I would check the Definitive Map or the Ordinance Survey Map. That path could very well be a public footpath: the medieval road system. If it is a public footpath, then you was on public property.

That footpath might be a private one, but since there is nothing to stop the public walking on it (no barrier and no sign and bollards are to stop cars, not people), then its public according to s33 of criminal justice act 1972.

It's still private land though, and access can be removed. It's not a' right of way'. Sec 33 CJA 1972 defines a public place ONLY for the purposes of the Public Order Act 1936. It states as much in the wording of Section 33. To be fair though, I was never asked to leave, they simply informed me it was private property. But my purpose isn't to test the public access/private property issue, I just want to take photos.

@@Stuart_George All land is technically "private" You have to be doing something illegal to be removed, its a car park, not a front garden it's open to the public hence public access by the fact you can access it (no barrier to climb over) look up some case Law about it. A right of way is a totally different set of Law. Public Order Act 1936 has nothing to do with this its about control of extremist political movements nothing to do with photography

You are right that the Public Order Act 1936 has nothing to do with photography or property. That is the Act in which a public place is being defined by the Criminal Justice Act 1972. It is defining a public place for the purposes of that Act ONLY, which meams it also has nothing to do with photography of anything to do with being allowed to remain on privately owned land, which is why it has no relevance, but I keep hearing people quote it. You do not need to be commiting an offence to be removed from someone elses property (publicaly accessible or not). Under common law “If a trespasser peaceably enters or is on land, the person who is in or entitled to possession may request him to leave, and if he refuses to leave may remove him from the land using no more force than is reasonably necessary.' I would be intetested in reviewing the various case law, if you could point me in the right direction.

I have had an SIA badge since the beginning. I recently up-skilled in September 2018. And this filming in a public place was covered. It was not covered in 2006. This video is 2020 how the hell did these 2 guys miss that part of the course🤔 Trained in law last 3 years at university and hopefully work in training and advice for various companies. Their only purpose is to give a right of way. But at the same time they claim it's private property which has no right of way. A possible loophole to filming on private property. I would agree with that. No laws expressly prohibit using a camera anywhere (public or private land). There are laws surrounding what you take photos off (indecent images, terrorist purposes etc). However, you have no 'right' to remain on private property once asked to leave.

With regard to photography, there is no law I could print on a piece of paper, as there is no law saying I can take photos in public, it's more a case that there are no laws prohibiting it. I could print out some case law regarding expectation of privacy in public places, which would help explain why taking photos from public is not against the law. Or I could print out the ACPO (NPCC) guidance. Look, if they leave me alone in the end, I'm happy. The 'education' is secondary for me, but the more it happens, the more I think it may be worth doing.
