if the IO has not recorded the statements of the witness and made chargesheet of his own and named the witness in the chargesheet without asking them... then what about contradiction between section 161 and 164 crpc

Haan kar toh sakte hi hain. Lekin fir defence usko contradiction ke liye use kar sakta hai, or court bhi apne according inquiry kar sakti hai. If such a witness changes his stance, then he becomes little unreliable, but his testimony is not discarded as whole. Relevant part can still be admitted as evidence (Falsus in uno, falsus in omnibus is not applicable in India)

As in sec 161 accused n witness both can be examined same is in Sec 164 ...Confessions are the statements made by the accused person n Statements in this sec are those statements which are given by the witnesses.... Statements can be taken on oath but not in confession bcz it will against the Rule of Self incrimination U/A 20(3) COI

162 crpc da ਕੋਈ ਬਿਆਨ ਨਹੀਂ ਹੁੰਦਾ I.O us 161 crpc ਬਿਆਨ ਗੁਵਾਹ ਦੇ ਲਿਖਦਾ ਹੈ ਉਸ ਤੇ ਬਿਆਨਕਾਰ ਦੇ ਦਸਤਖਤ ਨਹੀਂ ਹੁੰਦੇ.
