The plaintiff brings his estranged wife to court. He says she got a restraining order against him, and when he went back to their house, she removed his property, so he’s suing. The defendant argues she left the plaintiff because he strangled her. She says she removed her own property and not his, so she doesn’t think she owes him.

I think she did file that temp restraining order for the sole purpose of stealing his stuff. She has to pay $1000 but like he said it's going to cost a lot more to replace all that equipment so the defendant kind of won... Hence the sadistic smiling.

She literally said she was being abused, she filed a restraining order, and then her mom talked her out of it, while allowing him to remain in the home. And he didn't deny it. I love how the judge doesn't even ask to see a police report or pictures of the so called abuse he put her through. The defendant is a big BABY. He was supporting her, and she got pissed that he wasn't paying her way anymore and repaid him by stealing all of his stuff, and withholding his child. What a miserable person.

Two things about the verdict confuse me: 1- On the wireless system, if the value is $400, and the judge's logic is that they went in on it together, why does she get the system ($400 value) and he only gets half ($200)? Particularly when she didn't pay for the system initially. 2- Since they know where all of these items are, and are planning on having an exchange for the phone already, why didn't the plaintiff get the choice between taking the depreciated value or getting the items back that she stole from him? Particularly with the computer and that dock/keyboard thing he was so focused on?

1: The same reason why pre-nups exist, because the default for married couples is that money made within the marriage belongs to both of them, even though it's made by one party. Now I don't know if that counts if you're only religiously married, so there could have been a case for that but when you're legally married that's the default. 2: Depending on what he was seeking in the initial law suit, he might not have asked for the other items back but was seeking the phone because of the contacts within it. You see it more often in animal cases, but you can say that you want the item back or the value of the item. But if you'd rather have the cash, or know it's unlikely that you'd get the item back, you make a claim for the value of the item(s).

Yeah, expensive equipment like that, the defendant she have been ordered to return all of it. It's clear she stole the stuff, and he can't replace specialized equipment like that for $1,000. The defendant came away with the "W" for sure.

The Defendant is a nutcase and seems unhinged. She clearly abused the court system and only filed that restraining order so she could steal the stuff. And even her mother seems to agree. Worse yet, she’s not following the court order by ensuring he gets to see his kids. However, he doesn’t seem to be pushing the issue or in a rush to see the kids, so what can be said. The decision was fair. He got back what he was supposed to get based on the replacement value. If he really cares, he’ll take his court decision to family court and show that she is abusing the law and not following the court orders. This is a mess altogether. The new girlfriend needs to pay attention because this behavior will repeat itself if their relationship goes bad. The Defendant needs to be prosecuted and to get a job of her own and stop thinking everyone should take care of her. The Plaintiff needs to start acting like a concerned father and pursue family court, and also get help if he needs it for his behavioral issues if there are any. But based on how deranged the defendant seems, it’s hard not to wonder if some of the Defendant’s claims aren’t false. Sad, all around.

Maybe this is an unpopular opinion, but if he stopped giving her money, then maybe she should get a job since she is willing and able !! She said so herself they weren't actually married Therefore, he has no responsibility to take care of her. She is supposed to be a His grown women she took whatever she felt like taking!! And she's purposely keeping The children From their dad that is Just sad !! You don't have to like each other but don't hurt your children in the process. I don’t believe either one of them told the whole truth!! I feel sorry for the kids. He looks like he could be abusive and she seems like she could be manipulating.. but she did take stuff that didn’t belong to her. I’m surprised the judge didn’t order the return of the equipment rather than the depreciated value of the items. He is right, he won’t be able to replace those things at that reduced cash value. Best of luck moving forward with the kids.. 😢

The defendant took/stole the plaintiff's cell phone because she needed the SIM card? You're telling me that the defendant couldn't afford to buy herself a $10.00 SIM card? Honesty & integrity are certainly two qualities that she is not going to be able to teach her children. Whatever judge granted the defendant the sole right of finding/choosing a 3rd. party supervisor to be present for the father's visitation with his children is a total & complete IDIOT. From what the defendant said, which appeared to have left even the judge in awe, it seems that the defendant can take forever & a day to agree to an acceptable candidate & with as much anger the defendant holds for the plaintiff, the father could be waiting for years to see his children again. The original judge should have ordered a mediator & a time frame in which to find a suitable "supervisor" & not left it open to the whims of the defendant/mother. Thankfully, this Judge told the father to go back to court & pursue his parental rights rather than wait on his vindictive former wife to "move things along".

Defendant has an answer for everything. Rather than admitting she was just fed up and she has a new partner, she has an answer for everything. She has a reason for taking his cell phone, why he can't see his kids, the keyboard and equipment she took, etc. And yes the kids are being used as pawns too by the ex wife and they're being hurt by both of them. And for the ex wife to stand there and smile and laugh at the ruling, it was obvious she is auditioning for something, really immature.

The Defendant had been coming and going from the house, probably mostly staying away. Then, out of the blue she gets a restraining order to get him out of the house and cleans out the house. Electronics and computers, cell phones, etc. That's pretty sneaky. The fact that the Defendant's mother still allows the Plaintiff to stay in the house says a lot about the situation. Although, Judge Milian seems to be right, the Plaintiff is being too lazy when it comes to his child. She'll grow up hearing only her mother's side and hating her father. Neither parent seems great.
