Courts around the world are hearing cases that raise issues relating to climate change. The judicial response has been mixed: from dismissing climate claims on procedural grounds to directing governments to take urgent corrective measures. The Indian judiciary, often applauded for its progressive stand in environmental cases, has also started engaging with climate change. In this talk, Shibani Ghosh will discuss some of the cases before the Indian courts which have dealt with climate change - whether as a core issue or as a peripheral one, and then analyse the prospects of climate litigation in India.
Shibani Ghosh is a Fellow at the Centre for Policy Research, New Delhi, and an Advocate-on-Record, Supreme Court of India. She specialises in environmental law, and appears in cases before the Supreme Court and the National Green Tribunal. She has authored several articles and opinion pieces on environmental issues and has edited a volume titled Indian Environmental Law: Key Concepts and Principles (Orient BlackSwan, 2019).
