Interesting thing about abused women, they've been taught to believe they NEED the abuser. And, yes, that often means they will end up going back to that abuser. It seems crazy if you've never been involved in that type of relationship or at least been close to someone who has. But it's real and it happens all the time.

I liked how the judge seemed like she was leaning towards his side of the case then just dropped the hammer or in this case gavel on him and blindsided him like not straight to jail do not collect $200.

Judge was handing him a thoroughly basic rundown of how protective orders work, in that they don't suddenly get voided because you live in the same house. His smug nature comes from his treating this like it's a game he already won. He probably has less than a college education and thinks he's the smartest person in the room.

You can bet he got jail time most likely a couple of years. She was telling him not to call her from the jail. The person served is the person responsible not the person being protected. This is because if you meet in a store or he is stalking the served person can't say it is an accident they met at say a store or event. Also, it is not the protected that leaves, but the served. The one served always has the responsibility of honoring the order. He should have said here are the keys and gone to a hotel or handed her hotel money. That simple.

The judge isn't disregarding the victim. The victim's testimony as to what happened and her feelings about the actual sentence are supposed to be presented to the judge at different times.

Yes because such statements are not included as evidence. A witness's potential future feelings is not evidence. That's why it was not allowed. It was a terrible and lazy question by a terrible, weak and lazy DA.

A protective order and a restraining order are just paper. If the person that filed the restraining or protective order breaks it then the order should be invalid or they should be held accountable for breaking it.

So the reason they can’t let her say how it would affect her toward the beginning of the video is because its essentially feelings not facts of the case. The impact statement, which happens after the verdict, is when the victims get to speak about how they were affected, and the judge takes that into consideration when deciding the sentence or punishment for their crime. I’m probably not explaining it well enough. Essentially it’s a strictly maintained practiced in the law in order to protect the premise of a fair trial, to be led by facts about the case and not the feelings about it. This has been a drunken explanation of law stuff.

8:50 the no contact order is to prevent the defendant from contacting them or they get tossed in jail, if the victim contacts the defendant it nullifies the order, says so right above where they make you sign it, no contact goes both ways, while the victim will not get jail time they will lose the right to no contact order, here its called a protection order in other places a restraining order, but they all work the same... you list 5 locations you go to that are not the victims house or family and the defendant go within so many feet of those locations nor have 1st or 2nd parties contact... had he called the state when she came to him and told them she broke the court order he wouldnt have had an issue, it would have voided it, buuut he said nothing and drama popped off and now he got what he got. shoulda put up the cross "back foul demon from HEEELLL!" and called the cops. his mistake...

I think this is the sentencing so the guilty is already announced. The thug lawyer is objecting because she wants the sentencing, then have the victim statement, but she is getting the victim statement prior to sentencing. I don't know what the agreement was between her and the state lawyer, but it sounds like the State lawyer is presenting the victim statement prior and will affect the emotion of the Judge Boyd to go harder on the sentence.

There are different types of "no contact orders" (NCO) and they also vary by state/county and certainly vary by specifics of the case. If it was stated that he was to have "no contact" with his ex-wife then even if he's at a gas station and she pulls up, he has to leave without saying anything. Seems unfair, until you read and understand the specific NCO. The video doesn't tell us specifics. It may have been tied to the allegations, or it may have been about some other thing. Anecdotal - When I got divorced, (after a 20yr marriage) there was a NOC by default. Not that it was requested by either of us as we were actually being amicable about the breakup. It was set up by the court to avoid any 'potential' issues that may arise at a later date. We didn't break that order, and we are still friends. His case is much different obviously. 10yrs of marriage with kids but with violence and a different type of NOC for different reasons.

Excellent sentencing. Dude clearly intended to break the NCO the moment he goes on parole. I also have no sympathy for those that are violent against women, nor those that drink. A man can choose to be sober and gentlemanly, or uncouth and savage, but ultimately it is the man's choice and he should be held accountable for those choices.
