This is an information piece for the media comments that are there in social media on Sikkim Darjeeling unification: Many are saying in Sikkim Darjeeling Sikkim unification is a ploy and a political stunt - some said Darjeeling District has its own demand of Gorkhaland etc etc. I have been working on this for many years and have published numerous print and video materials. Let me put this issue this way - Gorkhaland is not Darjeeling District’s demand constitutionally. With the recent developments to deliver constitutional rights to various regions like Darjeeling District and 11 Bengal Dooars, it is likely ‘Gorkhaland Territorial Region’ will be delivered to the region of Bengal Dooars. Therefore, STOP saying Darjeeling District’s demand is Gorkhaland. Many said Sikkim had supported the Gorkhaland movement etc - it is because the people who supported Gorkhaland in Darjeeling District did not want Darjeeling District to pursue its constitutional right that is unification with Sikkim. Now, Darjeeling District is receiving its constitutional dues through the Fifth Schedule of the Constitution. Let me put this in simple words - Article 244 (1) (The Fifth Schedule) is a powerful law in the Constitution which ultimately brings constitutional amendment by way of Article 368. Therefore, Article 244 (1) will likely in near future amend Article 371 (f) and the current Sikkim will become ‘Sikkim & Darjeeling’ under Article 371 (f). The constitution experts will agree with this truth. Darjeeling District is a Requisitioned land as per various Treaties and Laws (British and independent India), therefore, in all cases Requisitioned Land should be returned to its owner one day. Historically, constitutionally Darjeeling District has been kept in British and Independent India as the land of Sikkim. Darjeeling District was ceded to the British in the year 1861 under the Treaty of Tumlong. So Darjeeling District is not a ‘gift or lease land’. It was officially ceded to British India and after that Sikkim started receiving yearly compensation of Darjeeling District from British India and Independent India till 1975. The people who are not aware of Constitutional history and the geopolitics of Darjeeling District - here is a small flow of information to help adjust with the truth. After 1861 - in 1866 Darjeeling and Kalimpong the lost territories of Sikkim became a separate administrative unit as Darjeeling District. The constitutional journey of Darjeeling District starts from here - later it became Backward Tract, Non Regulated Area, Excluded Area, Partially Excluded Area and at last Absorbed Area. The constitutional right of Darjeeling District which was there in the beginning as Backward Tract was kept intact throughout this journey till it became an Absorbed Area of Sikkim in India. In 1954 when Absorbed Areas Act was passed in the Parliament the interesting thing to note is that while in the process of declaring Darjeeling District as an Absorbed Areas - Requisitioned Land (Apportionment of Compensation) Act 1949 was brought along with Absorbed Area Act to identify this Absorbed Area is of Sikkim. It was a constitutional requirement for the Govt. of India to place these two laws together because India was paying annual compensation of Darjeeling District to Sikkim through The Requisition Land (Apportionment of Compensation) Act 1949 under Treaty terms. Therefore, my brothers and sisters of Sikkim, we are not begging for merger - we are asking for our Political right which is in the Absorbed Area. We are very much Sikkimese like you all. When 80% of the Sikkimese population was labelled foreigners by the Supreme Court in Sikkim - many had no clue what was happening, right? What happened when the 26AAA law was passed in the Parliament - you did not say anything? Do you not want to consider Darjeeling people as Sikkimese if they fall under the criteria of 26AAA? What is happening to Article 371 (f)? - a lot of questions are being raised in Sikkim that the dilution is happening progressively. Recent, Supreme Court verdict on Limbu and Tamang seat reservation in Assembly constituencies has given a clear picture that probably in the future BL and LT will become a blanket ST reservation. Hence, we need to consider a lot of things before commenting, making speeches from the dais and coming in front of the media. We do not want to snatch food from your mouth - we are only concerned with our birth right - which is constitutionally, historically, geopolitically correct. Even our Raja the last Chogyal of Sikkim had asked India to return Darjeeling District to Sikkim - what a noble approach, now the praja of Sikkim are saying they don’t want Darjeeling District. I believe you are hurting the sentiments of our late Chogyal. I would rather call this a ‘posthumous hurting’. Darjeeling Sikkim unification is at hand, we cannot tell the exact time however, it is inevitable because Sikkim Darjeeling unification is a Constitutional issue and not a political one therefore, even if people of Sikkim, political parties, intellectuals etc say no to this, it’s not gonna make any difference. It is the prerogative of the President of India and the Parliament. When they give, you have to take - no option. Just like in Kashmir, President’s law will impose and unification begins in a new way. This is to tell everyoneone what you don’t see coming. Some people were saying in the media we are 7 lakhs and they are 18 lakhs… no everyone will not come as a citizen they need to pass through the litmus test. Therefore, the number (eligibility for COI) will change. We are not coming to Sikkim empty handed - we are coming with a lot of things: 1. World famous Tea Industry (Sikkim can make money and fame like anything) 2. Siliguri corridor (Business hub for entire north Bengal, North East, Bhutan etc) 3. Plenty of Hydel projects 4. Darjeeling District will bring a massive land mass with it 5. Darjeeling Tourism (world class trek routes, Singalila, Sandakpu) 6. Human resources 7. Cinchona plantation 8. Forest reserves 9. Its rich history, heritage and world famous toy train. Sikkim can only become ‘sampanna, samriddhi’ state when Darjeeling District gets unified. We want to return to our home (Sikkim). The name of Darjeeling came from the Tibetan Words Dorje-ling i.e., Dorje means, Thunderbolt and ling means Land, that means Land of Thunderbolt. In 1835 was annexed by the East India Compnany , Prior to that , Darjeeling formed a part of Sikkim and for a brief period of Nepal.

Of India..ahju Darjeeling astho vako karan Sikkim ko political scenario weak vako la garda bhako..!!
