Senzo Meyiwa Murder Trial | 12 February 2024

Cross-examination of accused number 2 in the Senzo Meyiwa murder trial, Bongani Ntanzi, continues today. On Friday he testified that he never confessed to any involvement in the killing of the soccer star. He told the High Court in Pretoria that he only signed papers after his alleged confession on the 24th of June 2020 because he wanted a phone call and a bath. This as the trial within a trial to determine the admissibility of alleged confessions by Ntanzi and accused number 1, Muzi Sibiya, continues.

Today's session confirms three things. One is that Ntanzi was indeed assaulted. If you really listen to his voice projection when it comes to narrating how he was assaulted and how it happened including how each individual participated in the assault itself, you will clearly see that he is telling the truth. Two is that someone in police had a caring heart to leak out to Mngomezulu how police framed Ntanzi. That is why there appears to be places where Mngomezulu was definitely sure of and Ntanzi wasn't. To some, this might appear as inconsistency but it is not. It just shows that there might have been a police officer who fought on the side of Ntanzi for justice to be served. Three is that the line of Sibanda's questioning today shows that the state is now clutching at straws. Four is that the Judge uses a different criteria of interjecting between defense and the state. He kept quite when Sibanda incorrectly put to the witness that according to the AVL report, the car did not stop at Baragwana hospital because it said GPS locked. If anyone listened carefully to the expert witness, he said GPS locked means there is no signal at that place and so we cannot tell whether the car was moving or not. That means it is possible that the car stopped and it is also possible that it did not. If anything, the state should have some explaining to do on why the AVL kept locking in areas that were to the disadvantage of their version.

This is why he was tortured in that way. If the state has compelling evidence against someone there absolutely is no need to force to make a confession unless ofcourse if they are trying to frame them so that those who paid them (state) will get away with it.

Guys in case law a person can never be 100% correct. It is necessary for a human being to have errors in conveyance of evidence or statement. The judges and magistrates knows that. Ntanzi may be right but he is a human being he is also privy to errors. Errors does not constitute guiltiness. But deviations can cause serious harm to his statement. We must also keep in mind that Ntanzi was not taking notes on all this ordeal and the alleged torture he suffered.

Having the necessary exposure in the process of arrest. The witness version is what is general practice in the cells. Even 35 a rights. You leave the charge and fill out everything else... get the accuse to sing and you write the charge after. Then give him the copy. OB it is only strict police that would write themselves. 90%, you write your own OB entry. The keys and cell allocation, is also true the cell guard would inform you which cell is free you, take the person yourself.

Sibande purposefully moves from one topic to another and the randomly bounces back to the same topics. This is a typical tactic used when the advocate is of the opinion that the witness is sticking religiously to a prepared narrative as opposed to telling the truth. The defence and the judge will recognise the tactic and allow it. That is the reason why there is not much objections from the defence and the judge.

These are all necessary questions to the Mr. Ntanzi, because you need to know when and where and if these assaults did take place. For example, they collected me from Tembisa Police Station and then took me to a certain place where they then assaulted and tortured me. All of these actions do have a time frame that needed to be compared to the vehicle tracking systems of the vehicle used. Assault and tortured do not take 5 min of that I am certain.

in this part of evidence the state wants to prove that, the 1st and 2nd accused were not 1. Intimidated, 2. Tortured, 3. Abused, and 4. Coerced to sign documents. That the accused made a "confessions" a. Volunteery, and b. Without being assaulted. According to my little knowledge, the state has dismally failed so far to dispute the fact that, accused persons were not beaten up by the police. That's why the state has brought so many witnesses to explain processes at police stations, that were never being followed. It is a well known facts that police always do something else and when being asked about it they'll ran to protocols and standard procedures. We all know that
