Needs to go to the state dept to obtain a certificate of u.s . Citizen born abroad. As long as one birth parent is a US citizen, than the child is automatically a US citizen. I know this as my daughter was born in Germany at a us army hospital. Her birth is registered with the american state dept. .

The governor is the chief executive of the state of Tennessee . If the bureaucracy he is in charge of has a problem ... it is his responsibility to fix it . In this case , it looks like a clerk at the DMV needs some help figuring some things out regarding state compliance with the REAL ID Act that originated in Washington, D.C. 😶🌫️

My uncle went to the same thing when he was stationed in Germany when his youngest daughter was born. He/US Embassy had to fight with the German/Government to declare my niece was an American Citizen and NOT a German Citizen. After about 6 months of this just before he was to come back to the US, the German government dissolved his daughter's German Birth Certificate and finally gave my uncle his daughter's US born birth certificate.

Note the use of the word "person", not "citizen". "Citizen" is used in other places in the same section of the same amendment to describe other rights, so those who wrote the amendment clearly knew the difference and used "person" in this case. That said... The state enjoys sovereign immunity, and doesn't have to permit you to sue it.

The state isn't the bad guy. You have to provide proof of citizenship or legal residency for real id. It looks like his parents just never reported the birth aboard. If you are born aboard(Canada here), your parents have to submit a "Consular Report of Birth Abroad" which shows you got citizenship at birth. At which point you will be issued a US birth certificate. This was true when he was born. If this was not done then you must submit an application with your foreign birth certificate and proof of citizenship for your parents(you can request their birth certificate). This isn't to give you citizenship which you got through your parents but to get proof of citizenship and it won't take years.

I am a naturalized citizen who went thru honest process and so does him who was born in Canada and came to the US when he was a child who had stupid parents who didn't apply him for citizenship when they became naturalized thinking that it would be automatic for him to become a citizen. Not really, they just want proof from the US government that he is citizen, non citizens can serve in the military.....right now local government are requiring the federal government to determine citizenship, they are not relying on their interpretation of the Federal law anymore.....his case is easy to rectify, he needs to apply for Certificate of Citizenship(N600) from the USCIS pay the fee about 1500 with the required supporting documentations, it takes about a year or unless he request an expedited review due to a hardship........or if the agency understands Federal law and recognize him as a citizen.....this is not unusual, they are people being denied social security too because they cannot prove being a US citizen even when they worked here for 40 years ...... Agencies do not want to determine who is a citizen anymore based on the law they want the federal government to do it....this happens at lot especially with Canadians, since they can travel into the US and stay unlimited......

I had a co-worker at the Univ of Cal who had the same thing happen. When he went to get a passport to visit his dying mother in the Philippians, he was told he was not a citizen. His naval military record had been lost and he had no proof he had served. After wrangling with the navy with no luck, he contacted his Congressman and Senator. They were able to clear his record and secure his citizenship. Sadly his mother had already died.

The original slip up happened with his parents, however it happened. It's a super shitty situation to be in and it'll take a lot to fix. I feel like we're walking into a trap with a lot of our lack of education. We have a whole structure built around us to care for us and make sure that things go smoothly, but we've become so complacent and lazy that we don't attend to making sure that we're doing what's needed to keep the gears turning and are losing this knowledge of how to run the bureaucracy machine. My son was born in Germany, and we had to register him with the U.S. Embassy. That document is his American birth certificate.

The document you get from the Embassy is a "Report of Birth Abroad." Then when needed for ID, you show both your foreign birth certificate and your Report of Birth Abroad. Sounds like this guy never got a Report of Birth Abroad which can likely be quickly fixed by his US representative.

When my 16-year-old nephew went to turn in his learner's permit and take the driver's test. He was told he couldn't because he had a DUI. At 15. Turns out someone in a court clerk's office transpose two digits and it turns out that carrying a passenger at 15 is one digit off from a DUI code section. He never should have been suspended much less had a DUI. Even after we went to the court clerk got them to fix it and send that to the state along with the letter stating what had happened. They still made him pay $30 to reinstate the licensing ever had before he could take the test

Why? Citizenship is a federal prerogative. State senators don't have any special privilege with the federal government. Now, if he contacted his federal congressman or senator I bet they would give him all of the information he would need to get his US citizenship documented. The same thing happened to my brother. He was born in Canada but moved to U.S. when he was 2. Both my parents became U.S. citizens while he was little. The U.S. Department of State says if one parent becomes a U.S. citizen before a child is 18, that child is recognized as a U.S. citizen as well. He never had a problem for 50 years and then when applying for a new job, he was rejected because he “wasn’t a U.S. citizen.” That man should apply for a U.S. passport, which he will be granted as long as nothing else is wrong, and that document will give him the ability to fly AND prove citizenship to the department of motor vehicles.

It was incredibly difficult for me to get a real ID without a passport due to a past marriage & divorce. I got a passport and then went and got a real ID to fix the problem.

I had a real ID in Florida, but when I moved to SC, they wouldn't accept it, because my birth certificate had a different spelling for my middle name. I was born in Boston and so were my parents. However, for over 70 years I spelled my middle name Gail. Guess my parents never noticed it was spelled Gale on the birth certificate. It was a mess, but I got my license if I agreed to use the spelling on my birth certificate. So my driver's license, registration, title, and the deed to my home show "Gale." But my old passport, Social Security and Medicare cards all use Gail.

If your parents became naturalised American citizens, your brother should have been given a Certificate of Citizenship - I had one myself, as my parents became US citizens when I was a minor.

@@frankhooper7871 Both my brothers were born in Canada and neither received a certificate of citizenship when my parents became citizens. That was back in the early 50s. My other brother joined the army when he was 18 and never had a problem, but he also always had a passport as an adult. And as a recent retiree from a job where I was a passport accepting agent, in recent years when people from other countries became American citizens, they would immediately apply for U.S. passports for themselves and all their minor children and all the children were accepted as U.S. citizens with just their foreign birth certificates to show who their parents are and their parents new citizenship papers. Once one agency of the government verifies citizenship, the other agencies accept them as citizens without making them prove it again and again.

There's a Marine Corps veteran in Florida who served just after the Gulf War ended and spent years in the Corps, now his state is saying that he isn't a US citizen. He was a green card immigrant recruited with the promise that he would be given citizenship and now the state is saying that because he didn't serve during a "war time" he is not entitled to automatic citizenship. Even though his service would have overlapped 9/11 and OIF/OEF which was a war time period. Same situation too. Had a state driver's license for years and then all the sudden the state says they can't renew it cause he isn't a US citizen and has to apply for it.

My parents were born in Brazil and came to the United States after college. They were given permanent residency (green cards). During the Vietnam war, my father was drafted by the US Army and told that he could either serve or leave the US forever and never return. He opted to serve and did so for 3 years (1966-1969). He was honorably discharged. A few years later, he decided to finally get his US citizenship, so he went to the Immigration and Naturalization Service (INS) office and asked for his US citizenship. Initially, the INS officer told him that he would have to go through a bunch of paperwork, take an exam, give references, etc. My father just shook his head and pulled out his Army discharge papers. Under the law, anyone who served in the US military during wartime was AUTOMATICALLY entitled to US citizenship (makes sense). Before he left the INS office, they had him stand before a judge, raise his right hand, and swear his citizenship oath. He left the office as a brand-new US citizen. My mother, on the other hand, had to go through the whole paperwork, etc. I am truly surprised and disappointed that the state of Tennessee is putting this gentleman, also a US military veteran, through this difficulty. He should be taken before a judge and made to raise his right hand (he already swore to obey and defend the US constitution on entry to the military) and just remove any doubt of his citizenship.

This happens to far more people than you can imagine. Some consular puke fails to file the right paperwork and some poor kid of active duty personnel who is born overseas is left in limbo. We discovered my oldest daughter wasn’t registered as an American properly when we were trying to enroll her in school. It took 12 years, three different lawyers, the intervention of a US Senator and tens of thousands of dollars to fix it. And when our own consulate asks for a copy of her passport photos AND the $75 “processing fee” for the 17th time, you start to figure out why our immigration system is so intentionally broken and corrupt. Unfortunately my wife was killed in a car accident before she was able to witness our daughter being confirmed as an American citizen. The one thing I have advised her to never do is to ever serve in the military overseas.

This just happened to my husband as well. Born in Scotland to US military dad and American born mom. Served in the military 20+ years and held high security clearance. Has had a drivers license in Massachusetts, South Carolina, and Arizona. We moved to Mississippi, and he went to get his new driver's license and was told he's not a U.S. citizen. He, too, was told that he would need to apply for citizenship. In doing so, one of the requirements he would need to bring in his parents. My husband is 65 😂 Needless to say, he did get his drivers license. He just went to another location.

When he reached majority, he would have had to choose between U.S. and Canadian citizenship. Furthermore, to obtain U.S. citizenship at birth, his father must have been born in the U.S. So he has never provided proof of citizenship.

It's one thing to niggle over the Real ID, it's yet another to take someone's license and revoke it without cause, regardless of his having other state operators licenses, which de facto then overrules the US Constitution's faith and credit clause and effectively overrules the entirety of the US Constitution. Cut off every federal cent to the state, no federal agencies or services at all, not even for the Guard until they restore his rights as a US citizen.

All the things that are now commonplace to register a child as a US citizen when they’re born in another country were not in place when this man was born! Those of you who are saying it is easy, we’re not born in the 1940s and have no understanding how much life has changed since then. That is the major issue here. Rather than telling him he is not a US citizen, his home state should be telling him what he needs to do to resolve this issue. Shame on the bureaucrats from his home state who should be looking after him.

Those bureaucrats have deliberately created a situation that makes it impossible for his citizenship to be recognized despite the irrefutable proof of his citizenship. he needs to take Tennessee to court and sue not just to get just compensation but to also get his vote retroactively counted in this up coming election and if it comes down to one vote it should be his and I don't know his political party but there it is.

Nah man, I've seen the documents that they used back then. Someone knew what needed to be done. It will not be easy for him to complete it, but there is a process and there was one in 1940, too. I do agree that they should be telling him what needs to be done, but they probably don't know. They're county clerks with associates degrees for the most part.
