This is also a huge problem with college courses. I personally want to keep my digital textbooks accessible even after the class is done (I still have some from 10+ years) but the courses bought through Pearson and other sites "expire" so you're left with nothing. Whole $120 digital textbooks gone. That's why I save as many powerpoints and recorded lectures as I can for reference. Even some professors tell us to email them to ask for the powerpoints because they know it just disappears. If I'm paying $120 for a digital textbook, and tution on top of that, I should be entitled to own the digital book for as long as I want.

Honestly, if you paid for the game, software, etc. and no longer have access to it then you should have the right to obtain another copy of it through other means. I even think you should be allowed to pirate it if there's no option to buy it, since it's not like it'd hurt their sales anyway.

At this point they're basically saying it's a glorified rental for an unspecified length of time. At this point I feel like I'm listening to Darth Vader: "I Am Altering the Deal, Pray I Don't Alter It Any Further." I've decided that I will buy physical media or actual print books. Don't get me started on Kindle (or other eBooks) being edited or removed without your knowledge or consent.

Remember the good old days when you could go to a store, buy a game, put the cartridge/disc in your system and immediately PLAY the video game you spent full price for? No copying files, updates, internet required AT ALL and no worries that the servers will be shut down or you might lose access to your account?

to be fair and taking those rose-tinted nostalgia glasses for a bit, games' overall quality have improved (there are still a decent amount of bad ones out there.) I would prefer the best of both time periods though.

@@podled942 My biggest problem with games nowadays is that a lot of them are basically unplayable unless you download a big update patch, making the disc pretty much useless on its own. It encourages game devs to release crappy versions of the game and think “oh we’ll just fix it later over the course of a few months or years, or not even bother” Tony hawk pro skater 5 will always be at the back of my mind, its a SINGLE PLAYER game and for whatever reason has to be connected to an online server which got shut down just a couple years after it came out, so the only way to play it is by using the disc, and making sure the internet on your system is turned off and its on version 1.0. If you forget and turn the internet back on, it’ll try connecting to a server that doesn’t exist and keep crashing, the only solution is to uninstall and restart the game from the beginning. They could’ve easily updated the game and make it offline only and fix a bunch of bugs, but they were too lazy and totally abandoned the game. Also since we already have digital only versions of consoles, I have a feeling in about 10 years or so we won’t even have physical copies of games anymore, everything will become digital only. And at that point you will own NOTHING, all of your games will exist on a server somewhere that will eventually get shut down forever

@@dr.feelgoodmalusphillips2475 I mean its proven or at least backed up by the fact that so many companies do remasters of 10+ year old games and they sell, yet there newer stuff basically is a failure that falls on its face. a lot of AAA devs were crying about palworlds success, as their games sell like crap, yet palworld sold 13+ million copies on steam within the first 8 days. It goes to show that if you make a good game it'll sell like crazy, but all these AAA devs only seem to care about making it pretty thats it. A pretty game that is crap is still crap its just crap with glitter on it, sadly modern "gamers" fall for this hook line and sinker and thats why they keep pushing out these garbage games that just look pretty.

This is a criminally underrated comment. I've tried explaining this to kids in my family who are 16 and younger, and they look so mind blown when I describe how easy it was to use and/or fix a PlayStation 1 or an old Nintendo. Old games still have massive appeal from old and young alike, but like the fellow above me said, all of these new games from the AAA game developers are disappointment after disappointment, if you can even get them to work in the first place.

11:00 I want to say that it is actually possible to take companies to court and win even with agreeing to a TOS agreement to terminate your right to arbitrate. This is what happened with a class action lawsuit with Roblox that occurred in the US. A young girl spent money on robux to buy certain avatar items, that roblox allowed to be uploaded and sold by other users, only to later then take those items down without issuing any sort of compensation or refund. Roblox tried to rely on their TOS where the user agrees to everything and the judge went "nope, it's a 9 year old girl, she wouldn't have understood your terms of service, therefore the agreement doesn't apply" leading to Roblox's legal team shitting themselves and trying to settle desperately. So I'd assume in this case that a similar class action could also be filed against Funimation/Crunchyroll if they do not give these users the copies that they paid for, especially after having claimed it's a copy to be kept forever on one of their FAQ pages.

​@@charliec.3518 In a civilized country unlike USA, if a tos is against the law it is invalid, so you can ask a full refund in court if when they start to remove things that you bought. The problem is that no one is willing to go to court for a $10 purchase.

@@charliec.3518 The part that I was getting at here was that with funimation being as notable in that space as it was, do you seriously want to bet that there was no minor that bought content? My bet is there being at the very least a few minors that bought content from them. In Roblox's case it literally took just that 9 year old and the judge determining that she could not have understood that it legally twisted the company's arm to the point where they had to reach out and offer compensation to every single affected user individually that used their service irrespective of whether they were actually included in the class action, of their age, etc. So what I'm getting at is if somebody based in the US for example who is a minor brought a class action suit, it could very well be equally as fruitful potentially even for people not included in the suit. I think it's an interesting thought, I can't determine the likeliness that it will be a reality but if it were to be the reality even a small bit of compensation is ultimately much better than the current reality of no compensation and losing what you paid for.

Piracy is preservation in most cases. There are games on the wii, 3ds, wii u, etc, eshops that you legally cannot obtain anymore. If not for piracy they would be dead media. If buying isnt owning, piracy isnt stealing

If we didn't do that we wouldn't have Joel's Bonzi Buddy Windows Destruction, etc etc. a lot of my favorite media is extremely niche shit that most ppl don't like or actively question my taste for, if not for emulation a lot of it would be lost to time/cartridge decay/scalping inaccessibility. It's not just about what you value as "having worth" it's about the principle. (That and with backwards compatibility being less and less of a thing unless ppl actively are porting games to next gen then it will die. There is no if, there is only When.)

For real, i personally have believed digital should be complementary to physical media, but when it's getting to the point where even physical media is basically just a "key" to play the game and there's no real game data on the physical media, what's the point of having it?

OP is right about was why it was developed while you are right about why it was adopted commercially - the commercially-minded rarely have the creativity to be the inventor of what they sell.

Well, not quite. If you pay to merely get access to content, then accessing that content without paying for it through piracy is still illegal and technically wrong. I agree with the morals, but it doesn’t work out legally.

Agree I did a lot of piracy back then when I was a teen enjoying all wonders of gaming, movies, songs, books 📚 you name it. There are some laws that could prevent this. Precedent exists where if you give someone a ‘lifetime subscription/membership’ if that company gets bought out, they have to honour the former company’s agreement. Also TOS doesn’t mean shit when it comes to customer protection lawsuits. It’s like how even if you sign a waiver for a dangerous activity like skydiving, the service provider can still be sued for negligence. If any agreement in the US is too one sided or unclear, a court can easily void it. If they sell you a copy and you pay money, get a receipt and they literally say you own it forever, no amount of TOS can take that away. The only thing we can hope for is that someone files a class action lawsuit and doesn’t settle so a real precedent to prevent this is made.

Honestly you're right. If I could digitally purchase something and have direct, offline access to it then that's fine. I think most people would definitely agree with you. I was gonna say, we need a way to use the analog hole but still keep that hi-def. Still only works for noninteractive stuff, but better than nothing. And if you use it for digital copies you paid for, I wouldn't even consider it pirating, just modifying what you own to suit your needs.

stuff like this is why I always buy physical media! Also it allows you to share with a friend, or even resell it if you decide you don't want it anymore. Also as a physical object there's history to it and it can be archived, you can also create a digital copy if folks know how to rip it correctly so it won't disappear forever and it can be preserved in a way that isn't contingent on a company allowing you access to it. These companies can just disappear or change your access like Crunchyroll is doing and not be held accountable. digital "ownership" is such a scam. It's depressing

Even on that front, there is a lot of CR licensed titles available for streaming that are *not* on physical media, mainly because that isn't their central focus. Aaand it gets worse as I wrote in a previous comment: Crunchy also bought out the largest physical media outlets online, RightStuf aka Nozomi Entertainment. The way things are going, mainly the aforementioned focus on streaming, they could totally shut that down as well.

The thing is though, this isn't a physical vs digital issue, just like it never was for other entertainment mediums. An MKV file can be copied and played on pretty much any device. You won't even have to go through the hassle to do so either, unlike a bluray which can only be played in a bluray player, and needs to be ripped with software if you want to play the files on other devices. @daniellundberg2875 is right that piracy is still the better option. It's more reliable than both physical and streaming, and far more flexible. If the industry wants to fix the issue, the first step would be to properly ensure that content is properly available across all regions without BS like removing content people paid for. Unfortunately, it can't be trusted to not actively steal from consumers, so consumers should not feel sorry for the industry when people pirate. Physical media isn't the end all be all solution either. Many shows do not have proper physical releases and often only available from other countries. In general, physical loses out to even streaming in the anime industry due to the sheer amount of content available on streaming services that would cost an astronomical amount to buy if bought physically. Each quarter of the year brings several dozens of shows, and imagine you wanted to check out each one. Streaming services and piracy would allow you to watch each of them to get a feel for the quality of the show, whereas buying physical would get expensive quick and likely cost more than a CR sub. So basically, if a service has a problem, people will look for alternatives that are at least as good for them if not better. Physical doesn't meet that standard because the one thing it has over a streaming service is also an attribute shared by piracy, while everything else about it is the same or worse than the streaming service.

Anime and manga piracy is the sole reason they are so popular outside of japan. It has certainly benefited the industry a lot more than these official middlemen. Piracy is the reason poorer countries can become fans of franchises such as mario, zelda, pokemon, one piece, naruto, etc, and eventually buy official merch. Even if it is just a simple shirt.

sounds like a case of destruction of private personal property entrusted to them and not wholly owned by them. as i remember the og purchase agreement and it definitely didn't say it was a access code. they were literally selling you three things at the point of sale, a disc, a digital copy, and a permanent space on the funimation servers. it wasn't ever an access code. the tos doesn't protect them from repercussions of criminal activity or in places where segments aren't legally binding

Piracy is almost always a service problem. We're at a point where you no longer "own" the things you purchase and are actively taking it away, then I fully support people who pirate said goods. We live during a crucial point in time that if things don't change, we will own nothing as individuals and corporations will continue their quest to somehow try to squeeze even more money out of you to achieve endless growth and profits.

You're right. While some people do pirate just because they're cheap (I disagree with those pirates), it's always a service problem for a lot of us. I have no problems pirating a game from EA or Ubisoft, but will never pirate pro-consumer indie/smaller developers. A good example is Baulders Gate 3. I don't really want to buy it now, but would always refuse to pirate it due to all the good they've done for the gaming community.

Downloading copyrighted media is a civil matter between you and the person who thinks you have infringed on their copyright. Never forget what happened when Funimation/Sony shut down AnimeLab in Australia and forced us to use their inferior app. Now this is essentially karma coming back around. Still sucks that Crunchyroll will now be the only player in town but still. Also, I still have my copy of Spec Ops: The Line that's sitting on my shelf with pride. I'm studying in a Uni in an engineering program where your are obligated to buy a specific graphic calculator, TI nspire CX II by Texas Instruments. Not to long ago, like 2 years or less, you had the choice to buy just the calculator or pay slightly more money to get the complementary software for the pc with a permanent license. GUESS WHAT? Not so long ago they removed the permanent license for everyone who bought the software. This is like when a company offers a “lifetime warranty” but that’s not your lifetime, it’s the company’s. So if Funimation says you bought a digital copy and own it for life, they really mean the life of their digital content servers and that’s the line they’re gonna go with, dollars to donuts. As someone outside USA I bought a DVD of movie not available in my country which boasted on the cover that it came with digital online copy, great I think so I can view on laptops etc but NO when I try to use it I get a message saying it’s not available in my country so yeah it sucks but that has long been the case here is Australia as I can’t even buy the movie (venture bros) in any format here so had to buy special dvd player just to be able to see shows and movies cos the company can’t even be bothered to release is Australia, I also don’t pirate but shit like this makes me feel companies deserve to lose money from those who do pirate

would love for you to make a video discussing the current malware being hidden in sims 4 mods (maybe even testing it out to show us how bad it is, like its allegedly capable of stealing bank account information) cos its a very sudden and very dangerous thing and if people dont have discord they have no idea its happening

Honestly, they need to pass a law that if you lose access to a digital purchase, that vendor and/or its successors owe you your purchase, adjusted for inflation and 10% interest per annum. Watch those attitudes change real fast.
