This video addresses the outcome of years of litigation under FOI by Rex Patrick to get a copy of the advice that the then Attorney-General, Christian Porter, gave to the then Prime Minister, Scott Morrison, in January 2020 about what has become commonly known as the "sports-rorts" affair.
The first part discusses the litigation. It outlines the practice of avoiding transparency under freedom of information ('FOI') by keeping controversial documents away from government files and instead in Ministers' offices. If they are subject to an FOI claim, it is then asserted that the documents are no longer held, once the Minister changes office or the government changes. The courts rejected this approach and insisted that the FOI Act could not be frustrated in its operation in this way - which is a small victory for transparency.
The second part of the video considers the Attorney-General's advice, which has finally been produced. The advice concerned whether the Sports Minister had the legal authority to determine the sports grants. The video critiques that advice, noting the critical distinction that the Australian Sports Commission is a Commonwealth corporate entity, not a government department.
