In the early days Sibiya's version was not clear to his lawyers and the court. Mngo had to keep going to Sibiya to get clarity. Between them, Sibiya and Mngo, they kept tweaking the version as witnesses and new evidence came in. It is being re-tweaked by Sibiya as a solo effort now. This could prove detrimental to Sibiya's main trail as well as his trial-with-in-a-trial. What prosecution is doing now is placing Sibiya's new version on record. This will limit further tweaking of the version going forward.

I agree . From the outset there was no proper consultation between the accused and the defending lawyers . Criminal cases require too much of consultation and research. The defense relied on what they heard from the accused and seems not have scrutinized it in depth. There are many loopholes on the defense side . There is still a long journey to cross exam the accused . The defense paid more attention on the assault ignoring that there is no medical evidence or report to substantiate the alleged assault . Furthermore the answers of the Mr Sibiya are inconsistent with the questions of the defense . Several times the defense stated that the accused will say that , but now we don't hear that from the accused .

I so wish I could put this in my home language but let try King Charles language. Sibiya and Mngomezulu are not contradicting one another, it's Sibinda whose putting a wrong version to the accused. For example Gininda said he was not on a particular place, where Muzi said Gininda was also present. So Sibanda he read the last part of Mngomezulu and Gininda Cross examination. Where he said, Mngomezulu said to Gininda he must not answer for what happened in that particular place in question which I forgot, that's regards as a hearsay. Why Mngomezulu said that it is because Gininda refused to be in that place. But what was put to him is that the accused person said he was there. So for me Sibanda his the one that is putting the wrong narrative to fit his version.

I am not a lawyer or a judge but if i were to hear that the arrested person at some point rather requested to be kept in prison (away from police) rather than the police station, it would be ridiculous to come to a conclusion that whatever confession he made in the presence of police (which he wanted to stay away from) was made freely and voluntarily. If the state did not take the accused to a district surgeon to be examined whether they were assaulted or not as they alleged then the accused evidence shall stand and it will be extremely difficult for the state to prove confessions. @@MahlapeShabangu-jm7em The contradictions made by the accused are not material such that the court could definitely rule in favour of the state.. there are serious material defects in the state case like the issue of assault which the state did not prove beyond doubt that the accused were never assault...that's a very serious defect in the state case...if the police were honest that the accused were never assaulted why they did not take them to a district surgeon..that evidence stand and counts heavily in favour of the accused..

When are the Khumalos coming in? When is the 2nd docket coming in? Why did the police request Chicco Twala's gun for testing? Why was there a squabble in the house between Llongwe and Zandi Khumalo? Was Llongwe Twala ever invited to that gathering at the Khumalos? If not, why wasn't he invited? At what stage did he come in? How come he left the house when his so called girlfriend was in danger after the arrival of the so-called intruders? So when he went pass the intruders carrying a gun, they just relaxed like that, not knowing whether he's going to call for help, mobilize the community to fight the two intruders, or call the cops? How did he run at disappeared, and not use one of the cars in the yard? Did he arrived at Khumalos with the car or he used public transport? Now second person also went pass the intruders and went outside and jumped the fence and lended up at Ncashe's yard, and the intruders allowed that to happen with no injuries sustained for defying the order to hand in all their cellphones and valuables? And he's unsure as to how many gunshot he heard while he was outside, but certain that it was two, but the third sound was not clear enough as to whether it was a gunshot or what. And Kelly Khumalo standing in the passage doing nothing to assist Senzo who was fighting with the intruder carrying the gun. And 2nd intruder with a knife/gun allowed people to went pass them to go outside, others bedroom or bathroom. And the 3rd male what happed to him did he eventually ran outside like others leaving one male against 2 male intruders. And Kelly Khumalo calling Chicco Twala to inform him about the incident while Chicco's son ran outside unharmed. And the family of the harmed, wounded and deceased are not told first. And now Tumelo Madlala telephoning Senzo's family to inform them about the incident telling them who did it and that it was a mistake, is now singing a different tune now. I agree, being tortured physically, mentally or emotionally brings trauma and if one torture after the other, certain things can escape one’s mind. Anyone who has given evidence in court will know this. It becomes even more difficult if the witness is a layman. Barristers, Advocates however you want to call them, twist questions and that would irritate anyone. It does not matter how calm a person is but answering the same questions will end up irritating.

Police always assault the accused in South Africa and even if they report it it's never taken that's why they never bit u on the face they use lower parts. And sometimes if u were badly hurt they don't bring u court. They make up a story that there was no transportation
