People seem to have a misconception about what happens to you when you make a successful insanity plea. Yes, you do not go to prison. But, that does not mean you go free. You go to an asylum. And if you go to an asylum the conditions can sometimes be far worse than prison. Your sentence can ultimately end up being far longer too as it is up to the discretion of the institution as to when you are allowed to be released. So, while in some cases you may have served 10-30 years depending on the circumstances of a very violent crime; if you get sent to an asylum you could be in there until the day you die.

In 'merica, the death penalty is basically just life in prison. They can pretty much appeal the sentence until they die from old age (and often do.)
