@@bradblackmore2627 Maneuvering in a firefight is not at all the same thing as fleeing. If he was fleeing, he would have fled... away... as in out of the store or away from the area of danger. This jackass was maneuvering to cover and looking for angles on the target, he didn't even attempt to leave the general vicinity. He chose to initiate a conflict AND chose to escalate the conflict to a gunfight.

This happened down the street from me...I remember how odd the story was at the time...Fighting over a spot in line and pepper spraying someone and following them and it turning into a gun fight...Guy in the black was 100 percent justified in his actions...If someone is willing to pepper spray you multiple times and then follow after you over something so little...you never know what they're capable of doing next

I saw the interview of the man in all black and it seriously brought me to tears. He was on the phone with his mother when this accident took place and you can tell from his tonenof voice and how he describes the incident in the interview that he did not want to shoot that man, that man 100 percent kept threating this man and verbally then physically instigating the man in black until he had no choice but to defend himself. This is an oldie but a goodie. The decedent (guy in shorts) was actually an ex-deputy sheriff who was kicked off the force for anger issues. The problem was there was no audio on the video and the defendant said the decedent kept chasing him and saying he was going to shoot him. Ultimately, the case produced 2 hung juries and the prosecution gave up.

Go watch the actual interview and I'm sure with how long ago this was there were witnesses that also help paint the picture of what exactly happened that day

Hot head couldn't wait to have his peescription filled for his soothing tranquilizers. Dude in black, seeing the urgency, filled his prescription with a more effective tranquilizer substitute. Hot lead!! Whatever went before, when shorts fuse started following him mist people would perceived a malevolent threat. When Shorty walked back to the line, it was because he no longer believes blown fuse would cease and desist. So he circled back and delivered Blown's prescriotiom, peace out. His second mistake was circling back and shooting Blown Fuse. He should have carefully backed off, call police and wait facing Shortie's direction. Then if Fused approached aggressively again, Blackie would be in a totally different legal situation. Jurors would have had a far easier time. I'm no genius, but I know neither man properly anticipated their outcomes for their words and actions. Beware. Take care. God bless.

This scares me a little. Several years ago I was forced to use a gun in self defense and the court system was a nightmare. I got cleared, but it took a lot of time and money. If I ever have to do it a second time I guarantee the legal system will use that against me somehow.

Exactly what I came to say. If neither had drawn, and it ended after the pepper spray, anger mismanagement guy would've been arrested for assault. Especially with how the defender continued to walk away and the anger guy continued to pursue. You don't pursue in self defense (I guess there could be rare exceptions, but I'm talking about intent here)

But you’re not mad at the juries? Since both had a majority who wanted to convict, I’d say the real problem lies in the general population, not the prosecutor. A jury is supposed to be able to withstand a corrupt prosecutor, so when a jury can’t see this event as self defense then the state has already lost their soul no matter who the prosecutor is.

A prosecutor should have never brought the case before a judge, AND a judge should have never chosen the case to be been bound over to go to trial (a judge is also supposed to be a gatekeeper). But whereas ignorant, or corrupt, or biased cops, prosecutors, and judges will always statistically exist in such a large and complex country, the theory of the “wisdom of the jury” is supposed to easily overcome the occasional glitch. I can fight against individual wrongdoers (like a prosecutor), but I don’t even know how to hope to change an entire population.

Then they took us outside and sprayed us. After we recovered, we were asked the same question. All of us raised our hands.

Its definitely muddy if he was the first to bring out the gun which I can't really tell from the video, but just going off the facts of the case. But its certainly understandable given the circumstances of getting sprayed and then followed after trying gain distance. Anyone would feel they are being cornered. End of the day it should have never escalated to that point. Its really unfortunate for everyone involved.

It's would have been "clearly" self defense if he tried to escape instead of going after the guy to shoot him. I was charged with 1st/2nd degree assault for defending myself, it was all caught on camera. I was indicted and went to trial, the prosecutor was literally trying to get a guilty verdict even though it was obvious I was the victim and only did enough to protect myself and leave the scene. Luckily the jury of peers all gave me a not guilty verdict.

He grabbed the guy's shoulder and got in his face initially. It seems very likely he threatened him because of that context and since that's the cause of most people getting pepper sprayed. There is a difference between self defense, and lethal self defense. You can only use force equivalent to what your being presented with. The defender is the one who escalated the confrontation to lethal force.

Holy shit man THIS SAME SITUATION HAPPENED TO ME YESTERDAY! Just a normal day shopping at Walmart, I got my groceries and head over to a self checkout. There is a line at every register, so I find the shortest one and stand in line. Then I feel a tap on my shoulder and this little dude in shorts says “Hey guy I’ve been waiting in this line you can’t just cut in front of me” I say, “sorry I didn’t see you or anyone waiting here” To which he replies “I was here the whole time” So I said “okay, go ahead” and stepped aside and let him go in front of me. But that wasn’t enough, this little bastard keeps on yapping his mouth, keeps going on and on “shit, you ain’t gonna disrespect me like that, try that shit again and see what happens” Honestly I was pretty fired up but I’ve watched this channel so much, I didn’t say anything, I literally got out of line and picked another register at the other end of the store. I checked out, loaded my bags into my car and went home, not seeing or interacting with him again. I was definitely heated, but after seeing this video it’s so easy to just let it go

First, I doubt that any of the jury carried concealed, and even less of them have ever experienced what a person goes through after being pepper sprayed. However, I do think that the guy in black provoked the situation. I would not have argued over a place in line no matter how much of a beating my ego took.

They showed us this footage in my CCW course in SoCal . The guy in shorts was an off duty cop and the guy on the phone was a legal CCW holder . Our instructor told us that using OC spray offensively can be considered deadly force because it can incapacitate the victim and leave them defenseless against the aggressor. He cited a case in downtown San Diego where a guy was spraying tourists with OC spray and robbing them of their belongings. Unable to see they could not tell authorities which direction the perp had ran off to or let alone provide a description of the suspect. This went on for some time until the serial robber OC sprayed the wrong off duty CBP agent and suspect took the sidewalk temperature challenge.

The guy in the shorts not only escalated to physical violence, he then tracked the victim down after the victim disengaged and created distance. The fact the victim drew his gun is a minor escalation if at all. He was assuming a defensive position to prevent further attacks. Seeing how the aggressor pressed the attack that was a good call. If the offender sprayed him and walked away he’d likely still be alive with some minor legal issues….Even after seeing the victim with gun drawn he still had the choice to run away, we see what he chose to do instead. Sad to hear so many brainwashed jurors voted for conviction but glad he went free in the end.

Nope as soon as the man drew his gun he put lethal force on the table. It doesn't matter if shorts was following him, it is an escalation of force, which in turn caused shorts to draw to defend himself. Shorts was wrong 100%, but was drawing in response to being drawd on wrong? He was presented with lethal force, and had reason that his life was in danger as he had just OC sprayed the man so he fears retaliation. Both parties were wrong and one is dead. Although he avoided a murder charge, he is still 100,000's of dollars in debt. It just shows that it is NEVER worth drawing a firearm unless you are in CLEAR risk of death.

Exactly. Self defense is not what it was 10 or 15 years ago. Today self defense is whatever the mob convinces a District Attorney it is. (Think Daniel Penny.) There are many criminals today who use OC spray as an offensive weapon as a preliminary part of an attack. Once they have you immobilized and vulnerable, they can then proceed with phase 2 of the attack with a knife, clubbing device, or a physical beat down. If you were to go up to an armed security guard who is delivering $100,000 to a bank, and pepper spray him, chances are you’re going to eat some lead.

If USCCA decides they don't think it's "self defense", they refuse to pay legal defense fees for paid members.

Apply this same situation to Police. If a cop was pepper sprayed for no reason, pulls out his firearm in response and then saw the guy pulling out a gun, the cop would not have waited for him to point or even given him commands to drop it. He would've shot him straight away because when you're already blinded by pepper spray, you're not in liberty to take any chances. You can see in the video, when the guy in black started chasing him, the other guy didn't go for the exit, he circled around which means he was going to shoot back. Our guy made the right decision. I'm so glad that the charges were dropped against him.

How this case is even debatable is scary. When you go to Walmart and you see the people there and imagine that pedigree of people deciding your fate you should wake up in a cold sweat. DA are some of the most ignorant people on the planet when it comes to real life violence. Watching videos, reading case law and interviewing people is completely different from being involved in a chaotic situation YOURSELF. Someone pepper sprayed you after a brief exchange of words in a drug store for no apparent reason? You are almost blind and must assume this individual is unhinged and intent on doing you harm.

I'm definitely on the side of the defender. Dude had oc spray and a gun. Had he not pulled his own gun I think the attacker would have hurt him bad considering he was incapacitated by the OC. Bravo Jury!

We can't judge a situation by what might happen. If that's the standard then anyone could shoot anyone for anything. A person holding a pen would be justification to start blasting. There has to be a reasonable belief of death or GBH. The guy hunting him down after OC'ing him made him the aggressor but its muddy whether that being OC'ed and hunted creates a reasonable belief of death or GBH. I think the jury got it right though.

A couple of things I noticed. The guy that was supposedly "in line", wasn't. He was wondering around and clearly not in line and especially when the other guy got to the line. It also appeared that the guy in shorts used the OC spray without being provoked. Guy in the shorts got what he deserved at the end of the day.

I'm still amazed the prankster shooter was acquitted of the most serious charge. I didn't see anything in that video that justified the use of deadly force. I'm not sure there was even justification for drawing a gun.

I can’t see, I can’t really run, the guy’s still following me… I don’t know what that guy’s trying to do to me, because it didn’t end when I tried to walk away… I’d say I’d be scared for my life to be honest. I’d at least pull out my gun to make the guy stop chasing me, that caused the other guy to pull out his gun… now there is only one option. I think I would see it differently if he had gotten pepper sprayed, walked away, the guy stayed in line and the shooter came back a minute later and shot him as revenge.

As a police officer let me give you guys a big indication someone either has a gun or they are a train fighter. Whenever your in an argument and the person is quick to escalate to the point it seems like they want to get violent. They have a gun or they are a train fighter. There are people out there that can't wait to use their weapon and these are the things they do.

Yep.. thats always been my thought. I once passed a guy on a narrow side street, (where typically both cars move over to not hit head on).. but he just flew right by in the middle, so I gave a ½ second honk. Just for him to slam his breaks, do a u-turn, and begin aggressively chasing/trying to hit my fiance & I. The nutjob was driving in oncoming traffic just to try getting on the side of/in front of us..(which i tried to prevent as long as i could) And the whole time he's laying on his horn, speeding up to ram us etc. So we call 911 to see if they can help, give his description, plate # etc. Finally got to the point where he nearly hits another car while passing us, and then brake checks us till were at a standstill in the road. And while he's cussing & yelling out his window, im trying to get around & away from him.. And he repeatedly swerves to block us from getting away (traffic had blocked us from reversing). So being in a Yukon, i resort to hopping a curb & cut thru someone's lawn to finally get away & turn off that street. But I had no doubt this guy either had a gun & felt brave.. or was doped up on something. And I didnt own a gun yet so thankfully it didnt escalate even more.😬

@@NnjklgfxxvcI agree, living in an open carry state with “Will issue” CCP laws, politeness and a courteous demeanor with all social interactions is a must. I am former military and familiar with weapons and fighting. Whenever I am in any public venue and the end of the line is unclear I always ask those around if they are in line or not. I do this in a socially acceptable manner so as to be sure I don’t step on anyone’s toes. Also if someone says they were there already I step aside for them. Too many entitleds of all stripes to quibble over silly stuff. No matter how big you are or how well you can defend yourself there will always be one who is quicker, crazier, or on some drug. As self defense instructors say , if you can withdraw and or run away do it. Now in our upside down country where DA’s just make up stuff or have a political agenda, reading a room and withdrawing prior to, is the way to go.

Sometimes you can't win. The defender said a few words and backed off when it wasn't working. Then he's pepper sprayed without warning and only brandishes. He did what he could to not use lethal force. Definitely not murder

About what the other guy said, what in my opinion he is trying to convey is what the black shirt was thinking before he drew the gun, was he thinking of defending or to kill? did he wanted to kill this guy and was happy to do it or not? its hard to know the intention of someone but sometimes theres audio and in some videos you can clearly see that someone just wants to shoot people. Its the like the expression, ( He waited all is life to use that gun) more or less like that. I do think he drawing a gun and backing out was what helped not being convicted, and not knowing the intention and history of someone i will do the same and not convict the guy with the information on hand.

Not gonna happen. One .. the prosecution had a clear case (whether we agree with him is irrelevant). This wasn't malicious. As said above, you have to really have some hardcore evidence of prosecutorial misconduct to go after them... and like I said, this case had plenty of evidence of a crime. That's why the jury hung twice in favor of conviction. I wouldn't have prosecuted him, but that doesn't mean the prosecutor who did, did something wrong.

@@GaryUSMCvet You need to rearead what I said. I don't disagree with any of that, so your "hint", much like your post, is useless. I was addressing suing the prosecutor for malicious prosecution and didn't really say much about the actual shooting at all. That is an EXTREMELY high bar to get over, and this case is not even close. A prosecutor has a lot of discretion on when to charge and not charge a person with a crime. In this case, for whatever reason, he chose to charge the person. Whether I agree or not, it's his decision. A case of malicious prosecution would immediately fail on the simple grounds that after 2 trials, the jury hung both times, and both times were in favor of convicting the shooter. Again, I don't agree, but it showed whatever case the prosecutor was putting on, was at least somewhat convincing to the jury.

Looks justified to me. He was completely in defensive mode and has every right to protect himself. I would call that a defensive display of a firearm and the aggressor chose to draw on him instead of leave him alone. If I’m on the jury I think the initial aggressor would also be obligated to break contact with someone who is try to break contact instead of following him and drawing his gun. The defender was always in retreat and should not have been tried. Definitely a good lesson.

I'm a little surprised at John's take on this- the defender didn't immediately draw a gun. He tried to get away and the attacker followed him. The defender was diminished from the oc spray and even after he drew his gun, he was still trying to get away. He had every reason to fear this attacker pursuing him.

When someone aggresses on you for nothing, partially incapacitates you with pepper spray, and pursues you as you flee, you have reasonable suspicion of great bodily harm or death. Ie, self defense. 3. The bad guy ALSO pulled a gun. All that sh!tbag needed to do to be alive today was not start and escalate a violent confrontation. Amazing that you're still defending the offender even though you saw that, on top of initiating the attack, he also had a gun. OBVIOUSLY the defender's life was truly in danger. I'm very glad it was the bad guy and not the defender who ended up leaving this world. But if he had not drawn his gun, it may well have gone the other way. Can you imagine what a crimimal free for all the world would be if everyone thought like you?

Now no one could know all that ahead of time which is why if you are peppered sprayed as an offense measure and the clown keeps coming at you then you can reason this "fight" is going to be escalated fast.
