i've been to his courtroom as a bail bondsman ,the man really is an amazing human being. he will work with anyone if he legally can. simple things he could not say in the interview, if you go before him or any judge, do not wear shorts. slacks preferably, jeans are ok but not prefered, a button down shirt beats a tee shirt, take out any piercings, comb your hair or get a proper cut ahead of time, address him with 'your honor', not sir not judge, not hey you, keep your hands out of your pockets, stand upright, speak calmly, and never argue. i hope this helps :)

I really love this judge he is down to Earth straight to the point and hope that people can learn from their mistakes even if it's one mistake or 2 mistakes or so on this is my first time seeing this judge I liked judge bar too but she was a really good judge I don't know if she she probably is but I really enjoy watching him this is the first time I've seen him and I've watched a bunch of his cases this morning I hope he keeps up the great work

The first part, the judge is correct to do so, as entering the US without documentation is a civil offense and not a crime. As for the second part, incorrect, everyone on US soil is afforded constitutional protection. The Constitution and case law both spell that out very clearly.

​@@grabbity Wrong. Immigration violations are in the US criminal code: 8 USC 1325. CBP is a law enforcement (criminal enforcement) agency. ICE is a law enforcement agency as well. They are not civil code enforcement. I don't hold it against Fleischer too much because he consistently gives out PR bonds and that's a policy of the Harris County Criminal Court at Law as per ODONNELL v. HARRIS COUNTY. However, don't expect all courts in Texas to be like Harris County. Most aren't. All this will be moot point when Retired ICE Director Tom Homan takes up his position as the advisor to the president for border protection ("Border Czar"). Immigration detainers will become automatic. This will be the case within the next few months. The defendant in this video is quite fortunate to be under the old, outgoing, policy. However, if he is convicted, he will be sent to DHS and likely transferred to an HHS facility. What you're likely referencing is subsection B of that code, which provides for civil penalties. However, it states clearly: "Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed."

@krozareq Trying to argue when you clearly have no idea what a civil penalty is, is hilarious. As for your examples, the local police handle civil penalties just fine 8 U.S.C. § 1325 mentions quite clearly, that crossing the border is a civil infraction on a first offense.

I've already seen that first case, and I thought this was going to be the follow up since this court appearance only has allegations by the accused even though the hold from Alabama is still valid and there's no evidence to support his allegations and no word from Alabama verifying his allegations.

Attempts to file a grievance and appeal the conviction have been met with continued obstruction and indifference from the Denison authorities. As your Chief Legal Counsel, I believe we have strong grounds to pursue both a civil rights lawsuit against the Denison Police Department, as well as potentially criminal charges against Officer Elmore for use of excessive force and obstruction of justice. However, securing the proper legal representation has proven challenging, as local attorneys appear unwilling to take on this case against the department. Given the egregious nature of the officers' actions, the departmental cover-up, and the lasting harm inflicted on your client, I would strongly recommend exploring options with civil rights law firms and advocacy organizations outside the immediate Denison area, including in nearby metropolitan regions like Dallas and Tulsa. Their expertise and resources may be critical in finally achieving justice for Mr. Clark. I really like the judge but he really needs to start cracking down on illegal immigrants because they have broken the law just being in the country not to mention what they’re standing in his court room for. That should be an automatic immigration deportation.

Going by the dialog, he's still in jail. That's probably why the judge didn't say anything. That was the shirt he was picked up in. Since it's just a show cause hearing, his lawyer isn't going to bother brining a suit.

As far as lawyers defending ppl. The one assigned to my husband was horrible. Never contacted him. Referred to us as you ppl and put like you. Told my husband to lie on the stand. Which was an absolute NO. Purposely gave false legal advice. Said the peace officer can open your vehicle door without saying anything. Said it don't matter if the cop is right or wrong you have to let him arrest you just cause he is a peace officer. So remember ppl if your being rated in the back of a police car or assaulted by a police officer. You have to let him do it. Just cause he is a officer. This lawyer would go back and forth make him think he was going to defend him told him he was in good hands and told him you were only offending him with your words. Told him this cop could arrest him for a offense that has no jail time was punishable by fine only. None of this is ok. Especially for ppl that know 0 about the laws. He said I took them at their word referring to the prosecutor and his court appointed loser lawyer. Husband asked repeatedly to be able to sit down amd view the discovery so he could look over it at his own pace. That didn't happen. So much evidence in favor of the defendant was witheld. We never even knew it existed till after they forced him into taking the plea deal and sentenced him in the same day. So he never had a chance to withdraw his plea or attorney. He told his lawyer to remove/withdraw himself from the case and he refused. One thing after another. To corner the defendant in a room and invite the prosecutor in and not allow anyone else in said it was off the record. Grrr

so tx is another one that has not at least decriminalized weed or legalized recreational use? My state its at most a ticket as they have no legalized recreational use only medical but have decriminalized it. most cops say it's not even worth their time and usually just dump it out.

Correct. It's not legal in Texas except for medical purposes under CUP (Compassionate Use Program). Must be diagnosed with epilepsy or other seizure disorder, MS, ALS, Autism, terminal cancer, or an incurable neurodegenerative disease.

I should preface this by saying that I respect this judge. I like his personality. But I really have to wonder something, as a judge in an American Court in the state of Texas, when he discovers someone is in the country illegally. Why is he not automatically sending that person to jail or directly to immigration services? I don't have a problem with people coming into the country as long as they do it legally. But when they come here illegally, that's a problem. That is a problem that we're already seeing play out across the United States. Thanks to Joe Biden and Kamala Harris. They thought they could just import a bunch of voters from other countries so they would feel obligated to vote for Democrats. This country is very lucky that it did not work. And we will soon be well rid of their corruption. I don't agree with Trump on many things but illegal immigration. If it's not legal then punish it. I'm pretty sure that the law doesn't read, please if you don't mind, we would appreciate it if you could see your way clear to not entering our country until you have received our permission. Because that's not a law, and yet that is how that law is treated.

I am admittedly as "blue" politically as the sky on a clear day. That said, I was literally stunned upon viewing all the videos this past year-or-so of what must be thousands every day getting into the US illegally.. so incredibly disappointing; as is the economy now as well as yet-some-other-war that we are about to get sucked into. Just very disappointed in our whole national politic. [and if I may say so, neither is busting into the halls of congress; but I digress and will now shut up]

It's mostly a Harris County policy to hand out PR bonds to virtually everyone except for bond violations and FTAs for misdemeanor offenses. The PR bond he gave him is consistent with other DWI cases he sees. Incoming Border Czar Tom Homan, along with the incoming President, has already expressed a change to this system. Detainers will be placed immediately. This will soon not be an issue.
