paid for it, most likely. Again, I would be all for it, but I also respect people's property rights that they paid money for. And of course, opening it up would likely cause those property owners more harm than good, from litter, trespassing up outside the river corridor, etc. Not everyone is as good a people as you guys at SeekOne are, and they would abuse it. The perfect scenario would be to obviously compensate the land owners, give them tax breaks (beyond the fact they would be paying less taxes now that they have less acreage), set strict laws and ENFORCE them. Just to name a few ideas.

In sc, you own the land, but not the water or wildlife. If you can get through it without walking on the bottom, you can absolutely use it and fish and hunt it (ducks). You just can’t get out or touch the land under the water. Makes sense to me.

Sorry Lee bass fishing is bass fishing,but on similar note on the legalities on the water access.I moved to Nashville last year and there is a creek I found loaded with fat smallmouths.The water is so clean and cold and drinkable and somewhat private.Sad to say developers are trying to pump water from a treatment plant into it.

If the land owners and having problems with people leaving trash, I get that. Easy way to still allow people to fish it and keep river traffic down. Close those points on the river on the weekends. Allow fishing Monday through Thursday. People fishing during the week are likely to respect the environment. Weekend warriors are a big problem everywhere! But rivers should be open to the public.
