Trooper's Report: On 5/23/2023 I was patrolling State Highway 25 when I observed a silver passenger car traveling at a high rate of speed. Radar confirmed the speed to be 68 in a 55 mph zone. A traffic stop was initiated on the vehicle and during the initial interview I observed an open container of vodka in the passenger floorboard. The driver appeared confused and struggled to find his driver's license. The driver was ordered out the vehicle. The driver's eyes were bloodshot and watery. The driver admitted to having two drinks and refused to comply with a PBT or field sobriety. The driver was told to put the open container in the trunk and wait in his vehicle. The driver got back in his vehicle and drove off. I followed and activated the siren. The driver failed to stop and continued southbound for approximately 3.5 miles. During the pursuit the driver crossed the centerline, drove through two intersections, and reached speeds of 75 mph. After passing South 7th Street, the driver began to slow and move to the shoulder. Cleburne County units joined the pursuit and the suspect vehicle was boxed in. The driver was ordered out of the vehicle to which he failed to comply. While attempting to open the driver's door the handle came off. The driver was then forcefully removed from the vehicle and placed under physical arrest. The driver was transported to Cleburne County jail where he refused a BAC test. The subject was charged with the following: 5-65-103 1ST: DRIVING WHILE INTOXICATED - DWI 1ST 5-65-205: REFUSAL TO SUBMIT TO CHEMICAL TEST 5-54-125(d): FLEEING - VEHICLE OR CONVEYANCE 27-50-302(a)(7): SPEEDING - MORE THAN 15 MPH OVER LIMIT 5-71-218: OPEN CONTAINER CONTAINING ALCOHOL IN MOTOR VEHICLE 5-71-212(c): DRINKING IN PUBLIC OR DRINKING ON HIGHWAY 27-51-301(a): DRIVING LEFT OF CENTER

You can refuse a field sobriety test, but in some states you lose your license right away. You can refuse the portable BAT test in every state without consequence; however, you cannot refuse the test at the station. Some states automatically charge you with DUI if you do, others get a court order to forcefully do a blood draw. Either way, if you refuse, it’s worse than the DUI. That is, if it’s your first DUI. If it’s your second within 5 years, third, forth, or more, you’re in big trouble anyway.

Anybody who sees this video knows for a fact he wouldn't have released him with tickets to be on his mary way. He refused a field sobriety test and breathalyzer which is an automatic go directly to jail. He was waiting for backup to arrive to take him into custody worried he'd resist or put up a fight.

@@DarkChaos87 He only needs reasonable suspicion for the stop, but he needs probable cause for the arrest. I think he was working on it, but drunk dude decided to take a short cut. Edit: Exercising your rights against self incrimination doesn't equal probable cause. Of course the open bottle might.

"If you're stopped by police and asked to provide a breath sample at the roadside, police station, or any other location such as a hospital, you are legally required to provide one. Failing or refusing to comply with a breath demand is a criminal offence." "Alberta law (my province): You also do not have a legal right to refuse one or more of these tests. If you do refuse to take a field sobriety test, the police officer can charge you with failing to comply with an officer's demand. A judge will later decide if you had a reasonable justification for refusing to take the test." Also, in Alberta, if someone has reported you as a drunk driver and the cops show up at your house shortly after you get home, even though you have not been driving drunk and have already started drinking a beer by the time they show up, you can get charged for DWI.

It varies by state of course, and I'm not from Arkansas, but "probable cause" is the US constitutional standard for arrest. In some states, you must provide consent to even get a license. Generally, if the cop can articulate probable cause, it is good enough for an arrest and a judge to grant a warrant for a blood test. I agree with almost everyone here that this guy was hammered. But since the cop already said "I don't think you're drunk," that would probably hurt his case. Overall, I don't think either of these guys is Mensa material.

A car was hijacked and the police saw it a little later, but couldn't pursue because they didn't know if the people in it were the hijackers or not. No probable cause to chase. Oh look, there is the car that has been trying to steal ATMS from banks and it is just leaving a bank where the ATM was tried to be stolen, but we don't have proof they did it, so no chase.

He was definitely professional and polite, but definitely seen some things on that stop that he would be wise tk review it and practice better traffic stop etiquette and officer safety as well.

It made me cringe! Walking between the cars (unless the trooper knew the ignition was off), taking his eyes off the driver ie looking over the roof of the car, allowing the driver to get too close, not watching the driver walk back to the car (and missing the obvious stagger that occurred), too close to the driver when he had a large bottle in his hands.....

@Edgar Williams I can follow that reasoning 100% up until he leaves. The cop was not clear enough when walking back to his squad car. But when the cop then takes off after you and switches on his siren, you are supposed to yield and pull over - even if it's not for you. And when you then do pull over and he tucks in behind you and stops, then you are being pulled over - even if it's "again". So while I would not have agreed with an "evading" charge for the first couple hundred yards, he absolutely does deserve one after all this bobbing and weaving through traffic. I mean, how many times can you "pull over" for a cop to pass and the cop following your movement before you realize that YOU are being pulled over, yes: AGAIN...

surprised the officer didnt simply ask the guy to sit in the back of the patrol car instead. could have probably saved them both the chase.

While the Trooper was nice and polite, he did a terrible job on this stop. His instructions were flippant and lacked command. He also took his eyes of the man when he first told him to get out. He could have had a gun on him. No excuse for the driver to not pull over once he realized the trooper wasn't done with him though.

He is clearly incapacitated at 7:44 when his right foot, instead of stepping forward toward his car door, crosses in front of his left, veering him out into traffic. Too bad the officer was looking the way at oncoming traffic.

Hint folks: your ability to follow instructions is how your sobriety test is most heavily judged, more so than your ability to physically complete the tests. This guy didn't remember he was getting a speeding ticket and didn't have his license back yet, so he was supposed to wait for that. That's a failure to follow instructions.

The officer also gave confusing and contradictory statements and instructions which even sober were hard to follow. "If you can walk to the end of your car and back you can go ... good ... get in your car." A first year lawyer will have this guy walking in a couple days.

AT 11:00 the road is completely clear and he's driving relatively slowly. Driving drunk, he's clearly a danger. Why doesn't the officer use a pit maneuver at that time to get him off the road???

The reason he “misunderstood” is because he is drunk. I can see he’s drunk by the way he moves when he’s out of the car. Also there is no possibility that he didn’t understand the cop was trying to pull him over again. Sorry, I’m usually on the side of the officers but this was a bad call.

In some states, refusing the breath test is automatic license suspension. Not "Well, swe'll let you go with the speeding ticket you were originally stopped for." And the open container would have been : "Pass the breath test or we'll impound the car and take you to jail." Not "Just put that in the trunk for me." When he refused the tests, I expected cuffs, not "Get back in your car and we'll get you on your way."

A really great officer but he missed this one as this guy was drunk as can be, but I agree it didn't show up much with just conversation. He almost fell over getting into his car that the officer didn't see and was all over the road. An open bottle of Vodka on the seat is not a good start to convince me your not drunk. ASP has some of the best cops in the country and no one gets away I'm glad to say.
