Pretty sure whoever put it there will be back , eventually , to retrieve it Someone might look forward to that , more than the rogue agent . And of course , being fairly remote , virtually anything could happen . After all , this is where the aliens drop of Elvis and Sasquatch . They might want some company on the way back or just to drop at some random hog farm . You never can tell about aliens .

I would report the placement of items on my property by unauthorized persons to the Sheriff and County Prosecutor, and ask for prosecution of trespass, and deliberate placement of items.. before revealing to them what the items are and who owns them. Only after obtaining a commitment to prosecute, then reveal the items and agency responsible. Illegal surveillance without a warrant may also be an actionable offense.

So I live in Michigan. I own 60 acres of farmland. Same situation. About 5 years ago I found a camera on my land with an antenna. Camera was locked on a tree with a 3/8" heavy duty cable wrapped around the tree. Cable actually had a tag on it DNR. This tree is a huge stand alone oak tree literally centered in my property. So I got a full face mask to conceal my face and headed out with a hacksaw. I knew I wouldn't be able to saw through the cable - but I would be able to saw through the cable mount on the back of the camera. After sawing it off I found a small cable I hadn't noticed that went up the tree for 10 feet and there was a small solar panel attached to charge the battery. I removed the wire and batteries from the camera immediately after sawing it off. A few days later in 2 seperate trucks MI DNR officers are at my door one evening. They state they have a report of someone poaching a deer on the next property over and they want to enter through my property for the suprise and to hopefully catch the poachers in the act. I'm like sure take the lane back it only goes halfway but that will save you some walking. Both DNR officers head back with headlights on lighting up the whole field and lane like it was daytime... right a way I'm thinking if I'm sneaking up on people in the woods at the back of my property - I'm not going to drive back with my headlights on. In fact I'm ot even going to try to hit the beak pedal to announce to them I'm coming back. I grabbed my binoculars and started to watch what they were up to. They got to where the lane ended and got out of their vehicles. With flashlights in their hands they headed for the oak tree that had the camers on it. They were out there for a good 60 minutes shining their flashlights up in the tree and all over on the ground beneath the tree that the camera was on. I live in a 2 story home and was up in my daughters room on the second story so I had the birds eye view. They were taking photos of the area and tree. After they were complete they headed back up to my house and pulled back into my drive. I met them in the drive and said you only went half way back what's up - All excited i started bombarding them with questions -Was the dear laying there near that huge oak??? Do you guys have it in the back of your truck??? Is it a buck or doe??? What do you guys do with poached deer? Give them to the homeless or food bank??? What about the poacher did he get away??? Man i hope you get those guys because you can get them for trespassing on my land too. Both officers are looking at each other with their heads kind of hanging at the same time. Neither officer would say exactly what they were looking for no matter how much I pressed them. I said what were you guys looking for around that huge oak tree. They said just checking some things out, and kept giving evasive answers. I said sorry things didn't work out and said good night and i truly hope you get those poachers. I believe they knew I took the camers but couldn't prove it. They knew they were caught trespassing and couldn't or wouldn't admit it without opening themselves to a lawsuit.

"unlawful" search and seizures. It was the position of Leo's that they had a lawful reason to do what they did, it just turns out they were wrong, perhaps waiting until they found something and making up an excuse to go after him.

@@HH-ru4bj ... Uh, when's the last time you read the fourth amendment? It prohibits _"unreasonable"_ searches or seizures, not "unlawful" searches and seizures. Warrants are required by federal law, as an extension of the fourth amendment, prohibiting _any_ searches and seizures unless the person performing said search/seizure first obtains a valid warrant by explaining their reasoning to a judge, with strict exceptions.

Exactly, this is something we need reviewed by the current SCOTUS because it's obviously not inline with what the framers intended. It's absolute insanity that law enforcement would have the right to trespass on your property just because they can see it, they are not above the law, they are trespassing if they don't have a warrant.

@@tygerion4404 but yet judges issuing warrants where the leo lies should charge them with contempt. but dont do it often. wether you like or hate trump fisa warrants were issued based on lies that fbi knew were lies but the fisa judges have not held any of the agents who swore the warrant out have been held in contempt\ and why i said like or hate trump. if they get away with illegal actions to a elected president what hope does the ordinary man have against false government agents

@@bobbygetsbanned6049 wE do NOT Want this reviewed by the current SCOTUS, because they will gut it like a deer more than it already is. The Supreme court has shown us that it does not matter whats written or whats right, they do what they want. And that is something that is hard to pin down , because the same peeople who restrict police search of cell phones expand search of cars ,etc. like, its a risk to be sure.

Steve we had property in Kentucky And we found 3 cameras on the property that had antennas they were in the trees we shot them And took them to the dump. 2 weeks later we saw someone or someone dressed in Olive green on the property and we have no trespassing that violators will be shot and we started shooting we didn't really shhot at him it was more to scare him and he ran for his life 30 minutes later there was the sheriff's department along with Kentucky trooper and the wildlife officer was charged with trespassing, by our sheriff. Told the authorities you better have a warrant next time

There is a video on YT it a ATF Guy trying to bully his was into an apartment so that he can do an illegal search inside. The woman called the local police. The ATF agent was really cocky with the cop when he arrived. It did not turned out too good for the agent once the cop's backup arrived and took down the agent like a common criminal. It was funny to watch. Once on the ground and pinned by the cop, the agent sounded like a little b**ch, attempting to get sympathy.

I grew up in Tennessee and was always told that the game warden doesn't need a warrant. That never set well with me. I'm glad someone is finally challenging it.

I grew up in Oregon and heard the same thing. It wouldn't have set well with me either except for the fact that I shot my first human before I shot my first deer. I have no problem killing a tyrant.

I've heard this same story Game Wardens don't need warrants, can come in look in your freezer take your guns, boats, truck what ever and leave you with no recourse. Never sounded right to me. There are other stories such as the welder that got his arm blown off by a butane lighter in his shit pocket or the divers that came out of the water at the dam and refused to go back in for fear of being eaten but the giant catfish. I'm 68 years old now and have heard these same stories all over the country since I was a teenager. Not surprised to hear the law tells people this obvious lie in these classes. In the end if you don't know anybody that had these things happen to them, not their cousin or some dude a couple of town over, it probably never happened. Instilling fear as prevention, not of crime but of people bucking when/if it happens.

I took a hunter's education class a few years bank and the DNC officers that taught the class made it clear that they could kick in any door any time just to count the fish or squirrels in the freezer. No warrant needed! They also made it very clear that you better be very polite when speaking to a DNC officer, "because we've never met anyone that we couldn't find a reason to arrest". My take is that the "king" still owns the birds in the sky and the fish in the stream, and that blue gill in the fridge is more important than the Constitution!

So they were saying that they are basically granted an exemption from the Constitution of the United States of America, which I thought EVERY law enforcement officer of any department of any State was required to swear an oath to uphold and protect? I was told the same thing about Texas Parks and Wildlife "Game Wardens", except that when I researched the issue I could find absolutely NO Exemption for them from the Constitution anywhere! And hence, I'm suing them now. Just saying.

Had the same thing said to us when I took my son to a hunters safety class in Michigan. Said he didn't need a warrant but he wasn't going to be the first one to try and implement it. The sad part this guy laid into a 10 year kid because the kid thought something was funny. I told the kid on break that the warden was just a jerkoff and don't take it personal.

It amazes me what lengths certain agencies take. I have a life-long friend who grew up on a 70 acre dairy farm. Every fall, the family would host a "bird shoot" (dove hunt). It regularly drew a dozen or so friends and family. They would have a good time, everyone would get a bird or two, and the hunt would end with cooking them for lunch and socializing. One year (mid 2010's), in the middle of the hunt, a UH-60 Blackhawk helicopter landed in the middle of the field from which numerous "wildlife agents" in full "battle rattle" poured out. They gathered everyone up and demanded ID's and hunting licenses. They claimed they were "hunting over a baited field". Every season, the property owner would plant millet in one field, corn in another, various grassed for hay in another, while the fourth field contained the herd of dairy cattle, rotating the fields each season. The "bait" was the rotating feed-crop fields, according to the agents. The property owner explained he has owned the land his entire adult life, and those crops were feed crops for the dairy cows for his dairy farm. The agents managed to write one ticket for one unlucky participant who didn't have a "plug" (limiting device for only three rounds) in their shotgun. Come to find out, they had placed "monitoring devices" in the fields and considered harvesting a crop as baiting. Tax payer's money hard at work.

If they don't fight it, it will encourage people to challenge them on other things. They have to make every case as hard as they can, to discourage anyone who can't afford to spend a ton of time and money fighting it from doing anything.

No need. Sell them a third party wiretap and get the third party to collect data for you. No warrent needed. What are people going to do? Cite section 1983 try to get the government to admit these thrid parties are "state actors" and violating civil liberties on behalf of the government, so you might be able to sue them if the government deems you are allowed to? A government admiting they made a mistake. When has that ever happened?

Warrantless searches are illegal, period! Plus, if someone else's belongings are on private property not owned or occupied by that individual then the belongings are considered "discarded". The property owner has complete control of what he decides to do with those discarded belongings. The government's assertion that the placement of cameras on private property absent of a warrant is preposterous.

Warrantless searchers are NOT always illegal, PERIOD! Ever hear of exigent circumstances? The legal definition is "circumstances that are of such urgency as to justify a warrantless entry, search, or seizure by police when a warrant would ordinarily be required". Doesn't mean that applies here, but you're make a broad statement that just isn't true.

Most folks with a general IQ above 10 probably would’ve understood that especially when you combine “…MAY say…” with “…but as an unqualified blanket statement…” I often get slammed if I write several paragraphs commenting on videos because I wish to ensure that people FULLY understand the thought processes and explanation, and the one time I decide to keep it brief, out you pop.

@@maxsdad538 Except that judges have specifically defined that as 'imminent injury to a living person'... if you don't have that, you don't have exigent circumstances and even if you do or think there is or testify it is, if the person in question can give evidence that you knew it was not? All evidence goes bye-bye.

Growing up in East Tennessee I have always known since I was in my 'pullups' as well that Game Wardens (that's what we call them) have always overstepped their bounds. When the law chases it's own tale. Please indulge me on this very short TRUE story. Once upon a time a game warden here cited his lifelong friend (who was a deputy sheriff) for too many fish in his boat. The very next week the game warden's wife got a speeding ticket from the deputy. My community laughed about this for years.

I don't understand how they could accuse that guy of theft. They put the camera on his property and he just moved it to a different location on his property. They were the ones who put it on his property, he just moved it, that's not theft.

@@michaelshrader5139 it is open and shut BUT government often covers for government. I learned that the hard way the first time I shot a kid. The cops stole my gun. Yes, theft. They are supposed to give you a receipt. When I went looking to get my gun back because I was naive and innocent, the cops falsely arrested me. They did so to try to teach me a lesson and to give them time to figure out how they were going to weasel out of the theft. They'd already been reprimanded for a ton of missing evidence in other cases. Ultimately the bogus case was dismissed and they eventually returned my gun. The lesson I was supposed to learn was that the government is all powerful and I'm at their mercy. What I really learned was the reason for the second amendment: the government is often crooked and when it is it's our patriotic duty to kill. There's a reason those cops came with full kit: the homeowner had every right to kill those Nazi muffins and the cops knew it!

The definition of theft is moving someone's stuff without them knowing about it. That said, they didn't have any business planting those cameras like that in the first place so it is a bit rich to then accuse the guy of theft.

@@TimoRutanen Isn't another potential part of theft depriving someone use of their property? Moving the cameras into a safe would technically be doing that. So that's not the correct direction to argue. So yeah the correct one is that the person who placed it had no right to use it in that way. If you're illegally using your property in a way that violates someone else's rights, they should have the right to correct it (within reason). Like if you have leave a car blocking someone's driveway, they can't like just destroy it or something, but they should be able to have it towed elsewhere. The most generous version of "elsewhere" for a camera is in a safe (where it's no longer spying on you), if you feel like giving it back if the original owner asks for it. Less generous versions would be throwing it in the trash (you don't know who it belongs to and you just want it off your property).

Myself and another farmer were detained by a Missouri game Warden for poaching and spotlighting deer. The thing was we were using spotlights but we were trying to find a missing cow and calf! Neither of us had a gun in our vehicles and we were on the other farmers property. The Warden even argued with the owner about who actually owned the land. I called the supervisor which I knew personally and he came out and got the mess straightened out after almost two hours of trying to convince him of what we were doing.

Don’t know how it is there, but up north, we are absolutely over run by deer. I’m really not seeing the big deal about just letting people do what they want on their own property. If you bait, and over hunt it, you have no more deer on your property, and it’s over for you. The following years with out deer will cause you to self manage better. This is an agency with no need…..

To enter your property they need permission or a warrant. If they are worried about trespassers and poachers just call the property owner and get permission. If I had trespassers or poachers on my property I'd say, "Go get 'em!" They would only need a warrant if you refused permission. Cameras are by definition surveillance and search which needs a warrant, particularly if it's aimed at your shop and home.

Obviously, they were not after trespassers nor poachers. They were after the landowners and/or tenants. Otherwise, they could ask for permission before seeking a warrant.

If it is about trespassing, it is an offence against the property owner, so if the property owner doesn't cooperate, then the only one harmed is them. It's not the kind of offence where you really need to worry about the perpetrator victimizing someone else. They could even set up cameras on your neighbors' property, if your neighbors are worried about someone trespassing on their land.

I think you need to educate yourself on the concept of “curtilage”. It’s just another way the government has given themselves the right to violate your rights. Basically it says that once you get a certain distsnce away from your domicile you no longer have a “reasonable expectation of privacy”. Your property then becomes”open fields” and any douchebag with a badge has the right to go traipsing though it.

As a LEO I’ll add that they don’t need a warrant if they have the owners permission; the fact that they don’t want to do the work to either get the landowners permission nor a warrant would seem to say the crime doesn’t warrant enforcement. This won’t change much and frankly until the LEOs face consequences personally nothing will change as absolute power corrupts absolutely.

The thing that really annoys me is that there really ARE good cops out there. Cops who got into the job to help people. And then there are... The other kind. I don't think modern training is helping things, either. When you train the cops to think of everyone who isn't a cop as a potential threat the results should be pretty obvious. Yes, people can be unpredictable and dangerous. That's the job though, isn't it? If you can't live with that kind of situation you need to find another job, right? Frankly, cops ought to be able to retire after 20 years just like the military. And for pretty much the same reason. Dealing with the worst people in society pretty much all day every day is not going to give you a very good outlook on life.

@@678friedbed it's not okay for the government to overreach and commit crimes. Full stop. But we have plenty of enemies in this world who would love nothing more than to take us down a peg. Quick rash action is going to destabilize us, probably to the point that it would allow our enemies to hurt us in ways they've never quite been able to before. Even if that doesn't happen just because we cut out a corrupt government does not guarantee that the new government is going to be any better, historically this causes governments to become more corrupt, not less. There's a time for action yes, and that time may be more closer than I am comfortable with admitting, but if careful, critical, and measured thought is not given towards the outcome of any revolt or revolution then we absolutely will be preyed upon.

I had a co-worker tell me a story about their local game warden who was known to be particularly obnoxious. During opening day of fishing on a particular river in Maine, the warden was stalking fishers making sure no illegal lures where being used. Nearing sundown he set his sights on a teenager who was sitting on a log that jutted out into the river across from where my co-worker and his friends were fishing. The kid was totally focused, and when the warden was right behind him, the warden spoke loudly and authoritatively to the kid ordering him to show his lure. The kid was so startled he swung his pole around and knocked the warden into the river on the downstream side of the log. The current swept the warden down river, and as he tried to get his bearings and swim for shore, there was a momentary pause in the chatter of all the fishers lining the banks. Then the air was filled with the sounds of hooks being cast at the warden, then yelps of pain from the warden as they started to "catch" him. I can only imagine that it was probably the worst moment of his life, as he couldn't really see anyone in the shadows of the woods alongside the river, and was to busy trying to swim for shore while keeping his face from getting hooked. He evidently left the river with quite a few hooks in him and had to hike back to his truck through the woods in a soggy and bloody state, where he could then call for help. By the time the local sheriffs dept and an ambulance showed up, the fishers were long gone. My co-worker said it was the most fun he ever had while fishing.

This reminds me of the story of that woman who saw law enforcement putting a tracking device on her car. So as soon as they left, she went out, removed the device, and tossed it somewhere. Then she got in trouble for stealing government property or tampering or whatever it was.

Their argument about time restraint was absurd. Saying people would get away in the time it took, but they had time to get a boat crew together, plant the camera and take months to notice that it was gone.

I taught hunter safety in Iowa for about 12 years so I interacted with DNR officers who came to class to talk. I overheard one DNR officer tell another one that she believed that ALL hunters are poachers, they're just lucky they haven't got caught....speaks a lot to her mindset and how she deals with hunters!

If you don't know WHO the camera belongs to, I think it's fair to say "hmm this person who put the camera here is up to no good" unless you see the camera has something written on it indicating it belongs to a government agency or something.

Institute for Justice is working with a civil rights attorney in West Virginia where a judge went and did a search of a cop's home, in a civil matter, without a warrant. She defended herself by saying she has been searching people's houses for 20 years. She defended her order that he shut off his recording device by saying she was holding court on his property and in his home, so she has the authority to tell him not to record. She has lost on the state level and lost her Judicial Immunity (and I believe her law license) but has now appealed the civil suit to the Federal Level asking for immunity. During depositions, after the state courts ruled what she did was illegal, her bailiffs said if she asked them to do again tomorrow, they would do it.

So, if there is an actual warrant to place hidden cameras on my property, I'm sure they didn't show me the warrant, nor would they have notified me. How do I know to keep my hands off because it was the Feds and not my neighbors?

I'd take it down, remove the batteries, and check the pictures on it. Store several copies of any data stored on it, and pictures I take of it. If I can't tell it's from the government, I would take it to the police station as evidence and report trespassing on my property. If it did belong to the government, I would still make a trespassing complaint, but against them, and I'd look up how to handle evidence in a case against the government before hand. I'd pull my phone out and make an audio recording of the conversation, too. Maybe they incriminate themselves, or maybe they lie. Either way, I go to the local media, and tell them about the camera, either saying the government is trespassing and spying on people, or if they deny placing the camera, that someone is putting up fake official cameras.

I've been following this case in Tennessee. How the government was allowed. To go on private property and put up cameras is insane . The property owner didn't even know they were there . They committed a crime going onto private property. Thanks steve for reporting on this story .

Texas county Sheriff deputies actually climbed over my closed locked and posted "No Trespassing" driveway gate then walked 1/4 mile down my driveway to open my closed yard gates to knock on my door at 8am in the morning to ask if I was missing any cattle.... 1 deputy stood far off to the side with her hand on her gun while the other male deputy questioned me at the front door about some cattle they had found loose further up the roadway from my driveway gate (I don't have cattle here, just horses)! I was awakened from a deep sleep that morning, by law-breaking law-enforcement personnel who just wanted to know if I was missing any cattle.... wtf?!?! Previously a Texas Parks and Wildlife "Game Warden" opened my closed and (though not locked it was secured in the shut position from within my property) posted "No Trespassing" driveway gate and entered my property while I was not even home (a neighbor witnessed them doing it and was text messaging me while I was down in Houston working a job). Texas Parks and Wildlife has refused FOIA and TPIA Requests demanding to know just WHO they had trespassing in my property April 20 2020, how long they were there and what they were there for! Lawsuit is filed and Subpoena's issued, yet they in Austin at 4200 Smith School Rd building refuse to answer the subpoenas or lawsuit Discovery motion we filed last Spring. Of course my attorney is now having serious health issues and I need help with this matter, but so called "Institute of Justice" turned me down flatly since I clearly do not matter to anyone. smh!

Reminds me of the taxidermy guy when they insisted on searching his shop when it wasn't open. If law enforcement watches you constantly, they can charge you with something. Nobody's perfect, and nobody knows every single law. You will break one eventually, especially ones you probably don't know exist.

They can do whatever the court lets them do, and the court is part of the government, so it tends to agree with the other parts of the government. The main limits are the voters, and higher courts. Getting a higher court to hear a case is difficult and expensive, and that court might agree with the government anyway, meaning you need to appeal even higher, which is even harder. Getting a significant number of voters to care is difficult, and only works if they can connect the problem to either caused or refuse to fix the issue, and there is a viable candidate opposing them who you actually think will do something about it.

I remember the case. Speaking of the Institute of Justice they have taken up the case of the federal Court lawsuit regarding the lawsuit against the family court judge who conducted a search of a litigants home during a divorce hearing. John The Civil Rights Lawyer of W Va announced that the West Va supreme court denied Judicial Immunity. It is now going to the fourth circuit in November. I'm sure you have covered it. Between you, John and IJ that will only help bring public opinion to bear on how the people feel about thier rights

I tend to gain a new tree stand or two every few years from people trespassing on posted land to hunt. We find them on the land and wait till the evening before opening day to remove them. We have cameras and catch NYS Department of Conservation Officers trespassing also.

There was a case in West Virginia a few years back where some old dude caught a game warden on his property without permission or warrant and stuck a gun to his back and marched him back to the house and called the Sheriff. Sheriff cited the game warden for trespassing.

Just goes to show, shoot first, ask questions later. If you find a trail camera on your property that you didn't install, it for target practice. Unless the trail camera had a US Government property sticker, you have not obligation to search for the owner. It's trash. Being a good steward of the property, I can to remove it.

Steve, My father was a game warden in Vermont for 40 yrs. he worked people shooting deer at nite with a lite ( jacking deer) he would get a complaint of peopl using a lite on his land dad would rush to the location in his cruiser WITHOUT HIS HEADLITES ON . But it was at the landowner invitation. Half the time he caught them with a jacked deer He somtimes "worked jackers" by parking on private land at nite with his lites out BUT ONLY WITH THE LANDOWNERS PERMISION.

All government employees should be required to pass rigorous randomly timed psychiatric evaluation that have 100,000's of different possible questions to try and root out lazy and corrupt/power hungry people. This would include people placed in power by politicians and including politicians. Fail the test lose your job for 10 years.

Steve I thank you for all the information you provided on your KZbin video, I can't help wondering why so many people who work in the law department and inforcement are so willing to break the law themselves and not be held accountable, but yet if any citizen breaks any law they are willing to come down on them as heard as they can. "We the People University" channel explains it quite simply: Most "law enforcement" persons don't themselves know the law to begin with! He also point out that it takes like 2 years of training to get a Beauticians license, but a mere 90 days to get a peace officers license. People working in your Walmart Nail Salon have got more training in their profession than most law enforcement officers have fresh out of the Policy Academy! I had a sheriff's deputy once explain to me how the property line of my property extended straight up into the sky to the edge of space. Like, I wish!

There should be some sort of parallel between this case and another case you mentioned some months ago, in which the police needed a warrant to review their own body-worn camera video captured during a visit to someone's house during a welfare check. The BWC video captured what appeared to be contraband that was not noticed during the visit, but was the basis for a subsequent charge after video review. The court ruled that since none of the visitors noticed it during their visit, they'd have needed a warrant to review the video to find it.

Just for my own protection, after being approached by any law enforcer asking permission to place cameras on my extended property, I'd tell them to first produce for me a formal request that I would conditionally approve after discovering exactly where and why such cameras are needed, and how they will be implemented. I'd also demand an indemnity against anything recorded that may otherwise be used to possibly indict me or other property residents (and authorized visitors) for recordings made beyond any area not specifically permitted by said prior agreement. While you may trust the cop you're talking to, you should never trust his boss. Get everything in writing.

I too have sent multiple letters requesting action against civil forfeiture to every one of my state and federal representatives as well as several candidates running of office this fall. I've not gotten a single legitimate response from any of them; most did not respond at all, and one of them sent a form letter about having received my concerns "blah blah blah duckspeak", the same form letter he sends to every inquiry about anything. Not one single government official "representing" us is going to take action against this because they all benefit. 68 BILLION dollar stolen from citizens who have not committed any crime and that's before you add in the MILLION dollars stolen from people going through the Atlanta airport. "Get off your duffs" indeed, start giving $5 a month to IJ, and start emailing your so-called representatives, because you will be next! It doesn't stop here, people.

First if you install camera's on private property without a warrant, no notice or request. this indicates you are apparently attempting to catch the "owner" or anyone who might be seen committing a crime. If you have enough evidence or Reasonable suspicion then obtain a warrant. They flat out were fishing for evidence , then when the illegal camera(s) were found and moved, they committed several other very serious crimes. illegal search and seizure, false arrest, criminal trespass (since everything was based on illegal activity). Now since they were not "involved" in official and legal duties, use of firearm in commission of a felony (armed criminal trespass and detainment). As I said an Opinion, Thank you Steve for this and everything you do and bringing this out.

A long time ago police could pick up a suspect, take them i. The back and beat a confeshion out of the suspect. Then the couts came out with the miranda rights. When this happened cop agencies warned that doing their job just got harder. Every time they come out with things they are not aloud to do this is said by these agencies.

Usually, on rivers and streams that are deemed navigable, the private property starts at the high waterline. If it is not "navigable" but does have an easement allowing people to access the water, the easement would provide the setback, usually from the center of the river. (FYI - I am to a lawyer, but used to build homes in areas with lots of streams so we dealt with this often, I also have a property with a waterway easement going through it)

That is how floaters in Montanas get around on rivers going through private lands: up to the high water mark is "public" for use,.

What's navigable can be a headach though. Could have been historically navigable, but not anymore. Doesn't matter. If someone property could be considered a wetland butted up against the river then that whole wetland could be considered navigable to even if it's dried up.

@@gtd360 navigable is a legal term. Municipalities deem waterways "navigable." Having a waterway deemed navigable or not can drastically change property rights. Just because a waterway can be navigated by a watercraft doesn't mean it is "navigable" in terms of property rights and access rights of that waterway.

You misunderstand, waters deemed "navigable" by US engineer corps are in now way debatable to their unfettered access to the public, and just because a waterway is not "officially" deemed as "navigable" does not mean that it isn't

@@ScottLaffin The inverse is just because there's not water there doesn't make it not a navigable waterway. It's a headache with state law, federal law, treaties, and executive orders defining what waters congress can regulate. When I was doing fish surveys there was always a problem on if someone actually owned the bottom of a stream or not. Which some deeds had that. So technically we weren't suppose to be walking on the stream bed.

@Steve Lehto How could they get him for theft? The camera was on HIS property…where it REMAINED. He just turned it off and moved it to the house. It never left the property. They didn’t come and ask for it back. The arrived loaded for bear.

In Tennessee, any hunting paraphernalia left on your property is the landowner's to dispose of as they see fit. It would be perfectly natural to assume an unlabeled camera is property of a poacher.

I believe a key part of "theft" is "intent to permanently deprive". I'd be curious to see if they were able to make that claim.

I live on several acres in the country. I do not hunt, but many of my neighbors do. I do allow my land to be hunted with permission and notification, usually only by neighbors. I have no issue with a "Wildlife Officer" coming on my private property "for cause." (This cause is similar to a patrol car pulling over a car "for cause") I would expect the officer to make a good-faith effort in letting me know they were there. This does not mean leaving things behind without legal backing. If I find things on my property that I do not know why I feel it is my right to remove them.

Ask the cops, Has there been any poachers on my property or neighbors property?? I want to see evidence. I hope the lawyers get justice

In the Western States, such as Oregon I have found trail cameras hooked to solar panels and transmitter, in very remote areas. The giveaway was the Sun’s reflection off the camera lens. So our government is watching you in our public lands.

If it's fenced then it isn't open. Now there are some conceasions I'm willing to live with such as a public health or safety issue where maybe they are looking for the source of contamination, searching for a kost hiker... things like that I don't think anyone would have a problem with. But trespassing to set up surveillance without a warrant? Sounds like even with open fields being in their favor, that doesn't cover surveillance. I'm sure they could have easilt gotten a warrant to set up those cameras provided they had legitimate suspicion, and they could even get that to cover a time span of months. Now the next issue is accusing him of baiting. I don't think they ever had any probable cause and were just looking for properties to set up cameras. Sometimes it's a valid strategy to seek the nature of probable cause and what led to the suspicion in the first place. So why did they suspect him specifically?

Open Field Doctrine doesn't apply here since 1) the agents wandered all over the Property and 2) at least one of the Cameras was placed to watch his building (I can't remember if it was a shed or shop)...

As a Tennessee resident, I am happy to see our courts rule against this warrantless spying. I wholeheartedly hope this is upheld on appeal! I also believe that the Wildlife services argument is stupid... If they got time to setup cameras, they have time to get a warrant... Or better yet, ask the property owner... If I had trespassers or poachers on my property, I'd probably be fairly receptive in assisting law enforcement stop these people, so long as I know where the cameras were and what they were watching... But furthermore, if they can see a crime in progress, law enforcement is absolutely allowed to come on private property without a warrant.

Be careful. The more I understand the law the more I understand there is rarely justice without murder. Generally there is injustice and attorneys making money. If you end up in court, you lose if you win. You just lose more if you don't win.

Steve, I think a better question would be: "Please detail specifically for me the places to be searched and/or the persons to be searched and support that specific allegation or those specific allegations with evidence to support your suspicion of a crime or crimes being comitted?" If you can't do that? Case dismissed.
