That’s the game. You don’t have any real due process rights until you hit the special court martial level, and you can refuse the summary proceeding. The trade off is in order to get your rights you raise the stakes tremendously. Summary can only give you a month in the brig, special can give up to a year along with pay forfeitures

Even in the post-war Navy, a Seaman with 1 service stripe (indicates 4-7 years in service) ahows that the sailor might not be a "team player". I recognize I could be wrong.

In the case of a Summary Court, at least in the late '80s, the proceeding was very much as shown. No recorder, though there is no recorder for an Article 15, aka Captain's Mast either, no Master at Arms, no one except the officer of the court and the accused and such witnesses as are required. Having been the officer of the court once, that's one lonely feeling job.

Damian Flynn They are both indicators of human frailty and/addiction in an environment that demands discipline. Sure, smoking was acceptable, but when you think about it (when I do, at least), it seems odd that one guy with an addiction is punishing another guy with an addiction in a place where neither "should" be allowed (quotes used because I'm not qualified to say with any authority).

A man who drinks past the point he has a blackout,becoming quite possibly dangerous to his shipmates or the ship,a crowded place full of machinery that has to be worked with discipline and care. Yelling and needing forcible confinement till sober. Record of previous misconduct
