Mam, order 1 Rule 9 mein kaha hai no suit be defeated by reason of misjoinder or nonjoinder of parties.. proviso bol raha hai the rule shall not apply to nonjoinder of parties.. So kya non joinder of necessary party k case mein suit dismiss hojyga? Yaha thora confusion horha hai😟

Ha ho Jayega. .. yhi BAAT khta hai proviso.. agar necessary party nhi hai suit mein to phir suit defeat ho Jayega. Usmein phir rule 10 hai. Court application se ya phir Apne aap bhi add krwa Sakti hai party. Because necessary party k Bina suit adjudicate nhi hoga. See rule 10 ..
