आपको यह मालूम होना चाहिए कि पूर्व सीजेआई तीर्थ सिंह ठाकुर ने माना था कि NJAC एक बेहतर विकल्प है। इसमें fine-tuning करके लागू किया जा सकता है। और भी कई पूर्व जजों ने collegium का पुरजोर विरोध किया है। बदलाव होना चाहिए।यही देशहित में है

So many IAS, IPS and IRS and IES officers have been asked to take voluntary retirements after they failed to carry out their duties properly and efficiently. Why can't judges be judges too based on their efficiency and performance ? Judiciary is one branch where once you get it, then no matter whether you do anything or not, you'll get to serve till you retire. The salaries and perks of such judges are just a burden on public exchequer. Weed them out and see how judiciary function improves.

judges need to pass exam to find if they are fit for the judges job, they can not have their own personal god-forsaken agenda. If need be sack the whole existing god-forsaken collegium, which is getting rotten. Judicial services exams to appoint a judge should be a must . . !!!

One thing is clear, Modi can not digest judgements against him or his government. Just listen his law minister, supreme court shall not hear bail applications. Isn't it indicative of taking away the fundamental right provided by constitution, article 32, right to constitutional remedies?

🙄😡🤔 There are so many of excellent practicising advocates and juges who don't become SC etc juges or CJI even after passing judiciary exams...And appointments selections should only be decided on Meritocracy, wr criticise about Nepotism in Politics...Film fraternity...Corporate..No where in the world other than India, this Collegium system is there. 1. Corruption at Juges level especially in Lower Corts. Just anyone can check yourself, the status of any juge staying near your home, check his wealth, property, vehicles, travel etc and you will yourself get to know his wealth status. 2. Nepotism : Check profile of Juges, their parental and you will come to know. Lotsa of juge ka beta juge. 3. C0llegion system..No transparency a. No minutes, transparency, notings files provided to government when they send proposal for appointment. b. No collaborative approach by collegion when government raises objections to juges selection by them. If there are objections, proper minutes, explanations and reconsideration replies should be there. c. There can be a panel to appoint juges comprising of noted public members, executives as well as juges. d. Minutes of C0llegion is not allowed to be shared under RTI. e. Collegion is not in Indian Constitution. f. Juges wealth is not getting disclosed. g. No country across the world except India has collegi0n system of juges appointing juges. Will developed countries like US, Australia, UK, Germany etc adapt such system 🙄 4. No focus on reforms in courts a. Video hearing which was started during covid seems withdrawn b. Online submission of documentation c. Cort fee deposit n fee refund modality is so delayed and unstructured with Delhi Stamp Duty dept folks seeking money for refund approvals. d. Gate pass, litigants needs to stand in line for hours e. Millions of pending cases across courts, some going on for 30..40 years also. f. Inside Court addressal system still we use MiLords, Your lordship of British era, Court dress code of black gown etc needs reforms. g. SC court functioning even at night and immediate one day listing for accommodating 'elite' lawyers cases for Singhvi, Sibal, Dave, Chidabaram, P Bhushan etc whereas public listing is given after months. h. Jugements vary across juges due to archaic british laws adopted by India which needs to be revamped/scrapped. Indian Penal Code needs to be rewritten in current context. Kiran Negi case is classic example...Lower and High court gives death sentence, SC frees accused. i. Ink and Paper dating forensic technique still not there. j. Numerous property inheritance related matters bcos there is no law which considers Unregistered will as invalid whereas there is already a Registered will. So anyone can bring 2 bogus hired witnesses, get a good forger and dispute a Registered will. 6. Juges work timings, vacations : a. No profession except teaching and judiciary allows summer and winter vacations. While vacation in teaching profession all understand as kids are there, but we do not understand need for one month summer vacation and 10 days winter vacation when there are huge cases piled up. b. Corts hearing timings are as low as 5.30 hours per day with 30 minutes lunch break. Compare this with working hours of private or government employees. 7. No focus on streamlining laws across communities in secular nation : - Control over temples whereas Mosqes, Churces etc are free - WAKF Act only for one group - Places of Worship Act - No parity of Imam salaries Vs Other Religi0n salaries...So hold over temple funds but not on chrch, mosq funds. So govt are using funds from temple etc to pay for salaries etc for other religi0n. - Quotas based upon castes, trine etc continuing since independance. It was initially for 10 years but still comtinuing. It needs to be modified to EWS related modality. Unnecessary interference into Executive, Govt when their own system is needing major overhaul..So they should focus on reforms into judiciary asap.

@@gauravkakkar8022 exactly judiciery has setup monopoly system for their own whereas they are putting their legs in every law made my lower and upper house which doesn't come in their scopes. You can even laugh that no agencies or no one can ask/inquired their corruption , RTI info. They made a system called collegium to benifits their relatives which is not mentioned in constitution .. entire judiciery is driven by those 60-70 families. Also lower court gives different descision ,high court gives other and sc rejects or gives another on same case so who was wrong and if wrong then what action had taken on those judges ? Instead of maintaing the transparencies everything is hidden to all and they don't want even fair interference of others whereas they are desperate to interfere in every policy related matter of elected govt and bill or law constitutionally passed by govt in parliament .

Judiciary ka exam hota h.. Lower court mai all over India jo 20000 judge hai sab ne exam crack Kiya hua hai... 1100 judge in High court and 35 judge in supreme court collegium ke part hai.. High court and supreme court mai bhi judge lower court se promotion se aate hai

Supreme Court is one of organs of government not above sovereignty of India and Government is not binding to alien rules of laws British colonialism judiciary dealt with by Supreme Court judges appointed by collegium system now disputed. People need abolition by President of India MS Droupadi Murmur by cancelation of temporary official in favor of Supreme Court. Supreme Court subject to control of British colonialism judiciary not subject to recognition and control of preamble of constitution not acceptable to people. There is no liability imposed upon concerned area competent authorities to dispose of complaints of people victims of atrocities exploitation and corruption enfringement of rights so indisciplined judges advocates patrakars and political parties invade sovereignty of government of India liable to be prosecuted under seditious conspiracy statute. Judiciary subject to recognition and control of Preamble of constitution of India should enact democratic laws to overcome lapses and irregularities of legislature executive and judiciary under control of government of India. VS British colonialism judiciary subject to recognition and control of Supreme Court should be revoked from Supreme Court by President of India incorporated temporarily in article 50 in 1950 to deal with by Supreme Court for time being not for 75years to continue alien rules of laws harmful to people enfringement of rights in 5 crore backlog cases pending and 17-18 lakh under trial prisoners.
