It’s easy. Once you are a continuous study, you’ll put things together with ease. The best thing about this video is him mentioning attenuation which no one mentions. Wish he spoke on the ‘silver platter’ doctrine. Cops 👮‍♀️ 👮‍♀️ think they can get away with that when they can’t!!!!

What do you call it when they steal a key and come right on in when you are gone? And the police going through private paperwork in a sealed bag without a warrant?

If i lie to a police officer during the traffic stop can this law still defend me in court. For example the police officer asks “do you have anything illegal.” And i reply “no.” And the unlawfully search my car against my consent and find something illegal. Will the exclusionary rule still be something I can use in court?

@@princessruth9155 Oh yes, the police gets involved in warrantless arrests all the time. There are multiple exceptions to the warrant requirement that will establish when it is a valid or invalid warrantless arrest.

Regarding impeachment, when you say that impeachment doesn't apply to involuntary confessions under the 5th, do you mean confessions without an effective waiver (i.e., a coerced confession is not "voluntary" and thus no waiver has taken place) and thus cannot be used for impeachment purposes? Or 5th amendment violations in general? I think of Miranda encompassing both the 5th and 6th (although they have differences) so I am a little confused.

how wld a warrant have someone elses adress on it with someone elses name? or lets flip it, perhaps putting the names of the homeowners AND the perp on it tho.... but i dont think thats workable on a regular. it really needs to fit. homeowners need to have culpability.

Yes, as long as they have probable cause (maybe an informant) that the person is in that house. They can also corroborate the information by watching from the street and identifying the person they (the police) are looking for. Maybe the person's car was parked outside or near the house. I know this response is late, but it is to bring light to the question as the other responses were not too helpful.

I will add to it by stating that when law enforcement has probable cause to believe that a suspect is in a third party's home, they MUST obtain a separate search warrant before entering the third party's home. Of course, there are exceptions to the warrant requirement, such as hot pursuit, exigent circumstances, etc. Again, that is an AMAZING answer...I am nervous about the previous answers because it can be dangerous to spread misinformation.

Miranda is a consensual contract offered, if not refuted, then becomes tacit, and an agreement (informal contract). With covenants (contracts) we generally forfeit our CONSTITUTIONAL GOD GIVEN RIGHTS (unless reserved)... That's why Miranda is applicable to the poisonous trees constitutional violations... Inevitability is simply "public" vs "private"... Miranda is Latinized as to mean "to be wondered at" (aka, admire, from mirrored).. read Shakespeare's, The Tempest. ~ INERTIA
