My grandmother once gave me a VERY good piece of advice: "Always remember, it's hard to get into trouble with your mouth shut!". I think this rings true for an encounter with law enforcement, in particular.

Quite underrated comment here. I had someone forget something in my car (cuz I used to give rides to friends etc). I made the mistake of voluntarily letting him search my vehicle; tho I had precept it with "I've given rides to ppl these weeks and haven't cleaned my car out lately." needless to say, I didn't get arrested etc

@@glytchd Yeah, and they always try to get you to shoot yourself in foot with bulls**t like: "I can't help you if you don't come clean with me" or "Honesty is always the best approach, be honest with me and I'll do what I can for you" etc etc... Don't make their job any easier, especially since you most definitely won't be getting a slice of their paycheck and in the end all you're likely to get is f**ked without so much as dinner and movie first. Name, address license yes or no followed by something like: "Sir, I understand you have a job to do, however I choose to rest on my constitutional rights and respectfully decline to answer any questions or engage in any further dialog! Furthermore, I absolutely do not consent to any searches of my person or property!" They'll give you the bulls**t party line of "Oh, what are you so worried about then" "Only the guilty pull that crap" or "If you don't have anything to hide, why not make our job and your day easier and let us search X, Y or Z and we can just let you get on your way" Don't, just don't do their job for them! I the son, nephew and a brother to cops...believe me, most of the time, it's people doing their job and arresting themselves or giving them the PC they need. Stay silent, sweat it out, and don't do their jobs for them, nor fall for the time honored cops nonsense as outline above! :D I mean all it takes is for that one "friend" with some pot, coke, dope who chucks that baggie somewhere else in the car and most of the time it's you getting f**ked for it under the: Your car, your responsibility!" and pow, now you've got some shiny new bracelets to wear and all the crap that comes with that. But, seems like you've already encountered that one "friend"!

No. The most important part is shutting your mouth and not speaking. What you said can help you legally, but it's not as critical. Some people say they are going to exercise their right to remain silent and then keep talking. They would be far better off to not say anything at all than to do that. If you fail to say you are exercising your right, the fact that you are silent might be used to imply guilt. But the things you say because you weren't silent are far more damaging to your case.

The one I love is "do you have any weapons in the car?" A weapon is a "tool of the moment " so a bat, a tennis racket, hammer, screwdriver, gun, knife, ect all meet that. If you say "no" and they find a bat then they can and usually do say you lied about weapons. Most people think guns or knives when asked that question.

@@cult_of_odin I'd say the same about Colorado except maybe the liberal areas around Denver and Boulder. Otherwise nearly everyone is ready. Especially in rural areas where the police could take an hour to get to you. I know the sheriffs would say that's not true but my father was a Gilpin County deputy for 20 plus yrs and I can assure you that a half hour is a fast response time.

It sounds kind of silly to hear but, I've seen video as recently as yesterday of someone admitting to having a little weed in the car ,and the obvious happened (yes it was a small amount and the driver had a med. card) it resulted in an arrest ,an eventual dismissal ,but also days in jail waiting to see a judge ,a lost job ,an eviction notice ,homelessness and several ruined lives. And I'll bet those cops felt great about thier big pot bust. It's what they live for. That's one of the sad things about our society today.

Actually in my experience they actually dont. Most police officers are just like you and me and they are doing their job. They are simply trained a certain way and they are not verse in the law, simply how to enforce it. In my experience most cops will just give you a ticket and and move on with their lives. Keep in mind unless you were actually drunk driving, which you should not do and doing so is a danger to yourself and others the police are doing a good service to the community by making sure the streets are safe from drunk drivers. That being said you should still exercise your rights, specially if you are innocent because all it takes is one misunderstanding or a bad apple to turn your life into hell if you open your mouth. Be respectful to the officer but let them know you will not say anything other than providing Drivers License and Car Registration. Respect goes a long way in dealing with the police.

More than 95% of all traffic laws, and tickets are done for Control, and revenue generation purposes, not safety. The majority of traffic laws written for the people are not required to be followed or obeyed by the police. We cannot talk on any hand held device while driving, but they can... We must obey all speed limits while they can exceed them, etc... In short, traffic laws in the eyes of the police are for us to obey, but not them.

Absolutely. To illustrate this fact I want to share a story from when I was a teenager. Now I can admit I’ve made some bad choices and was arrested about 2 blocks from my home, for a DUI with another charge of careless driving. Then the cop proceeded to berate and insult me, because he didn’t want to have to drive me the 15 minutes to jail, as his shift was almost over, so he decided to do 90-100mph through residential areas, and weave in and out of traffic on the highway, as I sat in the back with handcuffs on, furiously contemplating the irony of being driven recklessly to jail after being arrested for careless driving/DUI. And I’ve hated cops ever since. They don’t care one bit about your safety or freedom and are a much bigger danger to our public.

Some of this is helpful especially in regards to Virginia. I live in Pennsylvania and they operate much the same way. However, Virginia is way more punitive with speeding offenses than almost any state I've ever been in and I have had a lot of speeding stops. For instance, I was doing 81 mph in a 60 zone and the trooper wrote me up for a misdemeanor which is punishable by up to $5,000 fine and 30 days in jail. In addition they want you to go to the county and take a driver's class for a week which costs $750, +/-$100. And if you live a distance away you will have to likely get a hotel, but they don't care. And if you're from out of state they will go at you harder, but will petition your home state to revoke your license if you choose not to respond. Many states do that these days as well. The cop pulls you over for DUI, drunk or sober, you're pretty well boned. In PA, you certainly can refuse a field sobriety test, but you will have to take a ride to the hospital for a intravenous blood test. Well you still have the right to refuse that, the officers then record that and, as per the statute of the state, send that refusal to PennDOT who will revoke your license 100% of the time. What are you going to feel it they uphold 99.99% of those cases, regardless as to whether your sobriety was proven or the stop was under false/erroneous pretenses. This is of course I'm constitutional, but police, prosecutor, and DOT do not care. And this is probably where Pennsylvania exceeds Virginia in Draconian traffic laws. I disagree that cops don't have quotas. While it is not like a sales quota they still have to follow job performance metrics which includes issuing a certain number of tickets per month based on what the precinct says is average per officer. This is why, if you have ever noticed, they always appear to be more active in week 3 or 4 of the month. This was told to me in confidence by a retired State trooper who is a friend of mine. So yeah, they have "quotas" it's the system rather than the officer that drives them.

Not true. Lawyers who lie are bad lawyers and are breaking the law that they took so long to study, and having a bad reputation as a lawyer can and will ruin their career. They take pride in 'outsmarting' the prosecutor (which is a government attorney). The prosecutors are the ones who make up wild assumptions; though, they are still not lies - just accusations.

That depends heavily upon whom the lawyer is representing. If they are representing the state or government, or they are part of a divorce case, then they are almost certainly lying. Defense attorneys who are representing innocent defendants are usually telling the truth.

I have mild Cerebral Palsy and, while I may look normal, I cannot pass the agility tests at all. Anything that asks for more of my left hand than to keep it hooked on my suspenders is not going to work. A neighbour, who is a local police officer, and I were discussing it and we went through the tests. I can not pass them when sober (no, I have never tried them inebriated).

That is why i tell them no on the field test and if they think I am drunk get a warrant and then I'll do a breathalyzer or blood draw. Since i don't drink i don't worry about those. But in my f'ing state if you refuse to do a breathalyzer you lose your license for 90days. I am trying to figure out where do process is for that to happen. But after 90days you can go in and get your license back and there is nothing they can say or do.

I had 2 cans of V-8 juice and 2 Litters of Diet Coke and a Pint of Carrot Juice ... And Oh....A 1/2 a Gallon of Water ! And he said " Despairingly " " I meant alcohol " ! I love the way you think. But it’s like what’s happening in Australia right now. People have said that being the decemdants of convicts people should be more respectful of liberty and freedom. But as so one wisely said it’s that there are too many descendants of the jail guards , that’s the problem. And as we have seen doing the lockdown, too many LEOS forget their oaths to support and uphold the Comstitution. Some do tho….The sherif of Knox County TN refused to enforce any mask mandate. He said it was a mandate not a law and was Un Constitutional. He said he would uphold any law that was legally and lawfully passed but not mandates. It makes me wonder, in a SHTF situation, how many LEOS will side with the Constitition and We the People and how many will side with and obey the tyrants. I have the same question about the military. I rather think more military are aware of their oaths to uphold the Constitution, and to protect and defend the United States against all enemies , foreign and domestic. Well, I’m just watching and waiting…..to,see what further acts of tyranny will happen during Biden’s time. And I think that him being what he is, that there will be more acts of tyranny….but I’m talking about the big one, the “ shot heard round the world” kind of act …and I’m watching and waiting to see what We the People will do. Well, the patriotic, Constitution supporting, freedom and liberty loving part of We the People…..It’s easy to talk and to be a keyboard warrior, bit when the shit gets real, well, that’s a different story .Some can talk the talk and that’s all, others can walk the walk…….actions speak louder than words. These videos are invaluable . More people should watch as many as possible. Over the years I've made it a point to educate myself and keep myself from falling for thier tricks ,but it hasn't always been that way. It doesn't matter if you're not a criminal and have nothing to hide. Convictions and conviction rates are all that matters to them.

I love this channel! I was on my way to get the exhaust, 6 new tires, and a NYS Inspection on an antique project truck my step son and I had been working on way back in the 90's. I was driving and got pulled over. The police officer asked if I knew why I was being pulled over. I knew I wasn't speeding, as the truck couldn't go that fast, and when this truck was made shoulder belts we an option, one this truck did not have. I said, "I'm not sure why you pulled me over. Was it the 6 bald and dry rotted tires, the loud exhaust, 2 hillbillies in an antique truck with no exhaust system barreling down the road at about 10mph BELOW the speed limit, or we didn't have seat belts on, but this has no shoulder straps? The cop looked at me and had nothing to say. He asked where we were going and I told him the tire shop in town and then the exhaust shop with a bender down the road from the tire shop for an exhaust system and inspection. He then let me and my stepson go as he laughed saying I pretty much covered it all. He did check, but did not run, my license, and it is a class A with XTP endorsements and no restrictions. We had the work and tires done on the old truck, and it was a much quieter ride back home, and we passed him in his regular hiding spot, all inspected, quiet, and 100% legal. My stepson was driving home, he was trying to speed, but to no avail. I know I should not have said anything, but we had appointments at the shops, I have the class A, and NY has a temporary inspection sticker for new purchases and new registrations. All these years later my stepson and I laugh about this incident and the goofy look the cop had.

Before anything, what I'm about to say is NOT legal advice or counsel, please speak to a licensed attorney and follow their advice, anyhow! If a cop stops you first be respectful and keep your arms in the wheel. If they just tell you you being stop let say for speeding and going over x amount of miles over the limit, I need name DOB, license and registration give them that. If they ask an open ended question like do you know why you were being pulled over, a simple no should suffice. If they are fishing and they ask you, sir were did you came from that's when you pull your 5th amendment rights by stating. Sir I respectfully decline to answer your question or I'm invoking my 5th Amendment rights and decline to answer your question. If they want to check your car you can invoke the 4th by stating I am invoking my 4th amendment right and do not consent to any searches or seizures, do keep in mind Cops don't need a warrant to search your car just reasonable doubt which can get pretty screwy but a good rule of thumb is too not give the cop any chance to look inside your car by having your windows up and only opening it up a bit to give your license and registration. If after that they still want to inspect your car, cooperate but let them know that you are not giving them consent to do so. Do not answer any other questions they ask but be respectful and professional. After they search your car and obviously find nothing incriminating or even if they do your next questions is going to be, officer I'm I free to leave? If the cop doesn't want to arrest you by this point he will give you your id and registration and give you the ticket, which is a court citation btw and move on with your life, if they don't let you go you will be arrested. Being arrested is not the end of the world btw, just keep your mouth shut and lawyer up.

And if they bring in the K9 unit to do a sniff around your car, you're screwed. After they get a positive reaction (they will ALWAYS get a positive reaction from a K9 since the dog is willing to follow the officer's commands and will want to please them), then they can search your car.

In the jurisdiction I live in, the Police department solely deals with fix-it tickets. The kind where you get a fine but fix it before the 10 days and go to a police station, where the civilian desk clerk makes sure that you light or what ever is now working. They then dismiss the ticket.

I have seen this ticket, (was with the friend who was driving when they got pulled over, went with her to the CHP station later); this was... three or four years ago (in Los Angeles). So, might not be a geographic jurisdiction, but was a CHP stop (not LASD or LAPD).

Last time I got a traffic ticket in LA (red light or speeding??), I pled not guilty intending to fight it! I went to the judge’s courtroom a few times before my court date to observe how things went down, possible winning arguments, etc. Biggest thing I noticed was that the few attorneys who were there got to go ahead of everyone else. Nearly ALL of the attorney’s tickets got dismissed, or at least reduced! I hit up one of those lawyers in the hallway and she took $100 to fight my ticket the next week with her stack, and got it dismissed, which I couldn’t have done!!🙏😎

Each time I visit my neurologist, she gives me what is called an "Evoked Potentials Test". It is essentially the same as a Field Sobriety Test. I have Multiple Sclerosis and cannot pass an Evoked Potentials Test, so if stopped, I always refuse the field test and that automatically triggers the blood draw - which is what I was wanting in the first place.

SALINAS v. TEXAS I assume you are referring to. Strictly speaking per the holding if you don't answer any question, then remaining silent is fine. However if you respond to any question, even a "Hey how ya doing?" You must invoke the 5th afterwards to be protected by it.

I would lean towards asking questions is engaging with the cops and opening yourself to issues. About the only question I could see being safe is asking about ones legal status. Ie am I free to go?

Great video! I got pulled over for a illegal right turn. The H.P. officer asked me, "what was that all about?" I didn't say anything. 30 plus seconds later he asked me for my lisence and proof of Ins. He wrote me a ticket. I pleaded not guilty. In court the judge asked the officer the details of the incident. "Listen carefully to what the officer says!!! "I stated to the judge, he pulled me over on this street, I never made a right turn. Case dismissed! I did not say "anything", he could not right anything I said down on his notes against me! This is a Great Attorney! Subscribed!

I think the biggest piece of information a person should know is that an answer that you give the police *CANNOT* be used to *HELP* you in court either. STOP TRYING TO DEFEND YOURSELF AND STOP TALKING. That is the best way to defend yourself.

I was recently told by an officer here in Virginia that all officers from his department were required 2 tickets minimum a day. He told me he likes to choose out of state drivers due to the fact they almost always pay the fine instead of returning and fight it in court.

In Minnesota and I believe a lot of states sobriety tests are "voluntary" but you automatically lose your license if you refuse to take it. I am surprised that's not the case in Virginia.

That's a ridiculously hard thing to do even when sober. I guess they make the tests as hard as possible so that very few people would pass them, sober or not. Is there a limit to how many sobriety tests they can give you, or can they just go on and on until you fail one?

The only time I never responded to a cop I got out of a ticket. I'm an Uber driver in LA. Dropped someone off at a strip club. Made a U-turn from side of the club. Cop pulled me over. I had my DL/Insurance on hand when he came up to the window. After every question I just shrugged and said nothing. He gave me back my stuff and said have a good night. FYI - Santa Monica and Beverly Hills cops write tickets regardless. They want revenue.

You are referring to "Implied Consent" laws. If you refuse a field sobriety test in Utah, you lose your DL for two years

Don’t be afraid to lie, right from the get go. If he asks “Have you been drinking?” ALWAYS say, “No, I don’t drink.” Yes, it’s might be lie, but who cares?. Any admission of drinking at any time is telling a suspicious cop you are lying your head off anyway. Saying anything else is making the cop more suspicious. If it’s a stop for DUI, you told him you don’t drink, then the next thing you say is, “Am I free to go?” Now, it’s all on him. He stopped you for DUI, you told him you never drink, and what is the point of him still detaining you? Keep repeating, "I don’t drink, am free to go?"

Be aware: The Supreme Court has ruled that just staying silent isn't the same as your right to remain silent. You MUST say that you are exercising your right to remain silent and not answer questions.
