China always takes advantage of gray-zone areas and loopholes they can find when it comes to the international community. Why is a warship being allowed to act as a "coast guard" ship, it's a strange oversight in UNCLOS. Imagine using a Tank to police a district but painted white with sirens and just spray a text on it, "POLICE", lol that would be outrageous domestically but that's what's going on here in SCS.

UNCLOS is not retroactive, meaning it only applies to maritime activities and claims made after it entered into force on November 16, 1994, and does not affect pre-existing situations or disputes that occurred before that date.

It is not retroactive but it has its agreed upon conventions that historical basis won’t be the basis for a country’s jurisdiction nor eez. When China signed the UNCLOS it agreed and defined its maritime waters only includes Hainan and its eez and does not include the 9 dash line.

If she wants, like developing nations of the global south, to protest the passage of unidentified foreign naval ships in her own EEZ, then she should observe those same rules regarding the Philippines’s EEZ. Scarborough Shoal is far from the alleged path of the coast guard ship which approached to within 77 nm or 143km off the coast of Luzon. Scarborough Shoal is located 220km off the coast of Luzon. If the ship stayed within 12nm/ 22 km of Scarborough Shoal, that would be understandable. Alternatively, China needs to decide if she adopts the position of blue navy power states like the US that assert and will have to accept the freedom of navigation of foreign naval ships through their own EEZs.

@@Qingqiu9 but that is the problem with this latest reported incursion into their EEZ, China is seemingly adopting the similar interpretation of freedom of navigation rights for foreign naval ships as the US does against China. The one distinction China can argue is that her ships are not naval ships but coastguard ships with no VLS or missiles. They are still armed though. I guess that might be how China is going to distinguish between American & NATO naval ships in the Taiwan Strait and Spratlys vs her coastguard ships within Philippines EEZ far away from any claimed maritime features.
