Speaking from experience, a throttle is much safer than pedaling from a stand still. A bicycle will lean from side to side when pedaling & it's possible to swerve into cars while trying to get the foot throttle to engage. Then the pedal assist gives a sudden surge of power that can get a rider off balance & cause crashes. A throttle is very responsive & can be gently engaged for smooth controlled acceleration in traffic surrounded by tons of cars no match in a wreck with a bicycle.

I don't know about your area, but around these parts the vast majority of e bikers are not pedaling at all, most of those cheap bikes can barely reach 15- mph on throttle only. On the other hand, I see tons of human powered bikes going way faster and no one questions them or whether it's safe or not.

As you're talking about the problem your not keeping to the right unless theres a bike lane....its a bicycle...keep to the right unless otherwise guided by bike lane. But your right safety regs should be the deciding factor not the engineering ( throttle)of the bike.

Mark just came back from a 20 mile New England ride . As I rode on a well defined bike lane with protected barricades , a gas powered moped with a rear license plate stop next to me , I mentioned to him , the best I could it was very cold , you probably should not be riding in this lane . The man did not know and thanked me and moved to the street. So this may just be a lack of understanding with some of the rule breakers .

I don't live in cities that run extremely fast ebikes. I observe and follow road laws including staying on the shoulder, pulling to the side to let traffic go and allowing traffic to turn or go if I need to turn. My ebike does 35mph and in some neighborhoods I still keep the 30 mph speed but slow down if traffic is heavy.

Don't worry they will get sued over the throttle law above 28 mph not being safe just like they had to end up taking down all of the red light cameras because it made people more likely to speed through intersections causing accidents.

I would say just let us put insurance on these pedal less ebikes and scooters that can go over 28 mph. That will solve most issues. They are prohibited on most bike trails and parks anyway. Let us use it on the street and I'll be glad to pay tax and insurance.

I have never considered buying a throttle only e-bike as I feel the whole purpose of riding my bike is for the exercise. Now I am interested in pedal assist because where I live it can get windy where I have the wind at my back one-way and then head on the other. I just want some assistance when that happens. Would the throttle people be happy if they still allowed it up to the 28 MPH? Because I do feel it is ridiculous to not allow that. Any bike going faster than that should be considered a moped or motorcycle. What I don't get with the new law is it says mopeds do not need pedals. All the original mopeds were motor/pedal hence the name. If they didn't have pedals they were scooters or motorcycles. The Surron should be classified as an off road motorcycle since they are so fast.

The reasons given for no throttle are a lot but probably the most important two are: they want to differentiate from a bicycle and a moped. Pedaling to 28 gives more of an appearance of a bicycle than a moped and they believe that is important. The 2nd reason is people pay more attention when they are pedaling. I've noticed that is slightly true but for longer distances. There are about 4 other main reasons but I think those reasons are pitiful reasons so not even going to mention them.

A Honda XR150L Motorcycle is under $4,000 ride away cost and gets over 100 mpg. More like 125 mpg. This bike can get over 60 mph. Insurance cost on a little bike can be under $30 a month. Depends where you live. Why not just have a regular lame ass 750 watt electric bike and a little motorcycle? Also there are electric motorcycles you can actually not worry about pedal or throttling speeds. Honda Cub is cool.. Honda Trail 125cc is cool.

I have an XR150 and never got more than 80 MPH on two 50 mile trips at 50-60 MPH. Of course I weight 225+ and after adding weight with accessories I get closer to 68-70 around town but, I do ride it hard because it's more fun to ride a slow bike fast than a fast bike slow. I also put larger carb jet.

I’m going with a controversial opinion. I have ridden both street motorcycles(licensed M 1) and bicycle commuter. When the poop hits the fan, A good portion of people will probably freeze with the throttle open. I can’t even count the number new e-bike riders using their feet as a brake. I usually told new riders to avoid the class 3 with throttle.
