Loan and debt should be considered as work and exchange for the equal amount work. For exam[ple. Person "A" banked his work done in form of money. "B" receives a loan from "A". This means "B" received the work done by "A" in the form of money. Now "A" has to do the equal amount of effort somewhere in the form of money in order to repay his loan to "A". sood / interest is just demanding an extra work in the form money. I love this scholar because of his integrity

Ghamdi sb says the same thing that Maulana Ishaq is saying that sood applies only in items which are consumed not inconsumable products. Therefore, he rightly points out that mortgage is not sood.

Pls see hadith from Sahih Bukhari. Ghamdi is a munkare hadith. It can't be clearer than this. See below. Narrated Abu Juhaifa: The Prophet (ﷺ) cursed the lady who practices tattooing and the one who gets herself tattooed, and one who eats (takes) Riba' (usury) and the one who gives it. And he prohibited taking the price of a dog, and the money earned by prostitution, and cursed the makers of pictures. Sahih al-Bukhari 5347 Book 68, Hadith 92 Vol. 7, Book 63, Hadith 259

THE controversy about the permissibility or prohibition of bank interest started in the colonial times, in the 19-century onwards, when banking institutions came to the Islamic world. The controversy first raged in Egypt. It is said that the Grand Mufti of Egypt, Muhammad Abduh, had permitted interest on postal savings though the fatwa issued by him is not available now. Today, many still ask if bank interest is prohibited in Islam. Most of the jurists maintain that it is not permissible, and Muslims should not accept interest on their bank deposits. In the latter part of the 20-century many Muslim intellectuals came out with the concept of Islamic banking based on mudaraba and profit-sharing. A number of Islamic banks were started in Muslim and non-Muslim countries with a large Muslim population. Still the question continues to be asked if banking interest is permissible, and there is no unanimity of opinion on this question. Yet, there are many Islamic scholars who feel that banking interest is not prohibited by Islam. Many modern commentators of the Quran also translate riba as usury and not as simple banking interest. From Pakistan Prof Fazlur Rehman, who had migrated to the US and taught at Chicago University for a number of years, wrote a very well-argued paper on the permissibility or otherwise of banking interest. He came to the conclusion that banking interest is not prohibited. Even those who do not agree with this view must read his article. It is very scholarly and based on original sources. What is riba then? The Quran strongly condemns the institution of riba. It says, “Those who swallow usury (riba) cannot arise except as one whom the devil prostrates by (his) touch. That is because, they say, trading is only like usury. And Allah has allowed trading and forbidden usury. To whomsoever then the admonition has come from his Lord, and he desists, he shall have what has already passed. And his affair is in the hands of Allah. And whoever returns (to it) - those are the companions of Fire there they will abide.” (2275) The Quran also goes on to say, “But if you do (it) not, (i.e. continue to take riba), then be apprised of war from Allah and His Messenger; and if you repent, then you shall have your capital. Wrong not and you shall not be wronged.” (2279) Thus we see that if one continues to take riba, the Quran not only warns against it but even permits war against the usurer. Is bank interest so severe in consequences as to be warned of a war by God? Banking interest is taken and given by hundreds of thousands of Muslims all over the world, including in Islamic countries. Should Islamic states declare war against banks? No country ever does it. Let alone war, they are not given any punishment. Then what is riba? Its root meaning in Arabic is 'growth' and here obviously it is unjust growth. One should not fatten oneself at the cost of others, which leads to gross injustice in society. Our justice system overlooks the stock exchange operations, which is based on pure speculation. One either becomes a millionaire overnight or is ruined completely if share prices crash. Islam permits only just growth which one earns in a permissible way through one's hard work, physically, intellectually, or both. Speculation is strictly prohibited. For example, it is not permissible to buy a standing crop in the field as one does not know how much it would be maturing and how much will be destroyed. To buy cheap a standing crop amounts to speculation and exploitation of the peasant. Yet, many middlemen thrive on such speculations. Our justice system hardly ever condemns such practices. Many people become rich overnight by speculation using such practices. On the contrary, our jurists allow the share trade without any restrictions. There were no banks during the time Islam appeared on the scene. People used to borrow money from private moneylenders and return double or more than the actual amount. Thus we see riba was the doubling of double (3129), which ruined the poor borrowers who often borrowed either for personal needs or small trade. This is certainly condemnable and all governments should take action against such practices. Banking interest is far from ruinous and its rate is fixed by market operations to increase or decrease liquidity in case of inflation or deflation. A bank cannot be conceived as an exploiting institution. On the other hand, it is a regulatory institution facilitating financial operations between borrowers and lenders. Some jurists argue that interest is not permissible as there is no element of risk in it and its rate is fixed. There is no such argument in the Quran itself. If this argument is valid then even investing in a building and giving premises on rent will also not be permissible as rent is fixed and there is no risk involved. The Quran denounces riba as an exploitative practice leading to unjust growth, not because there is no element of risk in it. In view of the above arguments it can be argued that banking interest cannot be treated as riba and should be held permissible. The writer is an Islamic scholar who heads the Centre for Study of Society and Secularism, Mumbai.

+AAHorwath Moulana Already Clarified This Issue, Listen Carefully From 10:10 to 10:45 , in Which Prophet(SAW) advised the one who sold his garden to someone but even after agreement suddenly some natural disaster destroyed the garden Prophet Advised the previous Owner to share this loss because ex owner took his profits and earned full amount but the new owner got loss so this is the real islam, Nabi(SAW) advised him to help his brother i mean new owner. now you see if even after sale agreement prophet(SAW) emphasized to share the loss then why not it can be in rental only ? wheares the property had been sold but there the property is still ownered so it is the same, i hope you got the point

Assalamualaikum wa Rehmatullah! Some shopkeepers are selling a Khaad (Compost) on loan and claiming that it’s not Riba. Let me explain further, let’s say the price of Khaad is Rs2500 if you buy now but if you pay after 4 months it would be 3000.. So here they claim that according to fatawa rizwiya it’s not Riba. They have been following some chishti peers for long who told them all this.. kindly shed some light on this matter Jazakallah

maulana saheb what is problem with islam if a middle class man could not buy a big thing like house, car, motorcycle in one stroke. but if any one come out to help that middle order man to buy a house, car or motorcyle and ask him to return the total amount in instalments with some extra amount because he had spent a huge amount with one stroke. slowly and slowly the middle class person can return the money with profit and one day he can be owner of a house, car or motorcycle. what is the problem with you people in such case

sorry mr moddy jee if you hurt. actually there are two kind of people. one have the property for morgage the second is poor who has noting to get loan. so first type person could get loan after morgage but for second kind of person the government should come to give him loan as qarza hasna to return back without any extra amount. But how the government could extend loan to ittefaq foundary, jehangir tareen, or any other industrialists to return back the same amount of loan without any extra charges.

اللہ مجھے معاف فرمائیں اور میرے علم میں اضافہ فرمائیں ۔ میری رائے میں کرایہ بھی سود کی ہی ایک شکل ہے ۔ صحیح بخاری:جلد اول:حدیث نمبر 2142 حدیث مرفوع مکررات 90 متفق علیہ 45 بدون مکرر موسی بن اسماعیل، جویریہ بن اسماء، نافع، عبداللہ بن عمر سے روایت ہے کہ نبی صلی اللہ علیہ وآلہ وسلم نے خیبر یہودیوں کو اس شرط پر دیا کہ وہ اس میں محنت اور کاشتکاری کریں اور اس کی پیداوار میں ان کا آدھا حصہ ہوگا اور ابن عمر نے نافع سے بیان کی کہ زمینیں کچھ رقم کے عوض جس کا انہوں نے تذکرہ کیا لیکن مجھے یاد نہیں رہا کرایہ پر دیجاتی تھیں اور رافع بن جدیج نے حدیث بیان کی کہ نبی صلی اللہ علیہ وآلہ وسلم نے کھیتوں کو کرایہ پر دینے سے منع فرمایا اور عیبد اللہ نے بواسطہ نافع ابن عمر اتنا زیادہ بیان کیا یہاں تک کہ ان یہودیوں کو حضرت عمر نے جلا وطن کر دیا۔ صحیح بخاری:جلد اول:حدیث نمبر 2182 حدیث مرفوع مکررات 90 متفق علیہ 45 صدقہ بن فضل، ابن عیینہ، یحیی، حنظلہ زرقی، رافع سے روایت کرتے ہیں کہ اہل مدینہ میں ہمارے یہاں کاشت بہت ہوتی تھی اور ہم سے ایک شخص اپنی زمین کرایہ پر دیتا تھا اور کہتا تھا کہ یہ ٹکڑا میرا ہے اور یہ تیرا ہے۔چنانچہ اس زمین میں کبھی پیدا ہوتا اور دوسری زمین میں پیدا نہ ہوتا، اس لئے نبی صلی اللہ علیہ وآلہ وسلم نے ان کو منع فرمایا۔ صحیح مسلم:جلد دوم:حدیث نمبر 1463 حدیث مرفوع مکررات 14 متفق علیہ 7 یحیی بن یحیی، حماد بن زید، عمرو، مجاہد، طاؤس، رافع بن خدیج، حضرت عمرو سے روایت ہے کہ مجاہد نے طاؤس سے کہا کہ ہمیں رافع بن خد یج کے لڑکے کے پاس لے چلو اور ان سے حدیث سنو جو وہ اپنے باپ کے واسطے نبی صلی اللہ علیہ وآلہ وسلم سے روایت کرتے ہیں طاؤس سے روایت کرتے ہیں طاؤس نے مجاہد کو جھڑکا اور کہا اللہ کی قسم! اگر میں جانتا ہوتا کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے اس سے منع کیا ہے تو میں نہ کرتا لیکن مجھے حدیث بیان کی اس نے جو صحابہ رضی اللہ تعالیٰ عنہ میں سے زیادہ جاننے والے ہیں یعنی ابن عباس رضی اللہ تعالیٰ عنہ نے کہ رسول اللہ صلی اللہ علیہ وآلہ وسلم نے فرمایا کہ اگر کوئی آدمی اپنے بھائی کو اپنی زمین ہبہ کر دے تو یہ اس سے معین کرایہ و خراج وصول کرنے سے بہتر ہے

اوزاعی نے ہمیں ربیعہ بن ابی عبدالرحمٰن سے حدیث بیان کی ، کہا : مجھے حنظلہ بن قیس انصاری نے حدیث سنائی ، انہوں نے کہا : میں نے حضرت رافع بن خدیج رضی اللہ عنہ سے سونے اور چاندی ( دینار اور درہم ) کے عوض زمین کو بٹائی پر دینے کے بارے میں سوال کیا تو انہوں نے کہا : اس میں کوئی حرج نہیں ۔ ( امر واقع یہ ہے کہ ) رسول اللہ صلی اللہ علیہ وسلم کے عہد میں لوگ نہروں کی زمین ، چھوٹے نالوں کے کناروں کی زمین اور ( متعین مقدار میں ) فصل کی کچھ اشیاء کے عوض زمین اجرت پر دیتے تھے ۔ کبھی یہ ( حصہ ) تباہ ہو جاتا اور وہ محفوظ رہتا اور کبھی یہ محفوظ رہتا اور وہ تباہ ہو جاتا ، لوگوں میں بٹائی ( کرائے پر دینے ) کی صرف یہی صورت تھی ، اسی لیے اس سے منع کیا گیا ، البتہ معلوم اور محفوظ چیز جس کی ادایگی کی ضمانت دی جا سکتی ہو تو اس میں کوئی حرج نہیں Sahih Muslim 3952
