Leaving the place of employment only protects them from being forcibly removed. It does not protect them from civil lawsuits or charges for their actions.

I got pulled over years ago for doing 50 in a 50 zone, But the cop assumed I wasn't going to slow down to 35mph that was still 50yrds away. Remove qualified immunity and you'll see cops straighten up real quick.

Me too. I ended up sitting next to the speed limit sign when I pulled over. After an argument and threat to call reinforcement she finally dropped it as I took a picture of the speed limit sign saying you are going to waste a judges time because I'll be challenging this.

I understand and truly appreciate your answer. I have an invisible hippopotamus who tends to over imbibe from time to time and gets extremely drunk. I don’t let him drive he just stays home, but I can see them purple walking him in an orange suit to their car to take him away. It makes as much sense as anything :-) but by far of all the answers I’ve read on here yours is the best take care

4 state have eliminated qualified immunity. Colorado., Montana, Nevada, and New Mexico. Have eliminated qualified immunity for state constitutional lawsuits against police officers. Every state should do the same .

Do have your lawyer over if you know you're going to be served a warrant. Having cameras present would be a plus as well as having your IPhone's recorder on as well.

In the UK we have a national barred list for constables for naughty cops. Individuals can be placed on it for a specific period of time or permanently. I know our political systems are different, but I'm sure such a system would not be beyond the wit of imagination.

We do have a "Brady List" where officers are put on it by prosecutors. Those officers are not allowed to testify in court cases. This is a death sentence since any case they are involved in is tainted. The problem is this list is local and only shared with local prosecutors. I've been a plumber for over 30 years so , I've been inside many homes for service calls. I found many homes in which unkempt would have been an understatement. It was not any of my business to judge how a person lived so , I learned to accept it long ago. This story is a perfect example of why I don't let cops in my house or answer their questions. They will take photos and make fun of you, even on the internet.

Resignations mean she walks away from her police job avoiding the repercussions of her actions, is free to work anywhere else, and still receives a life pension from the city. Where is there any punishment in that??? Her and the officer violated that ladys rights and took away her freedom with the threat of a prosecution. where's the justice in that???

This seems to be the kind of police state our country is turning into. I had a very similar experience. After taking my girl out to dinner, she wanted to stop for a few drinks. I was driving, so only had sodas all evening, while she got quite intoxicated.and started a fight. I left her at the bar and went to a nearby hotel for the night since I didn't want to put up with her any more. Once settled in for the night, I had a few drinks to calm the nerves and relax do I could sleep. A couple hours after I had checked in, I get woken up by the usual cop knock at the door. Cops were there to "investigate" a disturbance at the bar by my girl. Apparently, they found my car in the lot, so knew I was there. After asking a bunch of questions, they took me to the parking lot, gave me the roadside tests, and arrested me, and impounded my car. Cost me hundreds to get my car back after several weeks of storage because cop claimed he needed it "for his investigation." Not to mention the high cost for an uber to work and back during that time. This was dedpite the fact they had video from the bar of me NOT drinking all night, but their claim I "might" have been drinking before I arrived at the hotel. It cost me roughly $14k to finally beat it in court. But this shows nobody is safe from police misconduct even behind closed doors.

@@lwilton That's the problem, they'll put out the call that you've barricaded yourself inside and are considered armed and dangerous. Every hick police department has a SWAT team and are just itching to use it. They have to in order to justify their budget. Plenty of small departments use the SWAT team to serve traffic and other petty warrants.

Here's a good one for you, Steve. Back in the 70s, I was drinking at a bar, The Mad Hatter, in Underground Atlanta, when ready to go home, I ask the bartender to call a taxi for me, which he did. As I was being driven home, a cop pulled the taxi over for a tail light infraction. The cop smells alcohol on me, asks if I've been drinking, to which I replied, I hope so. The cop arrests me for, I kid you not, "Being drunk in a vehicle." In court the next morning when questioned by the judge, as to why I was drinking and driving, I explained that I wasn't, I was a passenger in a taxi. The judge's reaction was priceless, he raised one eyebrow, and said "Excuse me?" After reading the detailed report, the judge instructed a bailiff to have the officer report to his chambers, turned me loose with an apology, and instructed that my employer be called and told exactly why I was late for work.

Omg , About 10 years ago I got pulled over for doing 25 in a 35 And no matter how I try, I just could not explain that 35 was the upper limit not the mandatory speed and I was promptly arrested for arguing with him. the next morning in court the judge had the exact same reaction as your judge did 😂🤣😂 For me, they waived the fees for towing, and Impounding on my truck. The following week I saw that officer driving a paddy wagon, and just snickered.

See, my theory is that there have always been jerk cops because out of 100 plumbers, you are going to find one or two jerks! There will always be some. However NOW A DAYS my theory is that if you are a jerk cop, it's rewarded and backed up by the courts. We have here two examples where the court caught the cop and did the right thing, but I have heard about countless examples where the courts back up the corrupt cops. I blame Carl Marx. Straight up. It's happening all over the world. Not just the United States. It's tyranny. Plain and simple.

Running the plates sounds like work. He's an important official who doesn't have time for that. I suspect it wasn't even an assumption. He really is working a drunk driving case, and she really is drunk and part of the case. Add in a stupid lazy cop, and he just arrests the drunk person associated with the drunk driving accident without ever considering what her role might or might not have been.

I was present for one of these. It was a family member who didn't live there, a daughter-in-law IIRC, who called police and EMS on a guy who was only marginally inebriated in his own house. My partner and I were the EMS who showed up. After understanding what was going on - seemingly an over-controlling daughter or daughter-in-law, I took my partner aside and told her that "being drunk in your own home isn't something to be arrested for, nor be drug to a hospital for." My partner agreed, so I told the police that we weren't going to do anything to the "patient." The police decided that they weren't going to do anything with the "suspect," either, and instructed the woman who called us all to leave this man's house.

@@johndeeregreen4592 my legal education was cut short by trauma. But I'd tell this for sure (unrelated to this video), never feel confident that any case is slam dunk. Do your due diligence intensely. Short story: Someone took my stuff. I sued for my stuff back. In open court, judge asked, did you take her stuff. He answered, yes I took her stuff. I lost the case. And my stuff. One of the biggest WTF moments of my life. Now I'm old. Life, and cops and court, are like that. Best of luck to you in your career!

Steve you're missing the point. These seemingly harmless old ladies do many things. Look after Grand children after school, help out at homeless shelters , feed the needy ,run fundraisers for schools , organise charity concerts and so many more dangerous things. Thankfully we have trained fearless officers who stand in their way and protect us... I have been unfortunate enough to have been accosted by a grandmother who plied me with a hot chocolate drink and a coffee walnut cake with flaked chocolate on top...I was so traumatised that I went and had some more...am I caught in their web of addiction...?

You don't need training to know that its not illegal to drink in your own home. They knew it wasn't illegal. They knew they had no grounds for arrest. they were trying to score brownie points for a chief that had no regard for citizens' rights or well being. Similar to my case ,I was arrested for the intent to DUI I was at home doing yard work and barbecue going when sheriff's show up looking for some four wheelers and a loud truck I had a truck but not what they were looking for, I was searched and arrested for having my keys in my pocket and they tried to charge me with intent to drive after I had been drinking 😢 I was let go one week later and charges were dismissed, I should have filed a law suit and showed them they can't make assumptions a crime...

This story kind of reminds me of a thing that happened to Patrick Roy, when he played for the Colorado Avalanche. His family was in Montreal on vacation. Patrick had a really bad game, at home he was yelling and slamming doors and other things you do when you are angry. A neighbor called the police on him for destruction of private property. The police arrive and talk with Patrick for a short time and the neighbor asked if they were going to arrest him, and the police asked for what? The neighbor said for the destruction of private property, so the police asked Patrick who owns the property and Patrick said he did. The neighbor really wanted Patrick arrested and pushed, so the police said "for what, destroying his own property?" Neighbor said of course ... The police laughed and walked away.

She's just an over achiever. All she had to do is get the stats right and be good on paper. That's like when people act busy in front of their boss even if they're doing nothing useful.

I've said it for a long time. Police in the USA are out of control. "We the People" have got to gain control of the people that we pay to protect us.

Here's a scary, but VERY true fact: Situations similar or even mirroring this incident happen EVERY SINGLE DAY across America. While there truly are MANY great Police Officers and Departments out there, there significantly more crooked, tyrannical, bullying, and power-hungry ones as well. This is EXACTLY why you, as a citizen, need to video and document EVERY interaction that you have with ANY badged official and ALWAYS stay up to date and current on your rights, privileges, and responsibilities as a said citizen. The more unassailable proof of corruption and misconduct that is publicized and reported, the sooner we as a nation can again live our lives without the fear of being persecuted, prosecuted, exploited, or abused. And according to THE SUPREME COURT OF THE UNITED STATES, filming/recording of Police Officers while they're on duty and acting as a sworn law officer IS permitted, allowed, and HIGHLY recommended.

I used to think there were good police out there in my twenties. Now that I'm in my thirtys, I know that all police are trash. If I worked somewhere and trash worked next to me and I allowed it, that would make me trash

Everyday across USA a fireman pulls an electrical meter, for a kitchen fire. The fireman's brother, a local realtor, will buy and flip the house because the elderly owner cannot afford to bring the house up to new codes and get the electrical meter reconnected.

If the police went to a judge for a search warrant because she was drinking at home the judge would probably ask the police if they were drinking or smoking.

I wonder if it would be worth generating your own "bodycam" footage by setting up a discreetly placed home security camera or two, with some automation you can trigger that would on-demand start streaming the confrontation to a cloud storage solution so that it's preserved even if they wreck the place (being sure to test it out on occasion to verify that it's still functional). Then at the very least, if the police wrong you, you can pull that footage out of your pocket later on to demolish them in court and get compensated for their actions

My mom did that. She lived a small village in Canada, a prisoner had escaped in the area. The police warned people not to answer their doors and to try to stay inside. At about midnight they were going house to house doing wellness checks and of course she was asleep when they started knocking on the door. Her dog started barking and she couldn't here them over the dog. They were walking around her house shinning flash lights in all the windows and knocking on them trying to figure out if anyone was inside. They finally got her alarm company to call her. They ask her if she was aware they were outside knocking and she told them "Yes I did of course I didn't answer the door at midnight after they told me not to. Anyone can bang on the door and yell police that doesn't mean they really are."

@@anniestarlight Take a look at the Civil Rights Lawyer's youtube channel. First thing they do now is destroy your cameras, generally when they are at the wrong address to begin with. All you get is the few seconds when they start to destroy your camera.

​@coop I believe his 1st case video is of those "bad apple popo's" illegally breaking & entering after smashing all the visible cameras & rummaging through the house...even testing the guys dead friends ashes for drugs. Unknown to the dumb a's the guy had another secret camera set up that caught them. Watch that video set for more, but it's wild & full of corruption.

@@coop5329 That's why you hide/disguise them sufficiently well so that you at least catch some of what they're doing before before they find and destroy it, or even better if they don't find it, catch footage of what they do when they think they're not being watched
