Yes, in the US, there's a law literally named after the Kinder Joy/Surprise eggs because it's considered a choking hazard. The FDA, Food and Drug Administration, in the US decided that no non-food objects could be placed inside an edible object/food. Children in the US, maybe only the US, tend to try to put everything in their mouths, so that is the major reason. Choking is a bigger problem in the US, apparently, than in other countries, for some reason.

Yes for a while the kinder eggs where illegal but then they just had to change the design to sell them in the USA again now instead of being a chocolate hollow egg with a tow inside. You you open the wrapper to reveal 2 half egg shaped plastic containers 1 with a treat 1 with a toy
