As we saw in this case , the Odisha High Court only suggested and did not lay out a broad proposition of law. On examining the various decisions of the Supreme Court and High Court , it is very clear that sex on false promise of marriage is rape or not depends on the facts of the particular case and there can't be a straightforward formula to decide whether promise to marry was based on misconception of fact or not.
