never seen it really work, especially in more serious cases. usually at best it delays their case and sometimes wears the courts down enuff to give em a good deal but their deals are typically in line with what most non sov cit traffic violators get…no insurance dismissed if they prove they get insurance, same with registration or driving without a license…

I know several success stories because I've had two charges "dismissed" shortly after raising the issue (jurisdiction). I don't know specifically why two charges have been dismissed. All I know for sure is they dont even want to say WHY. So it will remain a mystery and a well guarded secret. Maybe they just felt like being lenient that day? I'm sure it's because they wanted to be NICE. ☺️ 🤫 ..... DON'T TELL ANYBODY. If you do, more peeps might start doing it. 🤯

@@brokensystembrokentrust I saw no anger, and the title doesn't imply any anger (he argued with the wrong judge because the judge was willing to hold him in contempt; not because the judge has anger issues). The judge also didn't display any anger; his voice was completely calm and level. Finally, his decision was completely logical and legal. There isn't the slightest evidence that the judge made his decision out of anger. The only person who thinks the judge was acting out of anger is you.

In my area regional jails have become the norm and the days where the jail and courtroom are within walking distance are a thing of the post. Getting transportation back and forth probably makes those overnight stays less handy since you have to temporarily hold prisoners at the court house and feed them until court.

Marijuana is still a federal crime even in those states, which is why marijuana businesses can't use banks and have many other restrictions. The feds don't necessarily have jurisdiction if the crime didn't cross state lines. But, say, if you are in a national park and a park ranger sees you smoking pot, you could very well go to jail.

Best "explanation"? Really? The strangest thing about this "explanation" is that it doesnt match the "explanation" another "judge" gave from a different court in the same state. I would think there would be only ONE consistent "explanation"? Why didnt the two judges have the same explanation? Ya know where they dont have to explain jurisdiction? Any legitimate court. Any legitimate court will have the issue of jurisdiction CLEARLY and UNAMBIGUOUSLY spelled out (example; military courts and federal courts). Why is that?

I would have handled the first part like this: “Do you understand the maximum potential penalties for the charges you are facing today? This is only a YES or NO question. Any other response from you will be considered as demonstrating that you are not in fact competent to serve as your own council”.

What more judges need to say explicitly is, "Sir, you've cited that once jurisdiction is challenged, it must be proven before anything can continue. Your mistake is that you think that means it must be proven *to you.* That's wrong. It needs to be proven to me. When *I* rule that this court has jurisdiction over you, the matter is decided and it doesn't matter whether you agree or not. The question has been addressed, and you can't use that argument anymore." Then, you can go into the "If you don't drop it and answer my question, you're going to be held in contempt of court." But you'll have laid the foundations of why. Even though they still don't believe you, I've seen a few of them who actually dropped the jurisdiction question and moved on to other stuff when they were faced with that... because they did manage to grasp that they weren't going to be able to delay that way any more.

@@fungidungie No, jurisdiction isn't a joke. But the sovereign citizens totally misunderstand what the law actually says about *how* it must be proven, and *to whom* it must be proven. It doesn't have to be proven to them. It only has to be proven to the judge, and only according to the rules of evidence which the judge knows very, very well. That makes it really easy for any prosecutor to prove jurisdiction to the judge so quickly the defendant often doesn't even realize that's what is happening, because they don't understand the rules of procedure well enough to recognize what those words they were just saying back and forth for five seconds meant. Meanwhile, however, those five seconds disposed 100% of their entire jurisdiction argument, and did so entirely lawfully. They keep harping on the subject because they don't understand that they've already lost it. This is not "assuming jurisdiction," it is *ruling on* jurisdiction -- which is entirely within the legal right and duty of the judge to do.

If you abuse the system, disrespect the judge and the court, and are not mentally competent to represent yourself (he didn't even know which court he was in) he should be appointed an Attorney and suffer the 'negative consequence' (in his mind) of not being allowed to represent himself. Why do you think there is the safeguard of the Judge being allowed to take that from him?

These sov cits totally baffle me. They all try to say they did not agree to give jurisdiction to whatever court or jail they are in. How do they not understand that it may suck, but whatever county you are in automatically has total jurisdiction over you whether you agree or not. If we had to give them jurisdiction for them to hold us accountable then no one would EVER give up jurisdiction. No matter where you are on the planet. Unless you are on land that you personally own then you are automatically under the jurisdiction of the governing body of that land.

I worked in a courtroom for a few years and during the time things merged into zoom and all...this happened a few times and BOY did the judges go off on them or at least have a word with them later. Very ugly and awkward, lol.

Perfectly done! Had I been the Judge, I would have asked him repeatedly, giving him a contempt citation each time until he acquired a weeks worth of time, and then sent him to jail. A week should be long enough for even the most densely committed SovCit to realize the error in their thinking.

What these numbnuts never get is that when they challenge jurisdiction, THEY have to prove the court somehow doesn't have it. The court does not have to prove jurisdiction, the challenger has to prove the court lacks it. You just can't say "I challenge jurisdiction" and then expect to have your case dismissed.

It doesn't prove jurisdiction of the matter at hand. I understand what you mean, but you can be held in contempt even if the court wouldn't otherwise have jurisdiction of the matter you are in court over.

@@Vykk_Draygo It's not the court that has the burden of proof. The court's jurisdiction is written in the state constitution and the relevant statutes. The party challenging jurisdiction has to prove, with an argument based in law, that the court has no jurisdiction in the matter. The most common procedure is to file a motion challenging jurisdiction and to argue that motion before the judge at a motion hearing. All qualified attorneys know this from training and experience. Qualified attorneys also know that if they were to conduct themselves in court the way this defendant did, they would risk being sanctioned by the state bar association. The defendant clearly knows none of this. He was only following a boilerplate sovcit script with no understanding of law or procedure. Further proof, if more were needed, that it's not a good idea to act as your own attorney in court.

If the U.S. Constitution does not cover statutory jurisdiction then it falls under the Tenth Amendment. Under the Tenth Amendment the Constitution of the State of Michigan applies. So the court does have jurisdiction.

The law is filled with what appears to be endless minutiae and arcane nonsense, but there’s a beauty to it also. Watching a judge deal with a mentally ill person brings that beauty out. At that moment the sovereign citizen is at the total mercy of what he believes is an oppressive system. Yet at every step of the way the oppressor not only protects his rights but even humors his idiocy. In the end he was sent to jail for obstructing the judge’s attempt to protecting the accused’s rights!

The prosecutor’s hot mic slip-up (including profanity) may be the only thing that saved the SovCit’s ally from joining him in jail for contempt. The judge may not have wanted to convict both of them and not treating both the same way would have been unfair

The 10th to the Constitution was ratified on December 15, 1791. It makes clear that any powers that are not specifically given to the federal government, nor withheld from the states, are reserved to those respective states, or to the people at large. That's how the court has statutory jurisdiction

So weird that people who claim not to understand even basic jurisdiction or court rules feel competent to represent themselves. It's almost as if they are intentionally dishonest about everything they say, to disrupt every proceeding and try to win by exhaustion. When it's planned ahead of time, contempt of court should include heavy financial penalties as well as jail time.

This is the court of general jurisdiction. It has jurisdiction over *all* legal matters within its territory *unless* jurisdiction over a given subject matter has been explicitly placed elsewhere (e.g. probate, &c.). So, in order to succesfully claim that this court lacks jurisdiction, one must assert that some other specific court DOES have jurisdiction.

11:00 the judge was TOTALLY about to ask him if he'd seen "My Cousin Vinny" and reference the scene where the judge tells him that if any words other than guilty or not guilty comes out of his mouth, that he would hold him in contempt! LOL But he thought better of it and didn't, heh. That would have been so awesome, though.

That's what all judges need to do. Sit overnight after they've been warned and refused to accept the court's ruling. It usually only takes 24 hours to convince them. Love your work OSG. Thanks!

@@voiceofreason9238 I was watching a couple of SovCit vids where some of the worst 'offenders' did get 24 hours to think on it and came back looking and acting most contrite. One was a gentleman who got punched 4 or five times by an off duty policeman who happened to be in court when the defendant kicked off. I don't think that's what changed his mind . . . but who really knows. You may well be right. The short man mightn't see the light. They're an unpredictable bunch and the more time they spend on the other side of bars, the better - as far as I'm concerned. IMO - they're getting worse, not better. Wandering around in the courtroom checking on the equipment, that's a concern too. I'll go overs for the fun of it - and hope OSG gets an update to us tomorrow. Gotta love OSG.
