@TheMrMarple it was a collision case. And my advice to you is Just be prepared be confident in yourself and bring some that will motivate you because it's very important for example when I went for my court case which was an accident case, we were brought into a room to try and settle the matter rather than taking the case to court, the damage the defendant made to my car is worth more than 3000 but when we were in the room trying to resolve the case, the attorney offered me 800 instead of a reasonable amount that would fix my car half way at least. With that been said, she told me to my face that it's better I accept the 800 and leave bcs I'm not experienced and there's no how I'd win the case and also considering I'm not from American and my English isn't that good, I stand no chance. I got so intimidated that I wanted to talk away with the 800 so bad but I had my dad who motivated me and pushed to reject the 800 offered and argue it out in court and finally I gained the courage to go ahead with the case and I finally came out with all smile on my face. I sued the defendant for 5000, won 4500 and fixed my car with 3200 and few cents........just believe in yourself, take someone who will motivate you, dress nice and get all your evidence ready and you'll be good.....goodluck

Wow. One company says they will sue me unless I sign their confidentiality agreement. I don't want to sign it but then they will sue me. I am so scared. I hope I can have some courage like you did.

I have my first small claims case soon against contractors who ripped me off, then threatened and tried to intimidate me. I didn't know they had serious criminal backgrounds when I hired them. The average person doesn't have access to extensive court records online, and I was given false names, so no red flags popped up before I hired them. I have contracts, texts and pictures, including the local inspector's detailed report, to prove everything, AND the cooperation of the terrific contractor who fixed the mess and didn't overcharge me. I have a diagnosed severe anxiety disorder and hate speaking in public. The amount owed me is not enough to merit hiring a lawyer, so I have to do this myself. To anyone out there ripped off during Covid, if I can do this, you can too.

Use courtlink--it will send them a summons and I am doing it now with a car dealer.BTW a lawyer told me that if you are right--in which he would say most plaintiffs with documemts and receipts--(proof) are--90% the defendants settle before court and pay once they get summons.Just have photos and receipts,The cases that wind up in court also usually heavily favor the plaintiff unless it is a fake claim--or a claim meant to intimidate or embarass--lawyer said you go simply to get money you are legit owed and you will most likely win.

I have the similar case as you. Mine is the sunroom not build properly, water and insects all came in. CSLB n insurance bond looks like protecting their own contractor customers. I'm wondering how long time did you take the entire small claim process? How was your case finally? Thanks

I live in Tennessee, and just realized how lucky I am to be able to sue up to $25,000. My home contractors ruined my house and I am taking them to small claims to (hopefully) get $24,999. I go in two days. Wish me luck!

I will be addressing willful negligence and the unauthorized use of used damaged components in repairing the braking system on my vehicle with the business owner who didn't directly oversee the repair. This was very helpful information, but I hope I won't need it!

I am in LA and it deals with a mediation. In my opinion I feel the party breached the mediation and confidentiality. It was signed per myself and another individual. The corporation is claiming I breached it and fined me for it home owners association. The fine I believe is not valid no due process, but the issue I have is why are they not using the court system or remediation? It really feels like attempted extortion with the fine?

What kinda Attorney takes cases against UPS. Or do I take them to small claims court in Contra Costa County, Ca. 3 years ago a UPS driver started retaliating against me for reporting him for false delivery attempts. He now falsify tracking logistics changing it to I requested my packages be held for pick up at UPS. Packages are returned to the seller after a week of sitting at UPS. I have a paper trail of emails to Customer service. They haven't did anything to fix my problem. It's more but too much to write.

I went to small claims court and the judge told me I will receive a decision in the mail as oppose to telling me and the other party what his verdict was. Usually small claims judges will tell you what the decision after the close of the case. This is what happens on t.v.

A roomie stole a 2.5k road bike from me and sold it behind my back. When I found out the hassle and cost to file a claim against someone who I knew would not be able to pay me back, because he was a drug addict at the time, hooked on heroin, I said to myself, small claims court blows! I should've insured the bicycle could've just got my refund but most don't insure things like bikes.

I have a question, I want to file against my phone carrier, and insurance coverage. but its with customer service and the insurance company. I've experienced a financial loss and unsolvable disagreement with the USPS. I filed a claim at the county magistrate's office. I quickly received a letter from the USPS telling me that they "Enjoy Sovereign Immunity " and cannot litigate them at the state level. Google research seems to confirm the same thing. About a month later I received a letter from the court advising both parties to meet next month. I'm so intimidated, and it may be true that this court judge has no jurisdiction over the USPS after all. It feels like David against Goliath. I think I have enough written proof to show culpability and that I'm right, but I also understand how the world works.... sometimes things just aren't fair. I'm hoping at least for some mediation.

He lost the case probly cuz everyone loses damage claims against USPS. That is their *specific immunity type* is *small claims and damages incurred to mail* that was entrusted to them.

@@farcyde2948 My case is still on the docket for Monday. Their lawyer started calling and leaving emails as of yesterday. They tried to convince me to drop the case and promised to look into my claim again. I told them they waited too long, we're not canceling anything, if if the magistrate judge can't settle our disagreement then we'd do at the federal level.

@@farcyde2948 Turns out that your right. At the last minute their lawyer contacted the magistrate judge to have the case dismissed over jurisdiction. I'm still showing up though. And I'll ask then how to I take it to the correct (federal level?). Hopefully it won't cost that much and I can represent myself. It's really not that much that I lost, but the principle of the matter eats me up.

Is it possible to win some but not all of the financial damages you are seeking in small claims court? For example: I'm seeking $3600. $1000 of that will be easy to prove liability & damages. The rest of the $3600, won't be so easy. Might a judge award me the $1000, but not the full $3600? Does going after the full $3600 hurt my chances of an overall successful outcome?

Check your state's statue of timeframe to file suit, some states are up to 4 years. Call the justice of the peace in the county where you rented, they can walk you through their website to file a small claims case, or you can go in person and they will had you the forms to file

What happen is the Judge is Racist? And you (black or hispanic) are in small claim court vs a white Plaintiff and right away you notice that the Judge put all the attention to the white Plaintiff and when is the Black or Hispanic turn to talk he ignored you no matter how you want to explain the situation you know are ignored and of course at the end you lose, what happen in cases like this one when the Black or Hispanic defendant show up without a Lawyer and you felt the Judge sympathy for the white Plaintiff? What can we do in cases like this???
