As a layperson affected by erroneous immigration decision-making, I just want to say that nothing is ever certain untill it is Under US immigration law. Any decision can be reopened or rescinded, revoked, or terminated. And until then, nothing happens. Upon further checking, I realize that Chavez v. Garland (2021) Addressing defective or deficient notice to appear that does not list the date and time on the actual notice. As a result, It does not stop the clock in accruing the requisite time period. For example, for non-US citizens, 10 years off on relinquished domicile is required; On the other hand, legal permanent resident-green card holders Requires seven years Of uninterrupted residency. Because a notice to appear Without the date and time says "to be set" , According to the Supreme Court does not Stop the clock In accruing the requisite amount of years to be eligible for cancellation or from oval. In order to be eligible for cancellation a person cannot be convicted of an aggravated felony, regardless of whether they have a green card or not. I don

Hey my case revolves around what you are talking about , I was order removed in 2016 an investigation was launched in 2018 and the report of the investigation revealed that the ICE office in Wichita Kansas despite of having access to sevis system of DHS where proper compliance of immigration law was documented submitted made up charges to the immigration court and successfully obtained a removal order. Once details of they investigations where submitted to them they quickly detained me and deported me overnight on a very expensive chartered flight. I don't have any criminal record and I have 10yrs and married to a US citizen who developed incurable disease and can't work

I noticed something I have been looking for for very long time - an attorney who can reopen immigration proceedings. It says on this very video below the phone number for the attorney's office," Supreme Court to reopen old removal cases" I am very glad I found this KZbin channel because I would like to have my case reopen. This attorney seems very knowledgeable. Therefore, my question is, what Case is the attorney talking about In reference to "reopening of old cases". How do I know more. Thank you. My name is Anthony.

Yes, we do need more diversity. Reflection of the times on the bench Is necessary to represent the growing ethnic and racial makeup of America. Agent of any gender and black women are grossly underrepresented Historically and now. The time has come to change This makeup. I hope president Joe Biden filled the court as he suggests . This is 2021.

Margaret could you help me with my case. I was deported earlier this January after an investigation by ICE sevis department and Wichita state university revealed that the ICE office in Wichita submitted made up charges to the immigration court despite of having access to accurate records of immigration compliance through the sevis system and the Date and time issue

Hello Randy, you can always go to the Scotus blog.com and just search for Chavez. How did you come to be interested in this case. I am not a lawyer, but I have looked into this and similar erroneous decision-making and the Supreme Court ultimate correction of the illegal immigration and immigrant reform responsibility act of 1996. For the last 25 years, the Supreme Court has come in and address many issues that the immigration judge and the board of immigration appeal and in many cases the court of appeals have gotten wrong. Hello Rupert. This is the problem As posed in your quest in. The Supreme Court in Chavez did not address whether or not individuals who were deported with a defective notice to appear can actually reopen their case. The question for the court was whether or not a defective notice to appear stop the clock , and by doing so renders noncitizens and eligible for cancellation of removal. Cancellation of removal requires that a non-US citizen not have been charged with an aggravated felony. But more importantly, The Supreme Court decision in Chavez found that the removal order itself was illegal, But they did not address whether or not the immigration judge had jurisdiction to order someone deported When the required statutory information is not on the notice to appear - the date and time are missing from the NTA. I do believe that the next round of Cases on this topic must be, & probably will be To address the validity of such removal orders for people currently outside the United States under those orders. And whether or not those individuals are entitled to favorable exercise of discretion if they meet all other statutory eligibility requirement, such as being in the United States before being removed 10 years before the notice was issued for a non-US citizens and 70 years for legal permanent residents non-US citizens. But this might be years in the making. Nonetheless, You may be interested in a pending case that was recently Heard by the Supreme Court dealing with An unrelated but somewhat similar issue Regarding Deporting someone for a none deportable crime, and now the government wants to enforce. Removal order in its pursuit to charge the individual for illegally returning to the United States. But the bigger issue is the government
