She had guns pointed at her by men who KNEW they had the wrong car, but treated her like a criminal, because the morons were incapable of thinking beyond the training they received. Her gas tank was punctured and leaking, but the morons left the ten year old in the car. Good job, Commander Hale.

Such is Government’s reaction: “never admit responsibility.” IMHO There must be some attorney in that state that would take the case under “continuancy”. . . But maybe not! In such a status , the State Bar should assign such grievances to a large firm to represent the woman Pro Bono. Let me guess; The State employs all of the large firms to represent them from time to time, so they cannot be used to sue the State. How convenient! Morality cannot exist in Government, “we don’t want to set a precedent”. Vote the decision makers out!!!!!

This highlights a major flaw with the grappler idea. If it only works “by surprise” and therefore you don’t deploy lights or sirens, you deprive any driver of the opportunity to voluntarily comply with a traffic stop, which most driver would likely do.

That’s my thought, too. If the person “fleeing” wasn’t aware they were in a chase, how can you establish it’s appropriate to use this? It also has the major disadvantage of doing what happened here, if you approach the wrong car, they have no idea they’ve been caught up in a “chase” until you’ve crippled their car at 50 mph, leaving them to crash.

It's also why they had to keep up the pretense of a "high-risk" stop (further traumatizing her), because if it wasn't "high-risk" then there was zero justification for deploying the grappler.

The excuse with the necessary surprise is utter bs! I’ve seen helicopter videos where grapplers were used during high speed pursuits. It’s more tricky but absolutely doable. The PD just wants to cover up their officer’s blatant negligence.

Not necessarily; it's supposed to be used during a chase- if you get close to the car you're chasing, you take it down using the grappler instead of a using pit maneuver. The problem here is that it wasn't used in place of a pit maneuver like it's supposed to be, but out of nowhere, in a way that deprived the woman of her rights by not permitting her to comply with the stop.

I really have to question what the dash cam was not on or working. Dash cams and body cams are a great thing for the police. almost all the time they end up showing the police did their job right. The only police that do not like them are the ones who are doing shady stuff and don't want to get caught. All of the police officers I know like them as it prevents people from making shit up. Just like WalMart video cameras in their stores because they are good for catching shoplifters and con artists who will fake an accident in the sores looking for a pay out.

The supreme court doesn't have any teeth to enforce rulings. They need to call in the national guard to enforce rulings against police. Police only follow rulings when they are forced to.

Yep, there needs to be a national standard for policing. Which, at a minimum, includes a zero tolerance policy for police who abuse their power, and an accountability clause that prevents police from screwing over citizens when they destroy their property.

The correct resolution here should have been the police to pay the bill to the repair shop and also pay for a rental. If they totaled the car, then they should pay for the replacement. No delays!!! Anything less is unacceptable.

Especially if they are trying to do this by stealth! Meaning the victim's car was not speeding, or driving erratically. They should have had plenty of time to check the license plate, or get some other confirmation that they were following the correct vehicle before taking action.

The cop who stopped that lady's car had a new toy, and really wanted to use it. He didn't wait to confirm whether or not he was using it on the correct vehicle. He did not attempt to pull the vehicle over without using the device. He wanted to use it so badly, He just used it when he thought he could get away with it.

It's Phoenix police. Has anyone surprised. Just the other day a lawsuit was filed against them because they held a guy down for 4 minutes when it was 114° outside on blacktop which is going to be much hotter and he had Burns all over his body and the police said oh it was a training issue cuz we never trained them not to hold the person down on super hot blacktop. And there are several other issues with Phoenix PD

@@agord7591 The more I live, the more I see that a lot of Seinfeld scenarios are not that far fetched. This type of thing always makes me think of George and the cleaning lady, and he tries to save his job by saying nobody ever told him he couldn’t sleep with somebody in the office, if only they’d had that training, he’d never have done what he did. George got fired, but for police, they make those types of excuses, and it often works. So yeah, nobody ever told them not to burn somebody’s face off on a 175 degree pavement.

That's why always film the police. Get a dashcam, and if you see a cop approaching, start recording on your phone. They equipment WILL always "malfunction". Or the footage gets "accidentally" deleted. Or the cop "forgets" to upload it.

Even IF they paid her the KBB value of her car, 1) She still had to go through all the hassle of the claim 2) The KBB values probably won't be enough to put her into a comparable car without her spending out of pocket or taking on a payment 3) You can't discount that a reliable car that you know is better than an unknown used car that you get to replace it.

Can she file for additional money for expenses? Ie; car rental(which they paid probably 14 days), supplemental rides(cab Ubers, Lyft & so on? This lady was just hauling her daughter to her dad's house. Police department #1 should have a fundraiser for her... They do it for everything else they deem necessary. Why not one of their screw-ups? Her own insurance company is to blame as well! Failure to payout & go after municipal insurance & offer a rental for at least 30 days like I've seen done countless times before. Oh wait... The insurance company is too busy raising rates on POS new vehicles that the manufacturer's over priced because they took it upon themselves thinking about the share holders & year end bonus!

Also if she was upside down on the car loan she probably lost everything getting payoff on vehicle. And if she had a car loan did she have the financial insurance banks love to tack on? I think it's very difficult to get any payments from any jurisdiction. My home in Berkeley California was broken into by police, car was searched - oops, he doesn't live here any more (I lived there for more than 2 years, so it was before me). I tried to file a claim against the city - $36k damage quoted from two different contractors plus $3500 on my car. Denied because they are not libel for more than $5k, they have a law for it. I had zero recourse. I suspect others have zero recourse as well. Legal options do not work. I really am disturbed by the police attitude ignoring civil rights and by city bureaucracy that makes it impossible for citizens who are wronged to be made whole, especially in a timely manner. How do we punish these people?

When the police make a wrong call like this or anything similar, they should reach out and make sure the damage gets fixed at their expense and pay for any psychiatric treatment if needed and some money to compensate for the incident. Many years ago I was involved in an accident in which a US Postal worker pulled his Grumman mail truck out of a driveway directly into the path of my motorcycle. He claimed he never saw me. When I tried to involve my insurance company, they wanted no part of it because it was the fault of the other driver. I went to the Postal Service and they sent me a form letter which basically stated that I needed to pay my medical bills and for the repair of my vehicle and then submit a claim, including receipts for my costs, and they would reimburse me for what THEY DETERMINED I was owed. Well, I payed for everything but, instead of turning everything over to USPS, I took everything, including their letter, to an attorney. He took one look at the letter, laughed out loud, and said, "They've been planning on screwing you from the get-go." He filed suit and they settled a claim that SHOULD have cost taxpayers $14K for a whopping total of $68K. And, oh yeah, it took 4 YEARS to make it happen.

I'm always amazed about how little police are expected to know without "additional training". They need training on how to read street addresses so they don't break into the wrong house. They need training on how to read license plates so they don't destroy the wrong car. They need training on how to identify people properly so they don't arrest the wrong person. Most normal people learn this stuff in grade school.

I’m ok with qualified immunity for the cops on this one. I am appalled at the city’s response, compounded by the cops leaving her to walk home with a child…a potentially dangerous even deadly situation. Qualified immunity means the cops don’t go to jail nor pay from their own accounts…it does not mean the city is not responsible for the actions of its employees.

This should be referred to the grand jury for criminal negligence, with willful damage, referral to a criminal court. Training to learn how to identify a suspect? Come on law enforcement, ESPECIALLY the prosecutor. These idiots have a real "cover my ass" problem. Anytime there's an auto collision that causes damage, you have to go to the other person's insurance to get your money. If she didn't do her due diligence to get that police officer's personal car insurance, she won't be getting it now, because the police station is in full hornet's nest mode

I can get ticketed for going 20mph over when I was actually going 10mph over because that checks the biggest penalty box before being a serious infraction, All to line badge and department pockets. But they also have no accountability when recklessly destroying my property either by mistake or incompetence. So we objectively factually live in a tyrannical police state even at the lowest levels of government authority here in the land of the free.

You know how we could avoid this? Put Government issued Identification numbers on cars to tell them apart. We could call them Vehicle Identification Numbers and put them on various places on the car. But then we add a second very visible identification Tag on cars on the front and back, so cars can be quickly identified. Maybe we could call them "license plates". Patent Pending

"It matched the description" So they misread the license plate? Because something tells me they didn't even bother to verify the license plate. Some cars produced by the Millions, it's the right color make and model isn't matching the description it's enough to investigate but not to use potentially lethal force.
